xSHORT TERM RENTAL AGREEM ENT
This Short Term Rental Agreement (the "Agreement") is made and entered into this by and
between THE PROPERTY MANAGER (Rental Agent) and ("Guest") as
of the date last set forth on the signature page of this Agreement. The agreement is to rent
the bedroom, bathroom property in addition to all of
the other requested amenities and services. For good and valuable consideration, the
sufficiency of which is acknowledged, the parties hereby agree as follows:

Please sign and return the attached rental agreement immediately to secure your
reservation. Once the final payment is received, instructions for entry to the property will be
provided.
1. M axim um Occupancy: The maximum number of guests is limited
to persons.
2. Term of the Lease: The lease begins
at on (the "Check-in Date") and ends
at on (the "Checkout Date").
3. M inim um Stay: This property requires a 3-7 night minimum stay.
4. Rental Rules: Guest and all members of the rental party agree to abide by the Rental
Terms and Conditions attached as Exhibit A at all times.
5. Access: All Guests shall allow homeowner, property manager and maintenance
personnel access to the property at anytime for purposes of repair and inspection.
Homeowner, property manager and maintenance personnel shall exercise this right of
access in a reasonable manner.
6. Rental Rate and Fees:
a. Reservation Deposit:

The Rental Period may be extended by additional days, and will be negotiated at the time of
request. Any changes to the Rental Period (additional days, modified check-in / check-out)
must be made in writing or email communication. Guests not vacating property by checkout
time will be assessed a fee equal to the rental rate for one (1) night and/or an hourly rate not
less than $85.00 per hour.
b. Security Deposit / Damage Waiver : A refundable Security Deposit or Damage Waiver will
be required in advance of occupancy, which will protect the owner against damage or theft to
the property. If issued any and all keys, passes or other access devices are to be returned
to the original place upon departure. If any of these items are not returned upon departure a
$100.00 replacement fee per item will be assessed and deducted from the security deposit
or credit card on file. The security deposit / Damage Waiver may be applied by
Management to satisfy damage repairs caused by Renter or to replace stolen items and
such act shall not prevent Management from claiming damages in excess of the deposit.
Management will provide an itemized list of any damages within 45 days following
termination of the Lease. The Guest who signs for the property is financially responsible for
damages to the Rental Property at

another guest in their group or invitee. The Refundable Security Deposit will be sent within 14
days after the Renter vacates the property so long as no damage was found, no theft
occurred, no excessive cleaning was needed, there were no other costs incurred to
homeowner due to Guest's stay, and any keys, passes and access devices, if given,
have been returned.
If the prem ises, appears dirty or dam aged upon Check-in, Guest shall inform
the Property Manager immediately.
c. Rental Rate: Payment in full of all previously stated applicable fees shall be due within 60
days of the Check-in Date. Failure to pay the Final Payment within 60 days of a Check-in will
be considered a cancelation under this subparagraph and will result in forfeiture of the
Reservation.
7. Credit Card Guarantee and Authorization: This Credit Card Guarantee and
Authorization is required even if you pay by cash or check. Cardholder warrants that the
card information and signature below are the same as on the card and are true and correct.
Cardholder authorizes the Rental Agent to charge the card for payment of rental fees and /or
any repairs, expenses, or incidental services that are not settled with the cash security
deposit / damage waivers.
8. (Initial here) Cancellation Policy: If Guest wishes to cancel his/her reservation, the
deposit will be refunded as follows:
a. A 90-day written advance notice of cancelation is required for full refund of initial deposit
less (1) night rate plus applicable fees.
December/ January Time Period are non-refundable after July 1. The
reservation may be subject to cancellation (and the Cancellation Fee shall apply)
if any required payments from renter noted above are not made by rental
payment date noted above. There will be no refunds for unused nights, late
arrival or early departure. Late departure and extra nights may be available for
an extra charge.
We offer travel insurance to protect you in the event that unforeseen
circumstances arise and we highly suggest taking advantage of the program to
protect your investment.
b. Cancelations less than 90 days from reservation check in date result in forfeiture of any
Rental Amounts paid (Cash Security Deposit and cleaning fees are refunded to renter)
Management shall not be liable for non-performance of this Agreement when such
performance is attributable to labor troubles, dispute or strike, accidents, municipal, state,
and federal regulations of, or restriction upon travel or transportation, riots, national
emergencies, acts of God and Nature, and other causes whether enumerated or interfering
with Management's performance.
9. (Initial here) Insurance: We provide optional Rental Guardian trip insurance and highly
recommend all renters to purchase this insurance to help safeguard their travels.
10. Paym ent: Acceptable payment methods are cash, credit card (4% fee applies),
m oney wire or bank check.

EXHIBIT A - RENTAL TERM S AND CONDITIONS
1. Smoking is NOT allowed in inside or outside the premises
2. People other than those in the Guest party set forth above may not stay overnight in the
property. Any other person in the property is the sole responsibility of Guest.
3. This property is privately owned; the owners are not responsible for any accidents,
injuries or illness that occurs while on the premises or its facilities. The Homeowners are not
responsible for the loss of personal belongings or valuables of the guest. By accepting this
reservation, it is agreed that all guests are expressly assuming the risk of any harm arising
from their use of the premises or others whom they invite to use the premise.
4. Please be energy conscious by turning off lights, fans, air conditioning, televisions, radios,
and other electrical appliances when leaving the premises.
5. Only use appliances for their intended uses.
6. Pets are NOT allowed.
7. No dangerous, flammable or explosive materials considered hazardous including candles
are allowed on the premises.
8. Parking: Assigned parking available
9. Housekeeping: Extra housekeeping can be arranged upon guests request for an
additional fee.
10. Rules for Pools and Spas: If the Premises have access to or use of a pool or spa,
the following rules shall apply. (i) There is no lifeguard on duty. Occupants and guests may
use the pool at their own risk. By their use of any spa or pool, occupants are agreeing to
assume all risks associated therewith. Persons who cannot swim or who cannot stand
unassisted in the deepest portions of the pool must be supervised at all times by a person
who can swim. All children must be supervised at all times. Do not allow a young child in the
pool or spa without an adult. Diving and jumping in the pool is not permitted. (ii) Persons
having an open wound or communicable disease are not allowed in the pool or spa. (iii)
Pregnant women and young children should not use the spa without the consent of their
physician. Those with weak hearts or those that suffer from high blood pressure should not
use the spa. No jumping or diving into the spa is permitted. (iv) Surfboards, boogie boards,
diving equipment or similar items are not permitted in or around the pool and spa area. (v)
No skateboards or bicycles are permitted in the pool or spa area. (vi) No glass containers of
any kind are permitted in the pool and spa area. (vii) Intoxicated persons are not permitted to
use the pool or spa. (viii) Children must be supervised at all times. During social gatherings
a person who can swim should be appointed to watch any children in the pool or spa to
protect young children from pool or spa accidents.
11. Neighborhood Construction: We are not responsible for any construction noise or
inconvenience that may occur during your stay. No refunds will be given on this account.
m on Areas: The Property Manager cannot warranty amenities provided by or
through any homeowner associations, including, without limitation, pools, hot tubs, club
houses, tennis courts, golf facilities, and picnic and bike paths.
13. Environm ental Disclosure: Guest acknowledges and agrees that during periods of
rain, the foyer, lanai(s) and entry areas of the Rental Property can be slippery when wet.
Guest further acknowledges and agrees that the tropical climate in the state of Hawaii may
increase the activity of certain types of insects, field mice or geckos and no refunds shall be
given for the presence of any insects, mice or geckos. Owner maintains the Rental Property
with regular pest control service, and requires the guest to maintain the standard of clean
interior during Guest's stay as delivered to Guest when guest commenced occupancy.
Please do not leave any food out interior or exterior of the property. The presence of
insects, mice or geckos shall be addressed expeditiously by owner or owner's agent.
14. Storm : If there is a storm or hurricane, no refunds will be given unless: The state or
local authorities order mandatory evacuations in a "Tropical Storm/Hurricane Warning area"
and/or "mandatory evacuation order has been given for the Tropical Storm/Hurricane
Warning" area of residence of a vacationing guest. The day that the authorities order a
mandatory evacuation order in a "Tropical Storm/Hurricane Warning," area, we will refund:
Any unused portion of rent from a guest currently registered. Any unused portion of rent
from a guest that is scheduled to arrive, and wants to shorten the stay, to come in after the
Hurricane Warning is lifted. Any advance rents collected or deposited for a reservation that
is scheduled to arrive during the "Hurricane Warning" period.
15. Lockout Policy: In the event a Guest is locked out of the property, Management must
be notified to make arrangements for re-entry. Guest will be responsible for costs incurred.
16. Phone Calls: The Rental Property may be equipped with telephones and allows
access to local phone numbers. Cell phone usage is highly recommended, as any long
distance charges will be incurred and deducted from Guest Security Deposit if applicable.
17. Sublet: Property cannot be leased or reassigned at any time.
18. Fire and Casualty: If the residence becomes uninhabitable by reason of fire,
explosion, or by other casualty, Management may, at its option, terminate the Rental
Agreement or repair damages.
19. Repair/Right of Access: Management shall have the right of access to the Rental
Property for repair and maintenance during reasonable hours. Management, upon being
notified by Guest of any appliance malfunction, will make every reasonable effort to have
such appliances repaired. Should a repair person make a call to the Property and find that
the equipment is in working order and the problem was due to the Guest’s Oversight or
neglect, the charge of service will be the Guest’s responsibility. Replacement or repair of
any television, VCR, DVD player, radio, or any other advertised equipment or amenity, when
provided by Management, is not guaranteed. In the interest of good business practice,
Management reserves the right to offer credit or if available, alternative accommodations for
any inconvenience encountered due to any major appliance malfunction, as part of the
Guest's vacation experience.
In the event of an emergency, Management may enter the Property at any time to protect life
and prevent damage to the property.
20. Use: Management provides linens, bath and beach towels. Rental shall be used so as
to comply with the state, county, and municipal laws and ordinances and Association
guidelines and/or restrictions. Renter shall not use Rental or permit it to be used for and
disorderly or unlawful purpose or in any manner so as to interfere with other resident's quiet
enjoyment of their residence. Any misuse described above shall result in termination of
Rental Agreement and no refund will be issued.
21. Property Loss: Management shall not be liable for damage to Renter's property of any
type, for any reason or cause whatsoever.
22. Indem nification: Renter releases Management from liability for and agrees to
Indemnify Management against losses, incurred by Management as a result of (a) Renter's
failure to fulfill any condition of this Agreement; (b) any theft, damage or Injury happening in
or about the Rental or Premises, to Renter's invitees or such person's property; and
judgment, lien, or other encumbrance filed against the Renter as a result of the Renter's
actions.
23. Disputes: This Agreement shall be governed by and interpreted in accordance with the
laws of the State of Hawaii. Any action relating to this Agreement shall be instituted and
prosecuted in the courts of the County of Hawaii, in the State of Hawaii. Guest shall pay
reasonable attorney's fees and all costs in the event that the Guest fails to comply with its
obligations under this Agreement and Management refers the matter to an attorney. If any
action at law or in equity shall be brought under this Agreement, or for, on account, any
breach of, or to enforce or interpret any of the covenants, terms or conditions of this Lease,
or for the recovery of possession of the Rental Property, the prevailing party shall be entitled
to recover from the other party, reasonable attorneys fees and costs, the amount of which
shall be fixed by the court and shall be made a part of any judgment or decree rendered.
24. Insurance: The owner, the Property Manager, and {reservations.unit_name}, are not
responsible for insuring Guest or Guest's permitted visitors' personal property and vehicles
against loss or damage due to theft, vandalism, fire, water, rain, criminal or negligent acts of
others, or any other cause. The Property Manager has advised the Guest to carry Guest's own
insurance (renter's / damage waiver insurance) to protect Guest from any such loss or
damage.
25. Return of Lost Item s: A $50 fee, plus shipping costs, applies to any Lost and Found
items that Owner's Agent returns to guest. Items found and not claimed within thirty (30)
days of Guest's check-out will be disposed of at the discretion of Owner's Agent.
26. Subject to Change: Guest acknowledges that when, due to circumstances beyond
Rental Agent control, the reserved property becomes sold, change of ownership, unavailable
or uninhabitable, substitute accommodations will be offered. If at the time the Guest is to
begin occupancy of the Property, the owner or Rental Agent cannot provide the property in a
fit and habitable condition or substitute a reasonable comparable property, the limit of liability
of the Owner and Rental Agent is to refund any payments received from Guest.
27. M odification: The Property Managerand the Guest hereby agree that this document
contains the entire agreement between the parties and this Agreement shall not be modified,
changed, altered or amended in any way except through a written amendment signed by all
of the parties hereto.
Failure of M anagem ent to Act: Failure of Management to insist upon compliance with
the terms of this Agreement shall not constitute a waiver of any violation.
Entire Agreem ent: This Agreement and any attached addendum constitute the entire
Agreement between the parties. No oral statements shall be binding. It is the intention of the
parties herein that if any of this Rental Agreement is invalid, for any reason, such invalidity
shall not void the remainder of the Rental Agreement.

Great House. Great Location. Good place and very customer oriented rental agency. Any questions or needs were immediately addressed. Coffee maker broke and was replaced the same day. Only complaint is the junior master suite had AC issues and was very difficult to cool.
