GUEST AGREEMENT

PLEASE READ CAREFULLY
This contract constitutes an agreement between the Guest and the property Owner, represented by the Property Manager.
For Guests staying in the following properties, there is a mandatory resort fee in addition to the rental rate:

WAIPOULI BEACH RESORT (Beginning January 1, 2014) - $12/day (included with rental fees)
HANALEI BAY RESORT - $15/day (to be paid at check in at front desk)

DEPOSIT, PAYMENT AND CANCELLATION POLICY: Upon confirming your reservation, 25% of the total amount is required upfront upon booking the reservation. The final payment, including taxes, is due no later than 60 days prior to Guest’s arrival date. Expenses (including, but not limited to: extra clean fees, room charges, telephone charge, cable television charges, utility etc. ) incurred during your stay will be charged against Guest’s credit card.

Reservations not paid in full sixty (60) days prior or by the listed due date shall be subject to cancellation and forfeiture of all monies. Each property is individually owned. Rental fees are not transferable from property to property. If Guest’s check is returned by the bank, Agent reserves the right to require payment to be made by certified check or money order including a service charge of $50.00.

If cancellation is made at least 90 days prior to scheduled arrival, all monies will be refunded less the processing fee of $90.00 and up to $165.00 for larger homes. If cancelled less than 90 days prior to arrival, the 25% booking payment upon confirming will be forfeited. Cancellations made less than 60 days prior to arrival will result in forfeiture of the rent and taxes, with the exception of the cleaning fee and Security Deposit (if applicable). Guests are responsible for the entire time booked. No rental refunds are given for early departure or late cancellation. All cancellations must be made in writing (email and Fax acceptable). We do not make exceptions. In order to protect your vacation payments we strongly suggest travel insurance.

TRAVEL INSURANCE: You are a valued guest and we want to do everything possible to make your trip enjoyable and worry free. Because the unforeseen and unexpected can occur before you leave or when you’re away from home we recommend CSA’s Vacation Rental Insurance Plan. The premium for Vacation Rental Insurance can be included in the cost of your rental. Vacation Rental Insurance reimburses for pre-paid non-refundable expenses due to certain unforeseeable circumstances that may cause you to cancel, interrupt or delay your trip. Please review our cancellation policy in this Agreement.

TRUST ACCOUNT: The Deposit, the Final Payment, Security Deposit (if applicable), and any other fees will be deposited into Agent’s trust account at First Hawaiian Bank, Princeville, HI 96722.
CONDITION OF PREMISES: The property and its contents are privately owned, withthe Property Manager acting solely as the Owner’s Agent. It is rented with Owner’s furnishings and neither Owner nor Agent will be responsible for providing any additional furnishings or equipment. No items belonging to Owner shall be removed from the property. Any household appliance and equipment malfunctions reported will be handled as quickly and professionally as possible during normal business hours. In the event of an after- hours emergency, please call Cyrila Pycha at. Guest agrees to keep it in good, clean condition.

Additionally, the Property Manager shall not be responsible for any loss, expense, damages, claims or injury direct, indirect, consequential or otherwise caused by reason of military actions, acts of God, or by any agents, employees, subcontractors, servants or services as provided.. Should the contracted property become unavailable, the Property Manager will act in good faith and use its best efforts to substitute with accommodations or services of a type comparable to those contracted. The Property Manager in their sole discretion reserves the right to refuse or discontinue service to any person(s) and/or to rescind any contract for accommodations or guest services. The Property Manager will not be liable under any circumstances, including substitutions, to refund any unused portion of booked accommodations or services. The Property Manager is not responsible for valuables left in rental properties.

Guest authorizes Agent to repair damages or losses caused by Guest or invitees of Guest, at the expense of Guest. Guest accepts responsibility for the acts of their children, visitors or guests and service animals. Guest will not remove or rearrange inside or outside furniture. Guest renting homes/condos with air conditioning for thirty (30) days or more will be responsible for excessive utility billing.

PESTS: Hawaii is a tropical climate in which insects, rodents and lizards unfortunately thrive. All properties are on a quarterly maintenance program, but Guest may encounter these pests during stay. Contact with a “pest” inside or outside of Guest's rental is not reason for termination of this agreement. If this does occur, please contact the Property Manager to make a report as a trouble call will be scheduled.

GAS GRILLS: Gas grills are not allowed at Condominium projects. Charcoal BBQ's and Hibachis are prohibited in all properties unless already provided. Any reported illegal use of a gas or fire barbecue from the association will result in a fine, which will be charged against your credit card account.

MANDATORY OCCUPANCY DISCLOSURES: It is mandatory to disclose the exact number and names of guests who will be occupying the premises during the rental term. Guest must immediately notify Agent, by phone and/or in writing, if the number of occupants changes. Additional charges may apply. The premises shall be used for residential vacation rental purposes only. Special events such as parties, receptions, etc., shall not be allowed without the express written consent of Agent. Shall guest refuse to adhere by this policy, additional charges may apply. In no event shall the premises be sublet or this agreement reassigned without the written consent of Agent.

CHECK IN / CHECK OUT: We want you to enjoy your stay and when possible will accommodate early check in or late check out. However, we are not always able to do so. Guest agrees to abide by stated check in / check out times unless express permission is given by rental agent.

SUBJECT TO CHANGE: Advertised amenities are subject to change without notice or compensation. Changes can occur after a reservation is made as a result of sale of unit, remodeling, mechanical failure or servicing. Should a property be made unavailable for any reason beyond the control of Agent, Agent may substitute another like or better property. If no other property is available the limit of liability by property Owner, the Property Manager or its Owners, is to refund any pre-paid rents that have been paid by the registered Guest.
SECURITY FEE: A non-refundable security fee is included in Guest's rent in lieu of requiring a Security Deposit. This is intended to limit out of pocket expenses from accidental damages to the leased premises or contents during the guest stay. A description of the Security Fee can be found at for review and is incorporated herein by reference. PLEASE READ IT CAREFULLY. In order to honor a claim under the security fee guidelines, Agent must be made aware of any damage prior to check-out.
SECURITY DEPOSIT: In the case of Special Events (e.g. Weddings, Graduations, etc.) a Security Deposit is required. Guest agrees to be responsible for any damage to the Premises or its contents. The Security Deposit shall be applied to actual damages caused by Guest. After Guest's occupancy, the Premises will be inspected to determine if such damage or theft including additional cleaning, has occurred. In such event, Agent shall deduct the cost of such damage or theft including additional cleaning from the Security Deposit and Guest will be notified in writing. In addition, Agent may deduct from the Security Deposit the amount of any long distance or per call telephone charges and cable television charges such as but not limited to pay per view movies that may have occurred during the dates of Guest's rental period. Agent shall apply, account for, or refund Guest's security deposit within forty-five (45) days following the end of the tenancy.
HOUSEKEEPING:

The property has been cleaned and prepared prior to Guest’s arrival. Fresh linens and towels are placed in the property along with a starter supply of soaps and paper products. Additional supplies that may be needed are the responsibility of the Guest. Each property is equipped with a washer and dryer. Excessive use of the linens and towels resulting in extra loads of laundry upon check-out is subject to additional charges. The Cleaning Fee stated on the Agreement is subject to change.

Daily Maid Service is not included.

In addition to your one-time out clean fee, mid-stay cleaning(s) and/or deep cleaning(s) may be required for extended rental periods of thirty (30) days or more at guest’s expense. Please notify our office at least one week in advance of your arrival if you wish to make these arrangements.

Please note that animals are not allowed, however, in the event a guest requires a service animal and has proper documentation for said animal; there will be an additional cleaning charge applied to the final balance.

PHONES: The private phones in each unit are for Guest's convenience. Local calls (Kauai) are free. Please charge all long distance calls to a credit card or third party.

OWNER’S CLOSET: Locked closets reserved for Owner are not to be accessed by Guest.

RULES, REGULATIONS AND LAWS: All properties are SMOKE FREE. Any smoking is to be done 20 feet from any entrance of the property per Hawaii State Law. Detection of any smoking within the property is subject to a $450 fine to guest. Our rental properties are located in residential areas and guests are asked to be considerate of neighbors' privacy and right to quiet enjoyment of their homes by keeping any noise at acceptable levels. Guest will take all reasonable steps to assure that property occupants adhere to the Rules, Regulations and Laws that affect the property, Homeowner’s Association, the Property Manager and the State of Hawaii.

Customer understands that the owner of this rental retains the right to sell their rental or change management companies at any time. In the event the vacation accommodation is sold by the owner or transferred into a new management regime, the Property Manager, acting as an intermediary between you and the Owner, will use its best efforts to provide a substitute vacation accommodation of equal or greater value. If the Property Manager is unable to find such accommodations, then at the Property Manager or customer's option this Agreement shall be cancelled and terminated and the Property Manager, acting as an intermediary between you and the Owner shall refund to customer all payments made by customer under this Agreement, and the Property Manager and customer shall thereafter not have any liabilities or obligations to the other arising out of the unavailability of the rental property and/or customer's travel arrangements.

Customer acknowledges that the rental owner and/or their agent retain the right to enter the rental for any legitimate reason, including showing a prospective buyer the rental, by giving customer at least Twenty-Four (24) hours notice of such showing.

NON-LIABILITY AND INDEMNIFICATION OF OWNER AND AGENT: Guest agrees to hold harmless and indemnify the Owner and Agent from any and all costs, expenses, legal proceedings, legal fees, suits, claims, or demands, whether from loss of life or injury to Guest and/or invitees of Guest, unless same was due solely to the willful act or gross negligence of the Owner or Agent.

The above rental information, while deemed reliable, is not guaranteed. Changes in inventory and or decor occur from time to time and such changes will not void or alter the terms of the rental and is not a valid reason for cancellation.
AGREEMENTS: Signing this Agreement and the Rental Agreement constitutes a contract, namely:
1) Acceptance of all terms, conditions, policies and procedures detailed therein.
2) Acceptance of full financial responsibility for late departures, any loss of inventory, excessive housekeeping and damage or repairs due to abuse or neglect for the property occurring within the duration of your stay.
3) All disputes arising out of this Agreement shall be subject to the exclusive jurisdiction and venue of the Hawaii State courts of Kauai County, Hawaii, (or, if there is exclusive federal jurisdiction, the United States District Court for Hawaii) and the parties consent to the personal and exclusive jurisdiction and venue of these courts.
4) Customer agrees and acknowledges that this rental arrangement is not subject to the residential landlord/tenant code of the state in which this rental is occurring (such as the Hawaii Revised Statutes chapter 521) since this is not a long term residential rental.
5) Acceptance of rental charges as stated on page one of this rental agreement.

Any alterations made to this Agreement by Guest without the approval of Agent, renders this Agreement null and void.

Nice place, don't expect to use the beach out front. The place appeared nice upon check in. Great view and nice looking place. A few things that we wish could have been better. The air conditioner is super loud and turns on and off every 4-5 minutes. Makes it difficult to sleep. If the bedrooms had ceiling fans, we could have turned the AC off. Lanai chairs are old and actually falling apart and give you splinters. Also the travertine on the Lanai is disintegrating and is sharp and super hard on your feet. TV's in the unit were old, no smart TV's. When traveling with kids it would have been nice to login to netflix in the evenings. We also arrived to some dirty dishes in the dishwasher. All in all it was still a nice stay, it just could have been better.

Good location. Comfortable and clean. Stress-free and well-organized check in and check out. Beach great for sunrises. Pool was fantastic. Was perfect for my group- myself, my wife and my in-laws. Plenty of room for 4 adults. More than that might be a little tight.

Clean, comfortable, great view The condo was clean and comfortable, very spacious. Kitchen was clean and well-stocked. View from the living room and bedrooms is amazing! 2nd bedroom closet was stocked with beach chairs, boogie boards, and misc. sand toys.

Beautiful place! It was a great location close by downtown Kapaa. We rented bikes that we used on the paved pathway right along the ocean. (Which leads to downtown) The place was clean with several balconies with ocean view. The keypad was nice to not have to keep track of the keys. Oasis restaurant is right on the beach and delicious. I would highly recommend this place.

Perfection! From Every Angle. This suite was beautiful, clean, classy, huge, well-stocked, bright, cool, modern, and has a view of the lovely grounds and ocean from 4 sets of sliding doors (yes..four!)The rental experience with Remax was easy; lots of communication in advance. This was the best condo I have stayed in EVER, and I've been to the islands 6 times. Convenient location across from Safeway and ABC Store, but quiet and private on the grounds. Families stayed around the pool. The location is excellent.

Great place for a family to stay! We've been to Kauai a few times in the past and have stayed at various places around the island. We loved this property based on the location and great views of the ocean and layout and highly recommend it to others planning a trip here with their family. We particularly enjoyed the amenities including the beach chairs and boogie boards as well as the easy access to Safeway and Foodland just a short distance away (without feeling like it they're in your backyard).

Nothing to say but perfect The condo exceeded all expectations and all I can say is that the pictures don't do it justice. The rooms, the kitchen, how it is equipped (towels, kitchenware, things for the beach), the bathrooms, the resort pool, the beach beneath the unit... all a perfect 10. Highly recommended!

Waipouli Beach Resort Great location, spotlessly clean, excellent appliances, spectacular view!!<br/>The resort itself was well managed, landscaping/pool/staff all excellent.<br/>Oasis Restaurant on site was awesome.<br/>Also, **** Try the newly opened "Coconuts" in the Safeway shopping centre across the street ... fantastic Fish Tacos and everything else ****<br/>I would book this unit again for sure!

Wonderful Week! The condo was very well appointed, and the kitchen well stocked with anything you would need to get through the week. With a Safeway right across the street, it was easy to cook 'at home' and still have many great dining you options readily available. The location of the resort s perfect... smack in the middle - so great whether you want to head north or south any day! The rest pool was fantastic and we thoroughly enjoyed our visit!

Home Sweet Home Chose Waipouli Beach Resort by chance and it couldn't have been a better choice. We were in Kauai visiting a relative, and whenever we came back to our unit, it was like coming home. Totally comfortable; beds were extremely comfie, and I am a bath person and the tub was heaven. Thoroughly enjoyed the slides at the pool (and we are in our late seventies!) Waipouli is a great location. Convenient to anywhere on the island.<br/>Favorite restaurant was The Local. Don't miss the Kale Pizza (and I don't like Kale!)<br/>

Best condo we've rented in Hawaii - any island! The pictures do not do this condo justice. The view from all bedrooms and the living room/kitchen is breathtaking. You can leave the lanai doors open and just listen to the waves. I had to stay in and work one of the days and it was no imposition! (The wireless strength is great)<br/><br/>The apartment is excellently appointed and it was spotless. Loved the kitchen appliances. Made cooking a pleasure. From one of the bathrooms (there are 3!!), you can open this window and watch the ocean from the tub. Nice touch!!<br/>The Waipouli resort is really nice too. The pool is pretty splendid. Has waterfalls, slides and numerous sandy bottom hot tubs. We loved it. Though you are right in the middle of busy Kapaa, from this apartment, you can't hear a thing except the ocean. And having the supermarket right there was actually handy :) We loved staying there and will definitely try to stay there again on our next visit!<br/><br/>Thank you!!

Beautiful Stay, As Advertised We had a great stay in G-306, loving the gorgeous view and resort. A few things could use updating, like pans in the kitchen and cushions on outdoor chairs, but nothing that affected our overall enjoyment of the property.

Loved it. Our family have stayed in the same property twice . We loved it both times and highly recommend it . However the sofa / lounge needs replacing as its not very comfortable & the air conditioning is noisy and inconsistent it doesn't maintain repay it'd control .

January 2016 vacation Very good resort, well situated for exploring north and south of Kauai. Pluses: beautiful lazy river-type pool, quiet, very clean, close to all amenities, beautiful ocean-front views. Nice Condo with a View Great place, near some good restaurants (Wahooo & Lemongrass: we had great dinners at both), and fairly convenient to everything. It was however a bit further from Poipu and all the stuff down there than I thought. Traffic gets slow through the Kapaa area. Very nice condo, and great pool too. Beach towels available near the pool. We spent 3 nights, then went to a condo in Princeville.

Beautiful Condo! This condo worked perfectly for our family of four. The home and related facilities (pool, grounds, etc.) were maintained beautifully. The location was perfect; equidistant from many north shore and south shore activities, thus reducing overall driving time.

the Perfect place to stay in Kauai The location is exactly as promised. It was clean, very functional, and is steps from the beach. It has everything you need hairdryer, beach towels from the pool, beach chairs, washer and dryer in the condo and cooking equipment. The pool area is amazing! It was Perfect!

G-306 A vacation where family gets together is always nice. The weather didn't cooperate for outdoor activities so we spent a lot of time inside. A couple of comments. Because six people could sleep there - the seating didn't accommodate that number of guests. There is one sofa (2/3 people) and one chair - not including dining room chairs which are uncomfortable after a while. The table on the lanai off one bedroom was falling apart and when we arrived there were pieces from the table all over the lanai. The window covers kept coming off the track and one of the small side covers wouldn't close. The bedroom with the larger lanai had electrical outlets that need repair and of the 3 lamps in the room - only one could be plugged in and it was a very dim lamp. The bathroom lights had all different types of bulbs in them - aesthetically it looked odd and inconsistent. The grounds were very nice - the pool was lovely and the children's pool area was good. There are slides at the pool which were fun but would have been nice to be able to put a little one in your lap and slide down. Lots of slide rules.... Grocery stores and restaurants were nearby and easy to access. The room did have quite a few pool toys which was also very nice. The kitchen was quite nice and I liked the smaller sized dishwasher so we always had clean dishes.

A family retreat Shopping was nearby. Lots of restaurants to pick from. Good snorkeling within a 20 minute drive. The condo had many water accesories for you to use. I used the condo's tennis courts every morning while the air was still cool. The air conditioning in the condo could be improved since it was quite warm while we were there. Beautiful place would definitely come back again.

Beautiful property in somewhat odd location This property is truly gorgeous, from the pool to the rooms to the tiki bar. And if you have rental car, you can get to all the best locations on the north and south sides of the island. The very small beach onsite is there if you need it, but mostly you will want to pack up and head elsewhere for real beach time. Only criticism I have of the rooms - and ours was a spacious two bedroom - is that the balconies are tiny, and thus not equipped with a lounge chair where you could read, have a drink, and enjoy the view.

Beautiful Condo Unit directly faces the ocean with multiple balconies off master, livingroom and second bedroom. Kitchen has all the lux amenities - stainless steel, granite counter, cooking ware. Also wash/dryer. Very useful 3rd 1/2 bath as you come in the unit to the left. Pool was great for kids and shopping plaza just across the street.

The unit was beautiful. However, if you rent a private unit from REMAX, the front desk cannot help you with anything as it is not their unit. This was a problem for us arranging a crib (which we never did get). Otherwise, no complaints.

Great Room, Great Location We really enjoyed our stay...the room was fantastic. Very clean and stocked with the best appliances. When DVD player in one bedroom didn't work, they came out next day and replaced it with a new one. Wonderful view of the beach. The resort has a good Bar and Grill restaurant and fantastic pool area. Bar and Spa closed The unit was very nice. However, it was disapointing that the bar and spa were closed and we were not notified. Otherwise, a great vacation and a perfect unit for families. Pool was great. Beach is nice but not for swimming as its a coral reef. Great place at a central location. It is important to pay the extra money to have the right location for the condominium. You don't want to view the parking lot or even the pool area. We had a beautiful view of the ocean from the 3rd floor. It was wonderful.

The Best Vacation Ever There was only one problem. When ever we left and came back we could smell a mildew smell. The air conditioner fan would never turn off even though we set it to not be on. The only way to turn it off was by opening the windows or turning off the circuit breaker. You should probably have someone one check it out.

Gorgeous condo in not so gorgeous Kapaa The condo, G306 was absolutely wonderful. Immaculate and modern with all amenities. It is right on the beach and you can watch the sun rise without getting out of bed. <br/><br/>While Kapaa offers the convenience of being a midpoint to all destinations on the island, it isn't a very attractive town. It's busy and we didn't feel entirely sure about its safety at night. <br/><br/>All in all, our stay at the Waipouli Beach Resort was excellent.

Loved the place so much, looking to buy a unit here! We stayed 15 days/14 nights on Kauai. The first 7 nights were at Waipouli Beach Resort on the East side and are second 7 nights was on the south side in a smaller, but very nice complex. As much as we enjoyed our time on the South Side, if I could turn back the hands of time I would book 14 nights at Waipouli. The room was incredible. The view was GREAT. The facility was wonderful. We also found ourselves, even when staying on the South Side, driving back to the east side for beaches and activities. We are SERIOUSLY looking into buying a place at Waipouli Beach we enjoyed it so much. Eric

Bad start We walked into a unit that had not been cleaned by the cleaning crew. Dirty towels, food left on tables, beds unmade, overall dirty, very poor first impression of Kauai on our first ever visit to the island. Agents thankfully moved us to another clean unit and things were acceptable. Poor first impression.

Love the Place, Like the Property... The condo has great views, well maintained-absolutely no issues with G306 whatsoever. Many of the issues with the property that you see on TripAdvisor are accurate. The pool is cold, the security guards spend way too much time guarding the pool and questioning guests and the barbeques did not work properly. This is an ideal place if have teen or younger kids-I wouldn't necessarily advise for couples as there is a lot going on and it may not be as quite as other places. For example, our view of the ocean was great, but the grassy area between the condo and beach was a common hang out area for adults and/or kids to play, so you had to accept that. Actually, if the security guards spent more time policing that area than the pool, I think that would have taken care of two of the problems I noticed.<br/><br/>Location is very central to the island, lots of places within walking distance, you just have to decide what type of vacation you are taking. If you want a great view; great place with great access, this is ideal. Quite and retrospective places to lounge around, not so much.

Buggah was cherry! For Kamaaina and visitors alike looking for a place to stay on Kauai, look no further than the Waipouli Beach Resort and the fine folks at Remax Kauai. I grew up on Kauai but live in Hong Kong now. We met my wife's sister and her husband visiting from Indiana so this was the perfect place to house both couples with the 2 bedroom suite. The condo has first class amenities with a far nicer kitchen than I have at home, 3 bathrooms, laundry, and a postcard sunrise view from any of the 3 balconies which are perfect for whale watching. The pool is great and very family friendly with 2 water slides, a lazy river, and 3 hot tubs. The location is good with shops and restaurants in walking distance. You cant go wrong here...

Great place, near some good restaurants (Wahooo & Lemongrass: we had great dinners at both), and fairly convenient to everything. It was however a bit further from Poipu and all the stuff down there than I thought. Traffic gets slow through the Kapaa area. Very nice condo, and great pool too. Beach towels available near the pool. We spent 3 nights, then went to a condo in Princeville.
