GUEST AGREEMENT

THIS AGREEMENT is made on the ____________day of ______________________, 20__.

BETWEEN:

The Property Manager

(Hereinafter referred to as the “Company”)

AND:

Name(s) ___________________________________________________________

(Hereinafter referred to as the “Guest”)

The Company has been hired to act as the Owner’s agent to arrange for guests to stay at the property. As a Guest interested in the Property for your vacation, you are now entering into an Agreement on the terms and conditions set out below.

THIS AGREEMENT WITNESSES that, in consideration of the premises, agreements and covenants below, the Company and the Guest agree as follows:

The Company as an Agent

The Company has arranged for the use of this Property by the Guest. The Guest agrees that the Guest is paying the company for the use of the property, and that the Company incurs no liability whatsoever.

Cancellation & Booking Deposit

General Cancellation Policy:
High Season: Deposit of 25% due at time of reservation. Balance is due 30 days prior to arrival date. Reservations must be cancelled at least 60 days prior to date of arrival for full refund. If cancelled 59-30 days prior to arrival deposit is non-refundable, within 30 days or less the entire reservation is non-refundable. Low Season: Deposit of 25% due at time of reservation. Balance is due 14 days prior to arrival date. Reservations must be cancelled at least 14 days prior to date of arrival for full refund. If cancelled within 14 days or less the entire reservation is non-refundable. No Discover cards accepted. $50.00


If, for any reason, the Company cancels a confirmed reservation or the Property is rendered uninhabitable, other than as a result of a default by the Guest or an invitee of the Guest, the Company will refund the 50% guest deposit. The Company will make reasonable efforts to find another suitable property for use by the Guest. Neither the Owner nor the Company will be liable in any way to the Guest in the event of a cancellation of a confirmed booking, other than expressly set forth in this paragraph and the Guest damages or claims shall be limited to the return of the funds paid.

Guest Conduct

The Guest will act in a proper and reasonable manner while staying at the Property and will ensure the Property and all contents and chattels used by the Guest are used in a manner to avoid any damage, reasonable wear and tear permitted, and will make all reasonable efforts to preserve and protect the Property and will not create a nuisance to
occupants of any neighboring Property.

The Guest will ensure that members of the Guest’s party and the Guest’s invitees act in accordance with the terms of the Guest Agreement and otherwise comply with the obligations of the Guests. The Guest is responsible for the acts of members of the Guest’s party and of the Guest’s invitees.


The Guest will vacate the Property at the 10:00 (am) checkout time and note that there is a 3:00 (pm) or later check-in time. The Guests will leave the Property in a clean tidy and orderly condition with furniture in the same location as at the commencement of the stay. Unless a late checkout is arranged on or before arrival a $50/hour fee will be charged
for each hour (or portion thereof) past the required checkout time and before the required check in time.

Only those adults who have been listed in the Guest Agreement and the minor children named may stay overnight at the Property. The rates are based on double occupancy. Charges for additional persons apply. Unless previously agreed, if an additional person over the agreed number of occupants stays overnight at the Property, an additional
charge of $50 per guest per night will be levied. The guest may not camp, tent or place auxiliary facilities on the Property without prior written authorization from the Company. The Guest may not sublet all or a portion of the Property nor assign this Guest Agreement.

The Owner or Company may ask a Guest, or the Guest Party to leave if, in the Owner’s or Company’s reasonable opinion, the behavior of the Guest or any member of the Guest’s Party is unreasonable, or if the Guest breaches this Guest Agreement, whereupon the use will terminate and the Guest will not be entitled to any refund.

Use or storage of contraband or illegal substances on the property will result in immediate eviction and notification of the appropriate authorities.

Damage Deposit

The damage deposit is separate from the booking deposit of 25%. All reservations are subject to a $500-damage deposit regardless of length of stay. The damage deposit may be retained and applied against any and all damage and loss to the Property (other than normal wear and tear), excessive cleaning costs and any other amount owing by the
Guest under this Guest Agreement. The retention of the damage deposit herein is without prejudice to the Owner’s right to claim from the Guest any amount in excess of the damage deposit. The Guest does hereby authorize the Owner or the Company to charge any excess damage or costs referred herein to any Guest’s credit card, the particulars of such card having been provided to the Owner or the Company. The Company will return the damage deposit, minus any deductions to the Guest. There is a $50 charge per key for keys not returned to the Company upon departure.

Cleaning Fees

Cleaning deposits are separate from damage deposits and are completely non-refundable. Cleaning fees differ between properties. The Guest is responsible for leaving the accommodation tidy and clean, with furnishings left in the same position as it was when the Guest arrived.

Property Used at Guest’s Risk

The Property is used entirely at the risk of the Guest and members of the Guest’s party. The Guest is responsible for any damage, loss or injury caused to the Property or to any other property or person by the Guest or members of the Guest’s party, or the Guest’s invitee. Neither the Company nor the Owner is responsible for any injury, accident,
death, property loss or damage, loss of physical or mental enjoyment, expense, cost or inconvenience directly or indirectly caused to the Guest or any member of the Guest’s party, by or arising out of the use or occupation, or the condition of the Property or its approaches. The fact that children may be permitted on the Property does not imply that
the Property is without risk to children.

Indemnity

The Guest will indemnify and save harmless the Owner, the Owner’s agents and the Company from any and all damage, loss, expense, claim, action or liability of any kind whatsoever, or howsoever caused including, without limitation, a claim of any kind by any member of the Guest’s party (including those of minor children), which arises
from or relates in any way to the use or occupation of the Property by the Guest, members of the Guest’s party or by invitees of the Guest. The Guest is responsible for any damage of any kind to the Property caused or contributed to by the Guest, members of the Guest’s party or by invitees of the Guest.


Limitations of Claim

If the Guest or any member of the Guest’s party or invitee of the Guest’s party or invitee of the Guest, has a claim of any kind against the Company or the Owner, with respect to, or arising from this Guest Agreement or the use of the Property, the maximum liability in all circumstances of the Company and the Owner with respect thereto will be the
amount of money the Guest has paid under this Agreement.

Interpretation

The laws of the State of Idaho, USA shall govern this Guest Agreement; the singular will include the plural. If there is more than one Guest, the covenants, agreements and acknowledgments of each person comprise the Guest.

The Agreement and other writing delivered pursuant hereto may be executed in any number of counterparts with same effect as if all parties to this Agreement or such other writing had signed the same document and all counterparts will be construed together and constitute on and the same instrument. Facsimile copies and facsimile signatures will be
valid and binding.

This Agreement will ensure to the benefit of and be binding upon the respective legal representatives, successors and permitted assigns of the parties.

The Guest agrees to use the Property for the period of time for the amounts and other payments set out herein and in the Rental Application on other terms and conditions contained in this Guest Agreement. The adult members of the Guest party who execute this Agreement agree to observe, perform and abide by the obligations of the Guest under this Guest Agreement. The undersigned agree that they and all their guests will use the Property at their own risk.

Facsimile Agreement

The guest agrees that this agreement may be executed by this and other facsimile transmissions and this/or other original facsimile signatures will seal the binding obligation of the parties to be bound by the terms of this agreement.




Limitations of Liability:

represent, warrant, acknowledge, and agree with Ranch Park Rentals and the Company that I/we will use the cabin, it's property, it's facilities and equipment in accordance with the terms and conditions, the household rules/inventory lists, and the cabin rental application and that I/we do so at my/our own risk and that I/we indemnify and save, the Company and the Property Manager harmless from any personal injury, sickness or death, loss or damages, however caused, to person or property of the guest, his/her respective family, and/or guests, during or after the time of occupancy. Additionally, I/we accept full responsibility of the use of the cabin and the surrounding property and any and all equipment, furnishings and agree to pay for any repair or replacement of the fore mentioned cabin equipment beyond normal wear and tear.

Spacious Lakeside Getaway Great overall experience but the condo could use a few minor updates for guest comfort! Master bedroom is very bright and needs additional curtains for morning sun. If you are picky about your sheets, you may want to bring your own. Sheets were old/scratchy. Great view, plenty of room for family, and decent cooking accommodations (pots, pans, coffee maker). If you drink wine, bring your own glasses as they had about 3 total. Bring extra paper towels and garbage bags. Shared bbq in parking lot was helpful. I would rent again, but I would pack a few extras to make the stay more comfortable.

The pictures don't do it justice The condo was bigger than we expected and closer to the water than the pictures indicated. We were right on the lake with a cute little beach and dock. It was only 2 blocks to town, too. This is a terrific spot for whatever you want to do - swimming, boating, paddleboarding, or just sitting on the balcony and looking at the lake.

Summer Renter This unit needs air conditioning during the hotter months in July and August. We were just not able to reduce the temperature enough to sleep comfortably.<br/>Also, sending a receipt showing a receipt of deposit without actually taking the deposit is confusing. Please send receipt that indicate the deposit is pending or you are liable for the balance. Hotels do this so should you.<br/>Condo has great access and a lovely view of the lake.

Well taken care of unit and nicely furnished for a large group!! We have rented at Mill Park for many years and have stayed in this unit perhaps only a couple of other times. This unit is very well furnished for a large group of people and we had a great time. We did wish the TV had a larger screen since we all wanted to watch the Seahawks game on Sunday. It was hard to see the score and the time. (Normally we aren't in McCall to watch TV though.) We appreciated the fact that they have put ceiling fans in the bedrooms and living room and wish the other unit we often stay in would do the same as well as make the whole unit more comfortable and better equipped like this one....especially since they expect to rent for the same price. Mountain Paradise Mill Park Unit #5 is perfect for a large family fathering -- lots of seating and eating space -- tastefully decorated and a great place for kids. It was very clean and organized -- with lots of sleeping accommodations. We enjoyed our stay immensely, but would love to have a large flat screen TV so that we can play back family videos taken during our stay. The WiFi is super!

Happy in McCall We only had one problem while in McCall and that was with the screen door to the balcony. Other than that not working, everything else was perfect. The location was ideal and we were there on the fourth so it was perfect for the fireworks.

Happiness in the Kingdom of McCall This was another wonderful year for our family at McCall and Unit5 was the perfect gathering place for our children and grandchildren. The ample seating in the front room was a big help.Everything was super except the lack of DVD players and flat screen TV in the front room -- not that we go there to watch TV, but it's fun in the evenings to watch movies and/or family movies and pictures on a bigger screen -- especially since we're all used to that at home.

Mill Park Condo #5 We loved staying at this condo. The place is huge, the view is gorgeous, the beds are comfy, the rooms and bathrooms were big. The kids had fun hooking their video game to the TV and playing together. The lake and beach being just out the door is so convenient.<br/> Walking to town or to our jet ski and boat rental pickup was easy. Overall, we love McCall and love the condos.<br/>

Right on the lake - balcony overlooking lake! LOVED this unit! Great for entertaining - two kitchen tables and large living/great room. Good sized deck with table and chairs, and beautiful view overlooking lake. Website pictures don't do the unit justice - much roomier and updated than appears on website. Very well stocked and real simple check-in/out.

Richardsons Love Unit #5 Beware: tv in master bedroom is a FIRE HAZARD and I unplugged it. In middle of night it was making weird noises like it was about to burst into flames. Please have owners replace it.

When we arrived, the water was not turned on. It took several attempts to contact management to remedy the situation. Also, while overall the condo was cleaner than last year, there were still stains on the dining room carpet, dust and rings on the glasstops of the end table, and some of the kitchen appliances (i.e. crock pot) had dried-on food from previous guests.

SAVE YOUR MONEY! For $310 a night you expect clean/nice. Stayed here 2 years ago-was pristine then. So very disappointed this time after bringing family to stay and bragging how great it was 2 years ago. Not one window facing the lake worked without propping it up with<br/> a stick and the rubber around the windows was falling off; the screen on the sliding door to the balcony was off and ripped. I called the property management company and they were looking at fixing it. In the meantime, we could not leave the door open at night<br/> to cool things down (no A/C here). Horrible mold problem in the upstairs bathtub. Carpets were dirty. Upstairs loft bedroom light and fan were broken (was very hot and uncomfortable for our family). Am sad about the decline. We will not be back and have found<br/> another place to stay next year. Overall rating of 2 stars is strictly for the nice view.

Mill Park Unit #5 is AOK except for fire hazard TV in bedroom. 1. Unit #5 still has old fire hazard TV in master bedroom which we warned about last year. This year it again made worrisome noises when off so we unplugged it again. This is crazy. Have owners get rid of it. Have you not read about old TV's exploding??<br/> 2. Porch screen door ripped and needs new screen. 3. Needs more dinner plates. Only has 4.

old and not worth 300.00 a night there was no info. in the condo for check out like they said would b. The kitchen had crumbs all over the table &amp; counters. The screen door was broken and have the window screens were too. Deck dirty. Not impressed at all &amp; we have stayed there in the<br/> pasted. will not recommend

Worst customer service...refusing to return our money! We rented two units and then were told one went into foreclosure. We cancelled because two families wanted side by side units. The mgmt company charged us full price on our Visa for two units and when we complained they refused to return our deposit money even though we never signed a contract and said we didn't want to rent from them because we needed two units. Mgmt kept stating they would fix the problem and made excuses that the key person was out of the office, on vacation, etc... so we have called our Visa company and will report the company to the Better Business Bureau since they charged our Visa for two rentals at full price that we never occupied and never intended to occupy! Renter beware!

Good location, very poor condition so disappointed in this property. Most of the windows don't work. One had to be propped open with a dowel. some wouldn't open at all. the screen on the sliding door kept falling off. ther is no air conditioning and so opening windows is a must. we weren't able to get air flow. the kitchen needs updating. The railings on the stairway were so far apart that our 2 year old grandson almost fell through to the lower level. the bedding was dingy. we had to call the cable company to get the Internet working. only good thing was use of the dock and the location to town, beach, park.

MILL PARK CONDO #5 - EXCELLENT! We just spent a joyous week with our children and grandchildren in Mill Park Condo #5. We were within a few steps of the beach. We parked the boat within site of the deck and beached our jet ski within sight. It was a wonderful location. Plenty of beds for everyone. The grandchildren loved the loft and even slept there a couple nights. The upstairs was a little warm so if you like to sleep cool take plenty of fans with you. The ceiling fans and the box fans at the condo are not enough to keep it cool during July/August. The park was so close the kids played there every night and even enjoyed feeding the fish at the hatchery located at the end of the dock. It was a wonderful experience and well worth the money. Can't wait for next year!

Great place to stay! Great location, close to eating/entertainment, yet private setting. Plenty of parking for snowmobilers. Units are spacious and modern and very clean. This is our 5th year staying there, and we will continue to stay ther for our snowmobile vacation!

Comfortable accommodations with all the basic equipment. Views and location a definite asset. We were a bit surprised by what appeared to be a rush clean-up (dust accumuation and spotty vacuuming). Friendly, helpful staff assisted in making the booking process effortless. I will return.

Mill Park Condo #5 This is the 2nd year we stayed in this particular condo. We love the location right next to the beach and boat dock. Everything we needed was there. We were hopeful that the upstairs bedroom with the Queen size bed might have a new mattress. The mattress in this room is rock hard and impossible to get a good night's sleep on. Last year I ended up sleeping on the floor and found it more comfortable than the bed. If you don't mind a hard bed this is the room for you. We loved being able to keep up with our laundry but the agitator in the washer needs to be balanced. It was so loud it it was impossible to talk in the kitchen. Other than the bed and washer we really enjoyed our stay...Could someone jump on the bed and soften it up for next year?

I have been at the Mill Park Condo's several times in the last 5 years and I have always been very satisfied with the condition of the condo's and the service provided by Lakeside Vacation Rentals. Beautiful location, you couldn't ask for a better place to stay and see McCall. Love the spaciousness and how it accommodates a large crowd of people very comfortably for a reasonable price. I would definitely recommend these condos to anyone looking for a great place to stay in McCall.

Mill Park Unit #5 is perfect for a large family fathering -- lots of seating and eating space -- tastefully decorated and a great place for kids. It was very clean and organized -- with lots of sleeping accommodations. We enjoyed our stay immensely, but would love to have a large flat screen TV so that we can play back family videos taken during our stay. The WiFi is super!

We only had one problem while in McCall and that was with the screen door to the balcony. Other than that not working, everything else was perfect. The location was ideal and we were there on the fourth so it was perfect for the fireworks.

so disappointed in this property. Most of the windows don't work. One had to be propped open with a dowel. some wouldn't open at all. the screen on the sliding door kept falling off. ther is no air conditioning and so opening windows is a must. we weren't able to get air flow. the kitchen needs updating. The railings on the stairway were so far apart that our 2 year old grandson almost fell through to the lower level. the bedding was dingy. we had to call the cable company to get the Internet working. only good thing was use of the dock and the location to town, beach, park.

This property had everything that you would ever need for a stay away from your home. The location was wonderful. Our family had an amazing time. We would suggest this property to anyone looking for a vacation rental in McCall.

We rented two units and then were told one went into foreclosure. We cancelled because two families wanted side by side units. The mgmt company charged us full price on our Visa for two units and when we complained they refused to return our deposit money even though we never signed a contract and said we didn't want to rent from them because we needed two units. Mgmt kept stating they would fix the problem and made excuses that the key person was out of the office, on vacation, etc... so we have called our Visa company and will report the company to the Better Business Bureau since they charged our Visa for two rentals at full price that we never occupied and never intended to occupy! Renter beware!

1. Unit #5 still has old fire hazard TV in master bedroom which we warned about last year. This year it again made worrisome noises when off so we unplugged it again. This is crazy. Have owners get rid of it. Have you not read about old TV's exploding??<br/> 2. Porch screen door ripped and needs new screen. 3. Needs more dinner plates. Only has 4.

there was no info. in the condo for check out like they said would b. The kitchen had crumbs all over the table &amp; counters. The screen door was broken and have the window screens were too. Deck dirty. Not impressed at all &amp; we have stayed there in the<br/> pasted. will not recommend

For $310 a night you expect clean/nice. Stayed here 2 years ago-was pristine then. So very disappointed this time after bringing family to stay and bragging how great it was 2 years ago. Not one window facing the lake worked without propping it up with<br/> a stick and the rubber around the windows was falling off; the screen on the sliding door to the balcony was off and ripped. I called the property management company and they were looking at fixing it. In the meantime, we could not leave the door open at night<br/> to cool things down (no A/C here). Horrible mold problem in the upstairs bathtub. Carpets were dirty. Upstairs loft bedroom light and fan were broken (was very hot and uncomfortable for our family). Am sad about the decline. We will not be back and have found<br/> another place to stay next year. Overall rating of 2 stars is strictly for the nice view.

We loved staying at this condo. The place is huge, the view is gorgeous, the beds are comfy, the rooms and bathrooms were big. The kids had fun hooking their video game to the TV and playing together. The lake and beach being just out the door is so convenient.<br/> Walking to town or to our jet ski and boat rental pickup was easy. Overall, we love McCall and love the condos.<br/>

When we arrived, the water was not turned on. It took several attempts to contact management to remedy the situation. Also, while overall the condo was cleaner than last year, there were still stains on the dining room carpet, dust and rings on the glasstops of the end table, and some of the kitchen appliances (i.e. crock pot) had dried-on food from previous guests.

Beware: tv in master bedroom is a FIRE HAZARD and I unplugged it. In middle of night it was making weird noises like it was about to burst into flames. Please have owners replace it.

LOVED this unit! Great for entertaining - two kitchen tables and large living/great room. Good sized deck with table and chairs, and beautiful view overlooking lake. Website pictures don't do the unit justice - much roomier and updated than appears on website. Very well stocked and real simple check-in/out.

I have been at the Mill Park Condo's several times in the last 5 years and I have always been very satisfied with the condition of the condo's and the service provided by Lakeside Vacation Rentals. Beautiful location, you couldn't ask for a better place to stay and see McCall. Love the spaciousness and how it accommodates a large crowd of people very comfortably for a reasonable price. I would definitely recommend these condos to anyone looking for a great place to stay in McCall.

This is the 2nd year we stayed in this particular condo. We love the location right next to the beach and boat dock. Everything we needed was there. We were hopeful that the upstairs bedroom with the Queen size bed might have a new mattress. The mattress in this room is rock hard and impossible to get a good night's sleep on. Last year I ended up sleeping on the floor and found it more comfortable than the bed. If you don't mind a hard bed this is the room for you. We loved being able to keep up with our laundry but the agitator in the washer needs to be balanced. It was so loud it it was impossible to talk in the kitchen. Other than the bed and washer we really enjoyed our stay...Could someone jump on the bed and soften it up for next year?

Comfortable accommodations with all the basic equipment. Views and location a definite asset. We were a bit surprised by what appeared to be a rush clean-up (dust accumuation and spotty vacuuming). Friendly, helpful staff assisted in making the booking process effortless. I will return.

Great location, close to eating/entertainment, yet private setting. Plenty of parking for snowmobilers. Units are spacious and modern and very clean. This is our 5th year staying there, and we will continue to stay ther for our snowmobile vacation!

We just spent a joyous week with our children and grandchildren in Mill Park Condo #5. We were within a few steps of the beach. We parked the boat within site of the deck and beached our jet ski within sight. It was a wonderful location. Plenty of beds for everyone. The grandchildren loved the loft and even slept there a couple nights. The upstairs was a little warm so if you like to sleep cool take plenty of fans with you. The ceiling fans and the box fans at the condo are not enough to keep it cool during July/August. The park was so close the kids played there every night and even enjoyed feeding the fish at the hatchery located at the end of the dock. It was a wonderful experience and well worth the money. Can't wait for next year!
