PARTIES. The parties to this lease are: Property Manager representing Property Owner, as LESSOR; and , as LESSEE (Guest).

Lessee's family and invited guests consists of adults over the age of 25 and children and adults under the age of 25.

PREMISES. Lessor hereby leases to Lessee the following property (the premises):

TERM. This lease begins on , and ends on , unless sooner terminated (the term). Lessee shall vacate the premises by 09:00am on . In the event Lessee fails to vacate the premises at the end of the lease, Lessee is liable for liquidated damages in the amount of $200. This is because this vacation rental may not be available past your check out time.


RENT. Lessee agrees to pay Lessor the following: This amount is nonrefundable. Trip Cancellation Insurance is highly recommended. It is purchased on your behalf through CSA Travel Insurance. Please sign here if declined:______________________________. Trip Cancellation Insurance can be added with the 2nd payment but must be paid at the time of reservation if within 30 days of arrival.


Payment Schedule: 2nd payments will be charged automatically unless we hear from you otherwise.



Security Deposit - Unless otherwise requested, the credit card taken at the time of reservation will be used for the security deposit. A security deposit is required for your rental. Security deposits must be paid by a credit or debit card. Your card will be charged with the 2nd payment and refunded after departure as long as there is no damage, missing items during your stay, or extra cleaning charges. If you leave the rental excessively dirty, extra charges may apply. You hereby authorize more charges should they be necessary to cover repair or replacement costs above and beyond the security deposit. You consent to the use of your card without original signature. Any damage is to be reported immediately.


All rent and fees must be paid in United States currency without demand, setoff, or deduction to Lessor. Published rental rates are subject to change without notice.


All fees must be paid in full on or before 30 days prior to the beginning date of this lease, subject to cancellation policy. Upon departure of the Lessee, Lessor will inspect the premises and, if there is willful damage or other damage over $2000 to the vacation rental, in the sole discretion of the Lessor, your card will be charged accordingly. Please be courteous and leave your vacation rental in good shape.


ASSIGNMENT. Lessee will not assign this lease or sublet the premises or permit guests who are not identified in this lease to remain on the premises.


COMPLIANCE WITH REGULATIONS. Lessee must abide by and comply with all governmental laws, ordinances, rules, and orders that apply to tenants of dwelling units. Lessee shall observe all rules and regulations set forth on Exhibit “A” which is attached hereto and incorporated herein referenced, as may be established and/or amended by Lessor and/or Owner, from time to time. Failure to observe all rules and regulations shall result in immediate termination of this lease and forfeiture of all deposits and rent as liquidated damages. This property is part of a “Homeowner’s Association.” Guests must abide by certain rules in order to stay here. If a Homeowner Association complains about Guests’ behavior, Guests may be evicted and may forfeit all monies paid. PAYMENT OF MONEY OR MONIES, IN ANY FORM OR AMOUNT, CONSTITUTES AUTOMATIC ACCEPTANCE OF ALL TERMS AND CONDITIONS SET FORTH HEREIN. THESE POLICIES CAN ALSO BE FOUND ON OUR WEB SITE AT TRAILERS ARE NOT PERMITTED IN ANY OF OUR NEIGHBORHOODS. IF YOU BRING A TRAILER, YOU MUST MAKE ARRANGEMENTS FOR PARKING IT ELSEWHERE.


RIGHT OF ENTRY. The Owner of the premises (and Lessor as Owner’s agent) is permitted, under Florida law, to enter the vacation home at any time if Owner/Lessor suspects an action or behavior in violation of this lease. Lessor/Owner may also enter the vacation home at any time if the Owner/Lessor deems access is necessary to maintain the home, security and/or comfort of the tenants. In the event the premises are listed for sale, the Lessee agrees to cooperate with the realtor and/or Owner/Lessor to arrange a convenient time to show the premises. In the event the vacation home is under improvement or repair, Lessee will be informed upon arrival and agrees to allow said improvements, maintenance and/or repair to continue during their stay.


Lessor will provide Lessee with reasonable notice before entering the premises.


WASTE. Lessee will not commit or permit any waste of the premises, and on termination of this lease Lessee must immediately surrender the premises in good order and condition and return all keys to Lessor.


DEFAULT. Time is of the essence in the performance of this lease, and Lessee will be considered in default if Lessee fails to pay any rent or deposit as set forth herein; or Lessee fails to perform or observe any of Lessee's agreements or conditions under this lease to be performed or observed by Lessee, other than the payment of rent.


ABANDONMENT OR SURRENDER. BY SIGNING THIS RENTAL AGREEMENT, LESSEE AGREES THAT, ON SURRENDER OR ABANDONMENT AS DEFINED BY FLORIDA STATUTES, LESSOR SHALL NOT BE LIABLE OR RESPONSIBLE FOR STORAGE OR DISPOSITION OF LESSEE'S PERSONAL PROPERTY.


REMEDIES. If Lessee defaults, Lessor may exercise any of the following remedies in addition to all other remedies provided by law: Perform any act or do anything required under this lease to be performed by Lessee. Accelerate the maturity of all rent due and to become due during the remainder of the term.


GENERAL PROVISIONS. The parties agree to waive trial by jury in any action between them arising out of or in any way connected with this lease or Lessee's use or occupancy of the premises. This lease contains the entire agreement between the parties, and any agreement to amend or modify this lease will be ineffective unless it is in writing and signed by Lessee. Lessee's obligation to observe or perform the covenants will survive the termination of this lease.


PROPERTY ASSIGNMENT - Every attempt will be made to keep the property reserved assigned to Lessee. In the event, circumstances cause the need to move the Lessee and their party, a similar unit may be substituted, if available, or all money refunded.


HOLD HARMLESS Lessee acknowledges that management, property owners, and employees do not carry personal liability insurance and cannot be held responsible regardless of fault, for any accident, loss, damage or injury suffered by the Lessee, members of their party or any other guests which the Lessee or their party have allowed access to the property, regardless if said loss is a result directly or indirectly from acts of god, danger incident to the sea, any body of water, fire, breakdown of machinery, equipment, acts of government or other authorities, delays or cancellations of or changes in itineraries or schedule or from acts of omission of any airline. Furthermore, the Lessee will release and hold harmless any and all parties involved with the rental, management, and reservations of the property and to release and hold harmless it's owners or representatives for any loss or damage to personal property or for any injury and/or death. Use the pool and other amenities at your own risk. Parents should be present with children at the pool at all times.


PROPANE GRILLS – Some properties may have propane barbeque grills. Propane exchanges are not the responsibility of the Management Company or the owner. Guests are responsible for propane exchanges should it be necessary during their stay.


No pets are permitted on the premises at any time unless prior arrangements have been made and you are staying in a pet friendly rental. No smoking is permitted inside the vacation home at any time.




If smoking is evident or pets are discovered on the property, Lessee may be evicted and be charged an extra cleaning fee and pet fee.

Exhibit A: Reservation Policies



PAYMENT AND CANCELLATION POLICIES

Payment may be made by personal check or credit card and is due 30 days in advance of arrival. For reservations made within 30 days, full payment is due at time of reservation and must be paid by credit card. For reservations made more than 30 days in advance, a nonrefundable deposit, in an amount equal to fifty percent (50%) of the total due is required at the time of reservation or within 2 days if paid by check, subject to the cancellation policy set forth below.

All fees are nonrefundable unless the time you have reserved can be rented again at the same rate. There will also be a $100 fee. It is highly recommended that guests purchase trip insurance. Cancellation or early departure due to inclement weather does not warrant a refund of rent or deposit paid. Interruption of utility services, for any reason, will not relieve Lessee from any obligations under this lease.

If you are forced to cancel your trip, you may forfeit up to 100% of your rental payment. The property manager strongly recommends you protect your vacation rental investment by purchasing our Vacation Rental Insurance Plan underwritten by CSA Travel Insurance for only 6.5% of your total cost.



USE OF THE PREMISES.

A. The premises is a vacation home intended for use as a family vacation rental only. Persons under the age of twenty-five (25) must be accompanied, by a responsible party who must be staying in the unit. The premises is monitored for violation of this policy. Violators will be evicted and the balance of any unused rental payments and security deposits will be forfeited as liquidated damages. Reservations made under the false pretense that the responsible party of persons under age 25 will be present at all times will void this agreement and result in automatic cancellation of the reservation, without refund. One responsible party over the age of twenty-five (25) must be present and staying on the premises at all times, for each four (4) persons under the age of 25.

B. Quoted rental rates include the maximum number of persons permitted in the Property Description. Guests who exceed the maximum occupancy are subject to immediate eviction and forfeiture of the balance of all rental payments and security deposit as liquidated damages.

C. Lessee will not store vehicles, boats, machinery, or building materials; engage in breeding or raising of animals or birds; or conduct any commercial enterprise on the premises. No pets are permitted on the premises at any time. No smoking is permitted inside the vacation home at any time. If smoking is evident or pets are discovered on the property, Lessee shall be evicted and extra charges may apply.

D. Lessor and/or Owner are not responsible for any damage or acts of theft or vandalism, or any other damages, to vehicles or personal property maintained on the premises. No trailers are permitted on the property. Parking is limited at most properties. Please bring as few cars as possible.

E. Please remember you are staying in someone else’s home during your vacation. Please treat it with the utmost care and leave it in as good condition upon check-out as when you arrived.

CHECK-IN/CHECK-OUT POLICIES AND PROCEDURES.

A. Check-in time is 4:00 pm, CST, on the beginning date of this lease, and check-out time is 9:00 am, CST, on the ending date of this lease. Lessees remaining on the premises after the 09:00 am, CST, check-out time on the ending date of this lease shall be charged for and shall pay additional rent for each 24 hour period they remain on the premises. There will be no discount or abatement of rent for late check-in. Guests arriving after 5:00 pm, CST should make arrangements for late arrival via telephone prior to arriving at the vacation home. Early check-ins may be available.

B. The vacation home will be equipped with a fully functional kitchen and all bedding, and may have its own washer and dryer. A complimentary set of toiletries toilet paper, trash liner, etc.) are usually provided upon arrival for your convenience. You are expected to obtain such additional items as may be required for your entire stay. Telephone service with free local calls may be provided as well. Incoming long distance calls are free, however, in order to place an outgoing long distance call you must use a calling card or credit card. Free high speed Internet access may also be available, but is not guaranteed.

C. Lessee shall observe all rules and regulations set forth herein or attached to and incorporated herein by referenced as may be established by Lessor and/or Owner, and/or HOA, from time to time. Failure to observe all rules and regulations shall result in immediate termination of this lease and forfeiture of all rent as liquidated damages.

D. Key Policy: Upon checkout, please place keys on kitchen counter and lock the front door from the inside. Any lost key will result in a key charge withheld from your deposit. In the event you are locked out, please call the phone numbers provided and we will meet you at the property. A lock out fee of $25 will be charged to you.

REPAIRS AND MAINTENANCE

A. Lessee will keep and maintain the premises, fixtures, appliances and appurtenances in good sanitary condition during the term of this lease.

B. Lessee will use the premises with due care and will pay for any repairs that are necessitated by any lack of care by Lessee or Lessee's family, guests, or invitees.

MISCELLANEOUS.

A. During your stay, promptly report any maintenance problems to Lessor at,, or. Lessor/Owners may enter the property at any time during your stay in order to respond to any maintenance and/or housekeeping issues reported by you during your stay.

B. Please do not leave doors or windows open while the air conditioning or heater is operating.

C. Lessee will make no changes, alterations, or additions in or about the premises

D. Rent and all deposits may be paid by credit card by phone or by check.

Emerald Mist review We thoroughly enjoyed our stay at Emerald Mist. Everything was as described. The house was spacious, clean and comfortable. We enjoyed cooking in the large and fully functional kitchen. The outdoor bbq was adequate as well. It is an easy 5 minute walk to the beach and half of the time we were able to ride the golf cart shuttle. We would love stay there again. Zero complaints! Will be renting here again. Perfect place to stay. Plenty of room for our two families which totalled eleven. The home was VERY clean and located in a perfect spot. The pool is right outside the front door and the beach is a block away. I would recommend this house to anyone!! No Kidding, Felt Like Home We loved every minute at Emerald Mist! We happened to stay during Tropical Storm Cindy. If we would've been stuck in a cramped little condo, it would've been miserable! Home is very close to the beach, ( within 2 blocks) which was good for me since I had a knee replacement 8 weeks earlier. There is also a very nice person who comes around regularly on a tram to pick you up and drives you closer than the beach if you need extra help. It's easy getting across the scenic highway, as traffic stops for pedestrians. ( and they are pretty good about that) 2 beach chairs and umbrella come with your rental. The home is directly across the street from the association pool. Warning, as the ice cream truck stops daily so have dollars on hand for the kiddos! This home is decorated nicely with a beach theme and has everything you need to feel at home. We had 4 adults and 5 kids staying at Emerald Mist and all were very comfortable! Emerald Mist Vacation Rental was perfect choice for us. Crystal Waters Realty personnel were great to work with. Emerald Mist is a beautifully decorated, spacious house located directly across from the bigger of two pools and just a short walk from the private beach access with it's own beach cabana which served as an added bonus for our daily picnics.

Emerald Mist is a MUST! We really liked the location of this vacation rental. The entrance to the large pool is just a few steps from the front door, and access to the white sandy beaches only a short walk down the sidewalk. Fun Family Get-a-Way The house was beautifully decorated and directly across from the pool. It was a short walk to the beach and has its own private beach with a picnic area and bathrooms. We felt very safe since it is a gated community. We will go back! Emerald mist First off emerald mist exceeded all our expectations. Furnished very nicely with plenty of seating for the whole family. Also very spacious upstairs and down just in case you have a rain day. We were a party of 9 and everyone had plenty of room to do their own thing. Kitchen was set up with everything you would need to fix a simple lunch or a full coarse meal. Exterior was well maintained with beautiful landscaping. Short walk to the beach was made even better by the furnished wagon to carry all our beach supplies. (Our stay wasn't peak time so the transit wasn't running) Security was very friendly and helpful at the beach. Communication was very good though the process. We will definitely stay again. Fayetteville GA It would be more desirable if you had two full side bed in one of the kingside bedroom. It allows sibling who are grown or have a husband to sleep well on a firm mattress and not on a thin mattress on the pull outs. Also the supply of towels were great!!! Also you advertised that the location was a block away from the beaches. For disabled visitors this is not true so prepare yourself for a longer walk. Restrooms at the beach extremely cleaned. When you have a house that sleeps lwelve you should have at least four chairs and umbrella for the guess at the beach. Further explanation should be in the description when you say bunk beds hold only 100lbs as that should go further to say top bunks only. It caused great confusion in our party as we decided where each person would sleep before we arrived. So other sleeping apparatus was purchased to accommodate our party. Lack of clarity produced extra expenditures. The kitchen is well stocked with utensils overall everything I would rate 31/2 to a 4. Enjoy Fayetteville Ga.

Snowbirds from Alabama This our third stay in Emerald Mist. We stay from January 1 until the end of the first week in March. Overall we have enjoyed our stay. The house is equiped well for our stay and we have most of the things we need for our extended stay. There are only two areas that we feel needs improvement. The living room furniture is rather tired. Some updated more comfortable furniture would be nice. With back problems it is difficult to get in and out of the chairs and sofas and they are not very comfortable. The owner said that they were planning to update the living room soon. We have notice in some of the other houses where we have friends staying the furniture has been updated to more comfortable seating areas. The only other concern is the decision by the association to not heat the large pool during our stay in January and February. We need to do our pool exercises so it is difficult when you have to get in the car to go to the small pool which is too small for the number of people staying in these months. If there is more than 5 people in the pool you can forget about exercises or doing laps. We think that the association needs to rethink their decision on heating the large pool. Response from Crystal Waters Realty; Monday, March 30, 2015 Emerald Mist is mostly a short term vacation rental rented nightly and weekly. We offer a Deeply Reduced Monthly rate during the Winter. The pools are VERY expensive to heat during the Winter months and many associations choose not to heat their pools due to the cost and the fact that heaters do not work well when the weather drops down below 55 degrees. Emerald Shores has chosen to heat the smaller pool until Spring Break, at which both are heated. Emerald Mist is very well kept and nicely updated. Fall Break Getaway The home is very roomy and comfortable. Had everything we needed. Nicely stocked kitchen, plenty of indoor seating area, porches, decks - We had 4 adults and 5 teenage/college age grown "kids" with us and we never felt crowded in this space. The included chairs/umbrella service on the beach was an awesome bonus and the wagon to carry our things there was very convienent. Even with the cloudy weather pushed in by the hurricane - we were able to relax and enjoy the views and calmness of the beach and area and local restaraunts and shopping. My husband was able to get 4 scuba dives in at nearby dive shop and I enjoyed picking up fresh seafood at the local fish markets for grilling. The property managment staff was also very helpful. Calling us ahead of time to check on our arrival status, having everything ready for us when we got there after a long drive, and responding very quickly for a backed up garbage disposal and fixing immediately on a Sunday. That was our only "issue", and they took care of it promtly. the upkeep of landscaping was beautiful in the neighborhood. Very nice area to be close to pools and short walk to beach. The beach pavillion was also clean and had restrooms and a good place to eat a picnic lunch out of the sand. Would definately plan another stay there. Super Hide Away This was one of the best vacations we have had in years. Beach was within walking distance. The private cabana and section of beach was wonderful. Our favorite rental yet! We have stayed at Emerald Shores for 3 years now. We have stayed in 3 different houses, as our number of family members has changed. We loved Emerald mist. We loved every minute at Emerald Mist! We happened to stay during Tropical Storm Cindy. If we would've been stuck in a cramped little condo, it would've been miserable! Home is very close to the beach, ( within 2 blocks) which was good for me since I had a knee replacement 8 weeks earlier. There is also a very nice person who comes around regularly on a tram to pick you up and drives you closer than the beach if you need extra help. It's easy getting across the scenic highway, as traffic stops for pedestrians. ( and they are pretty good about that) 2 beach chairs and umbrella come with your rental. The home is directly across the street from the association pool. Warning, as the ice cream truck stops daily so have dollars on hand for the kiddos! This home is decorated nicely with a beach theme and has everything you need to feel at home. We had 4 adults and 5 kids staying at Emerald Mist and all were very comfortable! It would be more desirable if you had two full side bed in one of the kingside bedroom. It allows sibling who are grown or have a husband to sleep well on a firm mattress and not on a thin mattress on the pull outs. Also the supply of towels were great!!! Also you advertised that the location was a block away from the beaches. For disabled visitors this is not true so prepare yourself for a longer walk. Restrooms at the beach extremely cleaned. When you have a house that sleeps lwelve you should have at least four chairs and umbrella for the guess at the beach. Further explanation should be in the description when you say bunk beds hold only 100lbs as that should go further to say top bunks only. It caused great confusion in our party as we decided where each person would sleep before we arrived. So other sleeping apparatus was purchased to accommodate our party. Lack of clarity produced extra expenditures. The kitchen is well stocked with utensils overall everything I would rate 31/2 to a 4. Enjoy

First off emerald mist exceeded all our expectations. Furnished very nicely with plenty of seating for the whole family. Also very spacious upstairs and down just in case you have a rain day. We were a party of 9 and everyone had plenty of room to do their own thing. Kitchen was set up with everything you would need to fix a simple lunch or a full coarse meal. Exterior was well maintained with beautiful landscaping. Short walk to the beach was made even better by the furnished wagon to carry all our beach supplies. (Our stay wasn't peak time so the transit wasn't running) Security was very friendly and helpful at the beach. Communication was very good though the process. We will definitely stay again.

We really liked the location of this vacation rental. The entrance to the large pool is just a few steps from the front door, and access to the white sandy beaches only a short walk down the sidewalk. The house was immaculate, had plenty of room for our large family. Couldn't have found a nicer retreat!

This our third stay in Emerald Mist. We stay from January 1 until the end of the first week in March. Overall we have enjoyed our stay. The house is equiped well for our stay and we have most of the things we need for our extended stay. There are only two areas that we feel needs improvement. The living room furniture is rather tired. Some updated more comfortable furniture would be nice. With back problems it is difficult to get in and out of the chairs and sofas and they are not very comfortable. The owner said that they were planning to update the living room soon. We have notice in some of the other houses where we have friends staying the furniture has been updated to more comfortable seating areas. The only other concern is the decision by the association to not heat the large pool during our stay in January and February. We need to do our pool exercises so it is difficult when you have to get in the car to go to the small pool which is too small for the number of people staying in these months. If the
