GUEST AGREEMENT

THIS AGREEMENT is made on the ____________day of ______________________, 20__.

BETWEEN:

The Property Manager

(Hereinafter referred to as the “Company”)

AND:

Name(s) ___________________________________________________________

Address____________________________________________________________

(Hereinafter referred to as the “Guest”)

The Company has been hired to act as the Owner’s agent to arrange for guests to stay at the property. As a Guest interested in the Property for your vacation, you are now entering into an Agreement on the terms and conditions set out below.

THIS AGREEMENT WITNESSES that, in consideration of the premises, agreements and covenants below, the Company and the Guest agree as follows:

The Company as an Agent

The Company has arranged for the use of this Property by the Guest. The Guest agrees that the Guest is paying the company for the use of the property, and that the Company incurs no liability whatsoever.

Cancellation & Booking Deposit

General Cancellation Policy:
High Season: Deposit of 25% due at time of reservation. Balance is due 30 days prior to arrival date. Reservations must be cancelled at least 60 days prior to date of arrival for full refund. If cancelled 59-30 days prior to arrival deposit is non-refundable, within 30 days or less the entire reservation is non-refundable. Low Season: Deposit of 25% due at time of reservation. Balance is due 14 days prior to arrival date. Reservations must be cancelled at least 14 days prior to date of arrival for full refund. If cancelled within 14 days or less the entire reservation is non-refundable. No Discover cards accepted. $50.00


If, for any reason, the Company cancels a confirmed reservation or the Property is rendered uninhabitable, other than as a result of a default by the Guest or an invitee of the Guest, the Company will refund the 50% guest deposit. The Company will make reasonable efforts to find another suitable property for use by the Guest. Neither the Owner nor the Company will be liable in any way to the Guest in the event of a cancellation of a confirmed booking, other than expressly set forth in this paragraph and the Guest damages or claims shall be limited to the return of the funds paid.

Guest Conduct

The Guest will act in a proper and reasonable manner while staying at the Property and will ensure the Property and all contents and chattels used by the Guest are used in a manner to avoid any damage, reasonable wear and tear permitted, and will make all reasonable efforts to preserve and protect the Property and will not create a nuisance to
occupants of any neighboring Property.

The Guest will ensure that members of the Guest’s party and the Guest’s invitees act in accordance with the terms of the Guest Agreement and otherwise comply with the obligations of the Guests. The Guest is responsible for the acts of members of the Guest’s party and of the Guest’s invitees.


The Guest will vacate the Property at the 10:00 (am) checkout time and note that there is a 3:00 (pm) or later check-in time. The Guests will leave the Property in a clean tidy and orderly condition with furniture in the same location as at the commencement of the stay. Unless a late checkout is arranged on or before arrival a $50/hour fee will be charged
for each hour (or portion thereof) past the required checkout time and before the required check in time.

Only those adults who have been listed in the Guest Agreement and the minor children named may stay overnight at the Property. The rates are based on double occupancy. Charges for additional persons apply. Unless previously agreed, if an additional person over the agreed number of occupants stays overnight at the Property, an additional
charge of $50 per guest per night will be levied. The guest may not camp, tent or place auxiliary facilities on the Property without prior written authorization from the Company. The Guest may not sublet all or a portion of the Property nor assign this Guest Agreement.

The Owner or Company may ask a Guest, or the Guest Party to leave if, in the Owner’s or Company’s reasonable opinion, the behavior of the Guest or any member of the Guest’s Party is unreasonable, or if the Guest breaches this Guest Agreement, whereupon the use will terminate and the Guest will not be entitled to any refund.

Use or storage of contraband or illegal substances on the property will result in immediate eviction and notification of the appropriate authorities.

Damage Deposit

The damage deposit is separate from the booking deposit of 25%. All reservations are subject to a $500-damage deposit regardless of length of stay. The damage deposit may be retained and applied against any and all damage and loss to the Property (other than normal wear and tear), excessive cleaning costs and any other amount owing by the
Guest under this Guest Agreement. The retention of the damage deposit herein is without prejudice to the Owner’s right to claim from the Guest any amount in excess of the damage deposit. The Guest does hereby authorize the Owner or the Company to charge any excess damage or costs referred herein to any Guest’s credit card, the particulars of such card having been provided to the Owner or the Company. The Company will return the damage deposit, minus any deductions to the Guest. There is a $50 charge per key for keys not returned to the Company upon departure.

Cleaning Fees

Cleaning deposits are separate from damage deposits and are completely non-refundable. Cleaning fees differ between properties. The Guest is responsible for leaving the accommodation tidy and clean, with furnishings left in the same position as it was when the Guest arrived.

Property Used at Guest’s Risk

The Property is used entirely at the risk of the Guest and members of the Guest’s party. The Guest is responsible for any damage, loss or injury caused to the Property or to any other property or person by the Guest or members of the Guest’s party, or the Guest’s invitee. Neither the Company nor the Owner is responsible for any injury, accident,
death, property loss or damage, loss of physical or mental enjoyment, expense, cost or inconvenience directly or indirectly caused to the Guest or any member of the Guest’s party, by or arising out of the use or occupation, or the condition of the Property or its approaches. The fact that children may be permitted on the Property does not imply that
the Property is without risk to children.

Indemnity

The Guest will indemnify and save harmless the Owner, the Owner’s agents and the Company from any and all damage, loss, expense, claim, action or liability of any kind whatsoever, or howsoever caused including, without limitation, a claim of any kind by any member of the Guest’s party (including those of minor children), which arises
from or relates in any way to the use or occupation of the Property by the Guest, members of the Guest’s party or by invitees of the Guest. The Guest is responsible for any damage of any kind to the Property caused or contributed to by the Guest, members of the Guest’s party or by invitees of the Guest.


Limitations of Claim

If the Guest or any member of the Guest’s party or invitee of the Guest’s party or invitee of the Guest, has a claim of any kind against the Company or the Owner, with respect to, or arising from this Guest Agreement or the use of the Property, the maximum liability in all circumstances of the Company and the Owner with respect thereto will be the
amount of money the Guest has paid under this Agreement.

Interpretation

The laws of the State of Idaho, USA shall govern this Guest Agreement; the singular will include the plural. If there is more than one Guest, the covenants, agreements and acknowledgments of each person comprise the Guest.

The Agreement and other writing delivered pursuant hereto may be executed in any number of counterparts with same effect as if all parties to this Agreement or such other writing had signed the same document and all counterparts will be construed together and constitute on and the same instrument. Facsimile copies and facsimile signatures will be
valid and binding.

This Agreement will ensure to the benefit of and be binding upon the respective legal representatives, successors and permitted assigns of the parties.

The Guest agrees to use the Property for the period of time for the amounts and other payments set out herein and in the Rental Application on other terms and conditions contained in this Guest Agreement. The adult members of the Guest party who execute this Agreement agree to observe, perform and abide by the obligations of the Guest under this Guest Agreement. The undersigned agree that they and all their guests will use the Property at their own risk.

Facsimile Agreement

The guest agrees that this agreement may be executed by this and other facsimile transmissions and this/or other original facsimile signatures will seal the binding obligation of the parties to be bound by the terms of this agreement.




Limitations of Liability:

I/We_______________________________________________________________________________________

represent, warrant, acknowledge, and agree with Ranch Park Rentals and the Company that I/we will use the cabin, it's property, it's facilities and equipment in accordance with the terms and conditions, the household rules/inventory lists, and the cabin rental application and that I/we do so at my/our own risk and that I/we indemnify and save, the Company and the Property Manager harmless from any personal injury, sickness or death, loss or damages, however caused, to person or property of the guest, his/her respective family, and/or guests, during or after the time of occupancy. Additionally, I/we accept full responsibility of the use of the cabin and the surrounding property and any and all equipment, furnishings and agree to pay for any repair or replacement of the fore mentioned cabin equipment beyond normal wear and tear.

Perfect for a family This vacation rental was perfect for our family. The location is close to town. Do you know it was clean and warm. The added bonus was having the garage to park a car in.

Late July in McCall The stay was very nice and management helpful. The best part was the newer furnishings in the house along with excellent kitchen. Downside was noise of the golf course maintenance people and equipment directly behind our patio beginning every day at daylight. Also, housekeeping must have missed plunger under sink with remains from toilet. Smell was horrible, but once we got it cleaned our stay was excellent. Very central location close to everything.

Excellent Property This unit is excellent, very well appointed and laid out very nicely. Privacy for all the rooms, furniture is very nice and beds comfortable. This would be a great unit for a big family of 6. It looks new. I would take different pictures as the ones on line are not as good as the unit really looks. Highly recommend this property.

Weekend at Birch Haven Our family had a wonderful time at Birch Haven. The condo was clean, comfortable and there was plenty if room for all 6 of us. The beds were extremely comfortable. It was well furnished and provided everything we needed for the weekend. We will definitely stay there again.

Reservation process confusing When we made the reservation you required a $250. deposit that I thought was charged to my credit card. A few weeks before we arrived I made two or three inquires about the deposit and final payment. It was very difficult to get anyone to answer phone calls and e-mails. It turned out no deposit was taken and the full amount was not charged until two weeks before arrival. It was very confusing and a little disappointing.

Very nice, 2-story townhouse! The home is very comfortable. Very nice furnishings and plush beds. It is located close to town and the many bike trails are wonderful! It is just a few feet from the golf course. I very much recommend this home, particularly if you enjoy golfing and biking! It does not have a lake view but it is in a beautiful, relaxing setting. The one downside we experienced was that there was no propane for the BBQ. Thank you for sharing this beautiful townhouse!

Fun time in McCall The condo is in a great location, close to the lake, golf course and town. It is quite new with nice furnishings and a good kitchen for cooking. It is a little dark inside due to the close proximity of the trees between the unit and the golf course.

Reservation The policy for cancellation. We made a reservation less than 30 days befor the date that we were to use the property and some thing came up where we had to cancel two days after the reervation.There was no copies of the agreement or instruction on where on how to get to the property until the day befor. arriving at the property.

Really enjoyable property! Had a great time at this condo. Great layout for a smaller family. Only recommendation would be offer WiFi in the unit. Really problematic not having WiFi living in such a connected world. We would have extended our stay longer in this unit if internet was available for remote workers like us.

Very Comfy! Nice and clean, we will be back for sure! The only thing I would suggest if you have children, make sure you bring plenty of DVDs, board and card games. Theres not a lot for them to do.

Birch Haven We had a family of 5 and the sleeping arrangements were perfect for us. I think sleeping 8 would be very difficult unless it were 2 couples and 4 kids. The cabin was very clean and the area was very quiet and very close to Ponderosa State Park. The kitchen was well stocked with everything we needed. If we ever have the opportunity to visit McCall we would love to rent this property again.

Great place, quiet and in great condition We found the townhome to be very clean and quiet. The location was central to golfing and a short bike ride to main street or the beach. The property was in great condition, and the beds were extremely comfortable, we have not gotten a better nights sleep<br/> on vacation in a long time. We would recommend this property and will plan on staying again in the future.

Decent place for the price This is the second time we have stayed at this property. The woodburing stove is nice. It would be nice to have a key as we are always worried we are accidently going to lock the door to the garage. $99 cleaning fee is high. There is a light out in the kitchen, that was out both times we rented this property. The heating unit closest to the kitchen also has some problems, as does the light switch in the downstairs bathroom. There are not enough cutting knifes.

Birch Haven, Unit B Unit was clean and the right size for our group of four adults and two children. Lack of HD TV was a negative, particularly since the TVs themselves appeared to be HD capable. Lack of High Speed Internet access was a negative. Unit information book said there was a garbage can in the garage but there was no garbage can on site. Had to carry our trash off site. This was a negative.

Birch Haven ... little slice of Heaven! Great set up, nice furniture, very comfortable accommodations, close to town. A few suggestions -- needs a grill on patio, needs sharp kitchen knives (we could only find silverware knives?) and the mattress on the trundle bed (pull-out) was awful - ok for a kid but not an adult). Overall - great experience! We'll be back!

Birch Haven Experience I don't know if I'd say that the description of the property is misleading, but it fails to mention that this is a condo. If you're looking for privacy this might not be the one for you, but it is a very nice, clean place and we had a good time.

New Years Weekend at Birch Haven Overall we had a nice new years weekend staying at the Birch Haven property. Property is very nice and is clean. However, there are a couple things that would prevent me from staying at Birch Haven again, depending on # of people staying.<br/>Pro's: Nice location, good sized kitchen and dinning area for 8 guests. Several TVs for chill time, garage space for 1 vehicle, quite area.<br/>Cons: I definitely disagree that this place sleeps 8 people as listed. Property has two nice bedrooms with king/queen beds (which will sleep 4). Third bedroom has two twins which is not completely desireable for a couple. The "other bed" was described as a pull out queen in the loft. I would not call the area a loft, more of a hallway. The pull out mattress was EXTREMELY uncomfortable, highlight EXTREMELY, thin and springs jabbing. When pulled out took up the entire hallway and guests in two upstairs bedrooms could not walk past.<br/>I would say this unit sleeps 6 comfortably, NOT 8. Would not recommend this unit if you take 8 adults as our party did. This unit is better suited for at max 4 adults and then a few kids perhaps.

This is the second time we have stayed at this property. The woodburing stove is nice. It would be nice to have a key as we are always worried we are accidently going to lock the door to the garage. $99 cleaning fee is high. There is a light out in the kitchen, that was out both times we rented this property. The heating unit closest to the kitchen also has some problems, as does the light switch in the downstairs bathroom. There are not enough cutting knifes.

We found the townhome to be very clean and quiet. The location was central to golfing and a short bike ride to main street or the beach. The property was in great condition, and the beds were extremely comfortable, we have not gotten a better nights sleep<br/> on vacation in a long time. We would recommend this property and will plan on staying again in the future.

This property is top has very comfortable beds and the kitchen is well stocked for cooking meals in. The decor is very cute. Overall a super nice place to stay.

We had a family of 5 and the sleeping arrangements were perfect for us. I think sleeping 8 would be very difficult unless it were 2 couples and 4 kids. The cabin was very clean and the area was very quiet and very close to Ponderosa State Park. The kitchen was well stocked with everything we needed. If we ever have the opportunity to visit McCall we would love to rent this property again.

Everything was great - I would only recommend one thing - and that was to have a good stock of dry wood for the fire. We had to search for it and was able to scrounge up some damp wood.

Nice and clean, we will be back for sure! The only thing I would suggest if you have children, make sure you bring plenty of DVDs, board and card games. Theres not a lot for them to do.

This was our second stay in this property. The price is right, good location, comfortable beds, and a well equipped kitchen. Good for 4-5 adults.

Overall we had a nice new years weekend staying at the Birch Haven property. Property is very nice and is clean. However, there are a couple things that would prevent me from staying at Birch Haven again, depending on # of people staying.<br/>Pro's: Nice location, good sized kitchen and dinning area for 8 guests. Several TVs for chill time, garage space for 1 vehicle, quite area.<br/>Cons: I definitely disagree that this place sleeps 8 people as listed. Property has two nice bedrooms with king/queen beds (which will sleep 4). Third bedroom has two twins which is not completely desireable for a couple. The "other bed" was described as a pull out queen in the loft. I would not call the area a loft, more of a hallway. The pull out mattress was EXTREMELY uncomfortable, highlight EXTREMELY, thin and springs jabbing. When pulled out took up the entire hallway and guests in two upstairs bedrooms could not walk past.<br/>I would say this unit sleeps 6 comfortably, NOT 8. Would not recommend this unit if you take 8 adults as our party did. This unit is better suited for at max 4 adults and then a few kids perhaps.

I don't know if I'd say that the description of the property is misleading, but it fails to mention that this is a condo. If you're looking for privacy this might not be the one for you, but it is a very nice, clean place and we had a good time.

Great set up, nice furniture, very comfortable accommodations, close to town. A few suggestions -- needs a grill on patio, needs sharp kitchen knives (we could only find silverware knives?) and the mattress on the trundle bed (pull-out) was awful - ok for a kid but not an adult). Overall - great experience! We'll be back!

Unit was clean and the right size for our group of four adults and two children. Lack of HD TV was a negative, particularly since the TVs themselves appeared to be HD capable. Lack of High Speed Internet access was a negative. Unit information book said there was a garbage can in the garage but there was no garbage can on site. Had to carry our trash off site. This was a negative.
