CHECK-IN/CHECK-OUT: The check-in time is 3:00 pm for condos and 4:00 for homes. The check-out time is 10:00 am. TENANT agrees to such time periods so the property may be properly cleaned for the next guest. If you have a vehicle, please register it with the main office if applicable or pick up the parking pass with your keys

Please advise if you expect late arrival after 5 p.m. Also you will need a valid I.D. and credit card at check-in.

CANCELLATIONS: Cancellations must be made in writing at least thirty (30) days prior to the scheduled arrival date. You will forfeit your reservation deposit and rental rate if you cancel less than (30) days and PROPERTY MANAGER is unable to re-rent the property. If re-rented, all funds will be returned within thirty (30) days of the new booking date, minus a $25.00 processing fee. A cancellation fee of $25.00 will be charged to any guests that cancel to cover all administrative fees.

ADDITIONAL CHARGES: All "Normal" utilities are included. Tenant will be charged additional fees for the following: long distance phone charges, fines or summons imposed as a result of your actions or your guest’s actions, any damage to the condo, contents, grounds or dock, excessive utilities, water, electric, etc. Anything requiring service or action by owner or agents as a result of tenants actions. The phone will be blocked from long distance and 900 number calls. A calling card or credit card will be required to make long distance calls. Toll free calls are assessable. *SOME UNITS OFFER FREE LONG DISTANCE FOR THE U.S. AND CANADA. PLEASE ASK ABOUT YOUR RENTAL.

PETS: There shall be no pets allowed on the premises for any reason unless prior authorization and approval is made. If a pet is allowed at your rental, a fee of $50.00 per pet will be charged and is non-refundable. Please clean up after your pet. Failure to clean up after your pet will result in a charge of $100.00 for removal.

RETURN CHECK FEE: A fee of $40 will be charged for a returned check for insufficient funds.

GUESTS/PARTIES/NOISE: The TENANT must supervise Guest(s) while on the premises. Noise in the condo must be kept to a reasonable level as not to cause a disturbance to the neighbors or general public. In no event may the maximum occupancy be exceeded without our written consent.

NO SMOKING POLICY: No smoking is allowed inside the condo whatsoever. If evidence is found of smoking in unit, Tenant will be charged $500.00 for violating the NO Smoking Policy.

CLEANING: Please start a load of laundry prior to departure. Please discard used food from the cabinets and refrigerator, and all recyclables placed in the container in outdoor bins. Please remove the trash from the condo and put in the appropriate bins. Please load and start the dishwasher upon departure.

MAINTENANCE: It is expected that major systems in the condo will break down from time to time such as air conditioning, refrigerator, etc. PROPERTY MANAGER will make every effort to have the issue repaired as quickly possible upon notice by the tenant to PROPERTY MANAGER. Owner and PROPERTY MANAGER assume no liability to tenant if such should occur as all products have a useful life and break down occasionally.

TENANT RESPONSIBILITIES: Please report any issues with the unit immediately to PROPERTY MANAGER.

SUBLETTING/ASSIGNING/OCCUPANCY: There shall be no subletting of the premises. The TENANT shall occupy and use the premises as a vacation residence only and not use the premises for any business, professional, unlawful or hazardous purpose.

END OF TERM: At the end of the term, the TENANT shall leave the premises clean and in good condition, remove all TENANT property, repair unreasonable damages caused during their stay.

HOLD HARMLESS AND INDEMNITY: Guest hereby agrees to indemnify and hold PROPERTY MANAGER harmless for injuries or other losses to Guest and other persons and property that may occur in connection with Guest's use of the Premises. Guest further agrees that, as agent for the owner of the Premises, PROPERTY MANAGER has no control over the condition of the Premises and, furthermore, that PROPERTY MANAGER is not under any obligation to accept for safekeeping any moneys, securities, jewelry or other articles of personal property belonging to Guest, nor is PROPERTY MANAGER liable for any loss in connection with any such items, or for providing security for the Premises. PROPERTY MANAGER will cooperate in forwarding any complaint or concern of Guest to the owner of the Premises, but shall not be obligated to correct any condition or hazard associated with the Premises. All property information is provided by the individual property owner and is true and accurate to the best of PROPERTY MANAGER’s knowledge, however guest agrees to indemnify and hold PROPERTY MANAGER harmless for any property information errors due or changes due to maintenance or owner's removal of items from the home or condo. We have made every effort to ensure that all information on PROPERTY MANAGER’s website is correct and accurate.

OCCUPANTS: The occupancy of the condo is limited to the number of persons and particular persons described in this agreement. The maximum occupancy is ________ ( ) persons including babies and children. If tenant exceeds the maximum occupancy, tenants and any/ all guests are subject to immediate removal and forfeiture of their security deposit and rental payment. If tenant exceeds the maximum occupancy without owners consent, tenant will be charged $100.00 per day, per person that exceeds the maximum rental. In addition, no boats or trailers are allowed to be parked on the property. The tenant must seek storage of the trailer(s) offsite at a proper trailer storage facility. A maximum of _____ vehicle(s) are allowed to be parked on the property.

ACCESS: Tenant may be asked to allow access to the condo and property upon the request of PROPERTY MANAGER and/or owner and his agents. Agents, to include, but are not limited to: plumbers, electricians, rental companies, maintenance, pest inspection, etc.

SAFETY: Tenants acknowledge and agree that they are responsible for the safety of themselves, their guests, and their children with respect to the pool and beach. Tenant acknowledges and agrees to hold owner harmless from any injuries to them or their guests. It is understood that there is no lifeguard and that supervision is his or her responsibility.

KEYS: Keys can be picked up on day of check-in at PROPERTY MANAGER’s office. The keys must be returned upon departure. We do charge for lost keys. There will also a fee for lost beach/gate access card at the rate determined by the condo association. Failure to return keys to rental office will result in a charge of $25.00 for keys and $100.00 for each access card.

AGE REQUIREMENT. Guests under the age of 21 unaccompanied by a parent or legal guardian will not be permitted to rent or occupy any vacation rental home from Florida Spirit. Any reservations made under false pretenses will result in loss of advance payments and removal from the premises.

LAWS: The Laws of the State of Florida shall apply to all terms under this Agreement. Venue for enforcement shall be in Saint Johns, Florida for any dispute under this agreement. It is expressly agreed and understood that this lease shall not be recorded in the County Clerk’s office. This agreement is made and shall be governed in the county of Saint Johns, Florida under Chapter 509, Florida Statutes.

LIABILITY: Tenant may be responsible and liable to owner for damages in excess of the damage insurance for any damage or loss caused by tenant or its guests. No refund will be given for weather conditions, or Acts of God or nature. Should the unit be rendered uninhabitable for any reason prior to the arrival date, every effort will be made to move the tenant’s reservation to another unit or the rental agreement will be voided and refunded to the tenant.

DAMAGE CHARGES. Your credit card information will be kept on file during the term of your stay in our St. Augustine office for use as a "security/damage deposit" to insure compliance with the terms of the Rental Agreement. If, after inspection, it is determined that the condition of the rental you inhabited is beyond normal wear and tear, or contents are missing from the unit, Tenant agrees to accept all liability and understands that these costs will be charged to the Tenant's credit card, to include an applicable administrative fee. Amounts may also be charged to cover unnecessary service calls, unreturned keys, or remotes to our St. Augustine rental units. Please report any problems or damage in your unit the day of check-in. If not reported, we must assume the damages occurred during your occupancy of our rentals. The Property Manager's determination of damages will be conclusive.

RENTAL DAMAGE PLAN. This Vacation Rental Damage plan covers unintentional damages to the rental unit interior that occur during your stay, provided they are disclosed to management prior to check-out. The policy will pay a maximum benefit of $1,500.00. Any damages that exceed $1,500.00 will be charged to the credit card on file. If, during your stay at one of our Rental Properties, an Insured Person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or actual cash value of such property up to a maximum benefit of $1,500.00. Certain terms and conditions apply.

RIGHT TO REFUSE OCCUPANCY AND REMOVAL OF GUEST. If Guest violates the terms and conditions of occupancy of the Premises, including without limitation, failure to pay rent as agreed with PROPERTY MANAGER, failure to check out of the Premises at the time set forth herein (or if such time is extended at PROPERTY MANAGER's sole option, at the time otherwise agreed to by Guest and PROPERTY MANAGER in writing), causing damage to the Premises, or engaging in prohibited use of the Premises, and Guest fails to pay for, or vacate the Premises upon written or oral request by PROPERTY MANAGER, Guest may be summarily removed with the assistance of a Florida law enforcement officer in compliance with Section 509.141(4), Florida Statutes. In addition, in the case of a large unpaid bill for rental of the Premises where PROPERTY MANAGER reasonably determines that such an unpaid bill may not be paid by Guest, PROPERTY MANAGER may elect, in addition to all other remedies available to PROPERTY MANAGER, to lock Guest out of the Premises until payment arrangements are made in accordance with Section 509.401, Florida Statutes. In the event a guest fails to depart from the home on time at 10:00 am, forcing PROPERTY MANAGER not to be able to clean and prepare the home for the next arriving guest that day and having to move that guest to another home, the departing guest agrees to pay damages and cost incurred by PROPERTY MANAGER. PROPERTY MANAGER reserves the right to refuse service to any guest for any reason, provided, however, that such refusal shall not be based on race, creed, color, sex, physical disability or national origin.

CERTIFICATION: I or we, the Tenant(s), hereby certify and consent that I/we have read all pages of this agreement and conditions and agree to the terms and will comply with them during the course of this vacation rental.

Anniversary Weekend This was a very nice condo we enjoyed our stay it was clean and plenty of room for us close to the pool and close to the beach good location on Saint Augustine Beach and would definitely do it again.

Nice location, dated unit. The furniture in this unit is very dated. Drawers that were difficult to use due to broken slides in both bedrooms. Kitchen lacked very basic things like serving bowls and silverware that was like dollhouse size spoons and forks. When we arrived, both the closets had junk stored in them. Had to rearrange a lot of things for a long term (winter) stay.

Post-Hurricane Irma Stay After our original rental was damaged by Hurricane Irma, Vacation Rental Beach Properties was amazing to work with. John promptly re-booked us in this unit and we had a great time! Clean, close to the beach, and a comfortable stay!

Meh The parking fee was more than stated and cash only which could have been a problem, the beach code and wifi password we were given were both incorrect. The condo was not very clean and smelled like garlic. Bring your own dishes as most common cooking items were not there as well as no blow dryer. Over all we had a nice vacation but I would not stay at this condo again. Also we did inspect the unit after readying your review and found the hair dryer in the dresser drawer in the second bedroom. Also the kitchen is fully stocked, so we are not sure what you think is missing. Next, I would recommend calling if you have an issue so it could have been addressed.

Only a short walk to the beach with a large, relaxing outdoor Jacuzzi. You get the amenities of the resort, including two pools, tennis courts, and fishing ponds. The private patio faces southeast for maximum sun exposure. The unit has updated furniture and appliances, including dishwasher, microwave, double stainless steel sink, coffee maker, and a laundry room with a full size washer and dryer. The kitchen table seats six.

The condo has two TVs, including a 55”HD TV w/cable and DVD in the living room with a queen size sleep sofa, ceiling fans and plenty of closet space in the unit. The master suite contains a king size bed, TV, ceiling fan, and private full bathroom with a tub/shower combo. The second bedroom is complete with two twin beds, ceiling fan, and dressers. The second bath also contains a tub/shower combo.
