Terms

PAYMENT: Deposit is due at the time of reservation. Fifty percent (50%) of the total rent, taxes, and fees shall be paid and received by Agent in the form of a credit card personal check, certified, cashier or bank check or money order within 7 days after the reservation is made, and the balance of rent, taxes, fees and any unpaid security deposit shall be paid and received by Agent no later than thirty (30) days prior to check-in. The security deposit, rent, taxes, and fees may be paid by personal check conditioned upon Agent’s receipt of same more than thirty (30) days before the above-stated check-in date. A valid credit card must be provided no less than seven (7) days prior to check-in whether or not the reservation is paid for by credit card. The credit card will be charged in the event that damages, missing items or excessive use of utilities are not covered by the Guest’s security deposit.
UTILITIES: Utilities are included in the rental amount unless other wise stated, however Agent reserves the right at Agent’s sole discretion to charge Guest for excessive use of utilities if it is determined Guest used any or all of the provided utilities in an abusive or negligent manner. Guest agrees that all excessive use charges will be charged to Guest’s credit card on file and/or withheld from Guest’s security deposit. Guest shall pay cost of all utilities on rentals of more than 30 days unless otherwise stated.
Time is of the essence as to payment pursuant to this Rental Agreement, and any late payments shall, at the sole option of Agent, cause a forfeiture of Guest’s rights pursuant to this Agreement and immediate cancellation of same without further notice to Guest.
CANCELLATIONS: Reservations may be cancelled by Guest with notice to Agent within seven (7) days of the date of the reservation call, and more than thirty (30) days before check-in and any deposit received by Agent shall be refunded to Guest minus a $50.00 administration fee. After seven (7) days from the date of the reservation call, or less than thirty (30) days before check-in, any deposits, rent and fees paid shall become non-refundable if the reservation is cancelled by Guest. In the event of an emergency, Agent reserves the right at Agent’s discretion, to refund on a case by case basis only, part of any deposit, rent or fees paid, minus an administrative fee, upon notice of cancellation by Guest. Any deposit, rent or fees retained by
Agent pursuant to this provision shall be agreed upon liquidated damages, consideration for the execution of this Rental Agreement and in full settlement of all claims.
THIRD: GUEST COVENANTS AND CONDITIONS:
The parties agree that the following are material covenants and conditions of this Rental
Agreement, the breach of which shall result in immediate forfeiture by the Guest of the subject rental premises in accordance with applicable law:
1. Guest shall not damage the rental premises or any part thereof or any personal property or appurtenance therein or thereto, and if the premises, or any part thereof, or any personal property or appurtenance thereto are damaged, obstructed or rendered inoperable by the misuse or negligence of Guest, Guest’s guests, family, agents or employees, Guest shall pay the cost for repair or replacement of same immediately upon presentation by Agent of a bill for same.
2. Guest shall comply with all applicable federal, state, and county local laws, and community rules, regulations, covenants and ordinances including, but not limited to Flagler County, Florida, and the community in which the Guest is staying.
3. Guest agrees not to commit waste or to use the rental premises or any appliances or appurtenances thereof or thereto for any disorderly or unlawful or offensive purpose.
4. Guest shall permit only the people list in Addendum A, incorporated into this agreement by reference, to use and occupy the subject rental premises.
5. No pets are allowed in or around the rental premises at any time, unless specifically permitted by Owner and applicable pet fees are paid at the time this Rental Agreement is executed.
Vehicles identified in Addendum B, not to exceed two (2) vehicles and may be parked on the premises in approved parking places.
Any vehicles not identified in Addendum B shall be towed or removed from the premises at Guest’s expense.
7. In the event the premises become uninhabitable, due to damage from wind, fire, rain, storm surge, or any other cause, and the Owner, at his sole discretion, shall decide not to repair or rebuild the premises, the term of this lease shall end and rent will be prorated up to the time of the damage.
8. Guest agrees not to charge any long distance telephone calls or other charges to the telephone account(s) located at the rental premises. Local calls are permitted.
9. RADON DISCLOSURE: Pursuant to §404.056(8), Florida Statutes, Radon is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time.
Levels of radon that exceed Federal and State guidelines have been found in buildings in
Florida. Additional information regarding radon and radon testing may be obtained from your public health unit.
10. Guest agrees to permit Owner or Owner’s agents to enter the rental premises or any part thereof at any reasonable time for the purpose of examining same, to make necessary repairs, and/or to protect any personal property from damage. Reasonable time for said entry, without further notice to Guest, shall be between the hours of 9:00 a.m. and 5:00 although the parties may agree to additional hours for Owner’s access.
Owner or Owner’s Agent may also enter the rental premises with the consent of Guest, or when necessary in case of an emergency or when the Guest unreasonably withholds consent or access.
11. a. Guest acknowledges and agrees that Owner/Agent may remove or cause to be removed from the rental premises any Guest or guest who, while at the rental premises, illegally possesses or deals in controlled substances, violates any of the terms of this
Rental Agreement, is intoxicated, profane, lewd or brawling, who indulges in any language or conduct which disturbs the peace and comfort of other guests or neighbors, or which constitutes a nuisance, or which injures the reputation, dignity or standing of the
rental premises, or anyone who fails to make payment of rent at the agreed-upon rental rate and fees at the agreed-upon times, or anyone who fails to check-out at the agreed upon time unless an extension of time is expressly agreed to by the Agent and the Guest prior to check out. Admission to and removal from the rental property is not and shall not be based upon race, creed, color, sex, physical disability or national origin. Any notice to vacate may be given orally or in writing by Owner/Agent to Guest, and if in writing shall be as follows: “You are hereby notified that this establishment no longer desires to entertain you as its guest, and you are requested to leave at once. To remain after receipt of this notice is a misdemeanor under the laws of this State.”
b. If any Guest who is asked to vacate early has paid in advance, Agent shall, at the time notice is given, tender to the Guest the unused portion of the advance rent and fees payment without prorating any portion of the day that Guest is noticed to vacate. Agent may retain any security deposit without further notice as agreed upon liquidated damages, consideration for the execution of this Rental Agreement and in full settlement of all claims, or Owner, at Owner’s option, may proceed at law with any damages claim.
Any Guest who remains or attempts to remain in the rental premises after being requested to vacate shall be guilty of a misdemeanor of the second degree punishable in accordance with Florida law. If any person is illegally at the subject rental premises, Owner may call upon any law enforcement officer of this State for assistance. If the Guest is arrested,
Owner shall employ all reasonable and proper means to care for any personal property which may be left at the rental premises by the guest; however, upon arrest, the
Guest/guest shall be deemed to have given up any right of occupancy and to have abandoned such rights.
12. Guest agrees that Owner and Owner’s agents shall not be liable for any loss of or damage to any personal property in or on the rental premises or stored in rooms or places provided to Guest in connection therewith, nor shall Owner or Owner’s agents or employees be liable to Guest, Guest’s family, guests, or agents for failure to repair or maintain any part of the rental premises or property contained therein absent gross negligence. Guest further agrees that neither Owner, nor Owner’s agents or employees shall be liable for any damage to the personal property of the Guest, Guest’s family, guests, or agents arising from theft, vandalism, fire, water, rain, acts of God or government, interruption of utilities, acts of others or other third party or external causes whatsoever.
13. No lifeguard is available on the premises. Guest shall use amenities, pools, beach, ocean with great care and in accordance with any posted rules. All children and elderly, frail adults using said amenities shall be constantly supervised by a responsible adult who can swim. If the amenities are equipped with any safety features such as a fence or other pool or water area barrier, a pool cover, a door latch or a door or window alarm, Guest shall be responsible for correctly operating and using said safety device every time the amenity is used. Any use of said amenities shall be at the sole risk of the user, the responsible adult supervising the user, and the Guest.
14. Guest is responsible for and shall indemnify the Owner and Owner’s agents and hold them harmless from any and all claims, liability, demands, actions, causes of action, expenses, damages, losses or injuries sustained by any person including Guest, Guest’s family, agents, guests or invitees as a result of or arising from the Guest’s subject occupancy and tenancy, including, but in no way limited to claims arising from the use of any pool, hot tub, spa-pool, water area or dock, which are part of the rental premises.
Guest shall also be liable and indemnify Owner for attorney’s fees and court costs incurred by Owner in enforcing any of the terms, covenants or conditions of this Rental
Agreement or which are sustained by Owner as a result of or arising from or during this reservation.
15. Guest may not assign this Agreement or sub-let the rental premises or any portion thereof.
16. Guest agrees that if applicable local and/or state tax rates increase after the time of reservation and before check-in that Guest will pay the additional tax due.
17. Absolutely NO SMOKING is permitted in the residence or on any balconies, patios, etc. attached to said residence unless otherwise noted in writing. Any detection of smoking in the residence will result in automatic forfeiture of the entire security deposit, plus punitive fees.

Great stay at 800 Cinnamon Beach #741 Another fantastic stay at Cinnamon Beach. This is our 4th visit and #741 is our favorite! Beaches this year were in fantastic shape and the experience of the new moon was incredible. Close proximity to restaurants and the local Publix is just minutes away. My only critical comment is guests were selfish using the carts during check-in and check-out. One of the "offenders" was on our level! Hauling all our belongings by hand was a bit of a workout. Other than that everything was great and management was very responsive.

Mary M Vacation Week - May 25 - June 1, 2019 Condo was beautiful and convenient.<br/>Would suggest blinds or drapes over sliding glass doors as mornings were very bright.<br/>Also high stools at kitchen bar area would be nice too.<br/>We also had a mtc issue one day with air conditioner leaking into garage parking area so had to turn off the air until able to fix.

#741 Wonderful vacation at Cinnamon Beach. Unit #741 was very nice, very clean. The view was amazing. The balcony is huge. Our company said the beds were good and there was new bedding in the guest rooms. The master did need new bedding. Also we were told the unit would be painted and that would be very nice. Other then that, absolutely no complaints. Scott at Cinnamon Beach Vacations was so great to work with! Also John the maintenance man is wonderful. The grounds are beautiful. The pools are great. So fun to walk on the beach with easy access. You could walk for miles. We plan on coming back next year and our friends will be coming and staying next door.

Vacation 2019 The sliding doors going on to the balcony needed some blinds. The drain under the kitchen sink leaked a little. The location and staff were great. Someone wanted to view our room while we were there on vacation didn't like the idea of people coming to view the property while we had it rented for the week.

Great time at Cinnamon Beach. Had an outstanding experience with #741 for a one week stay at CB. This bright and pleasant corner unit on the 4th floor offered a fantastic view of the ocean as well as easy access to the beach. This was our second time visiting CB and its consistently been an excellent vacation choice for us. We would not hesitate to book 741 again for our next visit to CB.

Good - Recommended The beach this year was particularly rocky. We have been coming to this location for 7 years now during June and July. Each time the beach is a bit different. Last year very few rocks. This year it was crazy. So don't let the rocks scare you away - it will be different a week or two later. Also, this place has new furniture inside and on the deck. The deck is a great feature. The front gate system continues to be a pain, but its tolerable. Walk down to Atlantic Grill for a nice dinner. The gym is nice if you enjoy workouts during vacation. Kids seem to love the pools when they are not at the beach. Dune repairs are underway. We will be back.

Fabulous time had by all! This rental was great! Million dollar view could not be beat! We had 5 in our party. Kids ranged from 5-13. All loved the condo and all it had to offer! Clean, and well docorated. One bummer was the pool area. One of the pools was not usable (family pool including kiddie pool/splash pad). It was closed all week due to maintenance. We were able to use the other pool, but it closed at 7 pm. <br/>Besides that, we had a great time!! Would definitely stay again!<br/>

Fantastic beach condo Everything about the condo rental was great except for the restaurant management at the pool. They have very strict rules about outside food/ drinks in the pool area, although, they are not consistent. We walked up from the beach with a small cooler that only holds 2 waters (at most) and immediately they were on us letting us know the cooler wasn't allowed. We looked around to see people drinking Publix water bottles and they were not told those weren't allowed. We were forced to take the cooler back to the condo before we could enjoy the pool. The clubhouse management was only downside to this resort. Rules are rules but at least be consistent. Condo was exactly as shown in the photos.

Great location We have stayed in this development for the past five summers. Our first year in this unit. We had a trouble free stay. Kitchen was well stocked with dishes and glassware. Layout works well for families.

Wonderful!!! We stayed for 8 days and had a wonderful time. Due to scheduling problems we needed to extend our stay a day and accomplished it without any problems. The condo was great and coffee on the balcony watching the ocean was perfect. The beds were comfortable, there were plenty of linens and the kitchen was efficient and well stocked. Really enjoyed the stay.

Outstanding Ocean View Very comfortable condo, spacious, love the amenities. Fitness center has all new machines which we used at least 4 times. Working with Scott Massey was a very professional experience. Had all of our papers ready and e mailed to us before arrival.<br/>Loved the code on the front doors - did not have to go to an office to pick up a key. Can't wait to return. Beautiful neighborhood.

Best Florida vacation yet We actually rented 2 different units as we vacationed with our entire family, both were very nice condo's, pictures on the web site are exactly as the condo is, very clean and everything worked as is was meant to be, the entire complex was clean and well maintained, nice quiet area, check in and out was a breeze, we are already planning our next years vacation and plan to stay here again

A week at the beach Beach was beautiful and pools were both very nice. Condo was nice but needs some updating with the furniture. Outside furniture needs to be replaced rusty and old, a couple of the chairs you can't even sit in. Living room set is old and the rug was so dirty it should be thrown out. Master bed was had dips in it so we ended up sleeping across the bed side to side. Kitchen is very slimly stocked and only the very basic needs are there. Not even a dish strainer? Mostly just looks like the owners are never there and is just a income property for them.

Beautiful condo, beautiful location We enjoyed our stay at this beautiful condo very much. Everything was clean and just as it appears in the photos. The views from this unit are breathtaking. The whole area is gorgeous and not overly developed. One word of warning -- there is a $2.00 bridge toll to return to the condo from Palm Coast. We got tired of paying $2 each time we headed back from town, so we ended up going to Flagler Beach to eat most nights. It's right on the beach and has many reasonably priced restaurants and shops.<br/> The only problem we experienced in the condo was with the sliding door. It is quite difficult to open and shut. We were told maintenance would take a look at it, so hopefully they fixed the problem. <br/> A suggestion for the owner would be to add some toys. A condo of this size will most likely accommodate children on a regular basis. It would be great if there were a few items to keep toddlers busy in the condo and on the beach. We actually bought beach toys and left them there for future guests. <br/>Any "problems" we experienced were minor though and we did have a blast with our kids and grandkids. We will definitely stay here again if we come back that way.

Second visit to Cinnamon Beach One negative was that they were working on the pool area and had the children's area closed. Couldn't this be done another time of the year and not during prime vacation rental time?<br/>The condo I stayed in had this long shag rug. It might look cute but was a mess with constant with dust balls and a trip hazard. That rug needs to go. The unit was not child friendly with its suede couch and dining chairs too.

Cinnamon Beach 741 Satisfactory with a few disappointments. Appoinments and furniture were weathered and had seen better times especially the balcony furniture (rusted and chipped), master bed (concave in the middle), deep shag rug ( fuzz machine), window dressing ( torn and broken in 2 places). Not what I would expect from a 1st class location.

Amazing time of sun, relaxation, and family fun! Amazing gem just south of St. Augustine. Perfect private family vacation spot. FYI--Pools were advertised as heated, but pool attendants say May 1st they turn off the heaters. We were there week before Memorial Day, pools were colder than the ocean but tolerable.

Unit #741 This was one of the best family vacations we have ever had. Unit #741 was very spacious and plenty of room for us and the other family with us. The pool was great for the kids. The unit was up to date, very clean and had a spectacular view of the ocean. The entire complex was very clean, well kept, security gates which I liked and felt very safe. I am planning on staying here again in the future.

A Week at Cinnamon Beach We had a very nice time enjoying the oceanfront view and the conveniently located pool. The condo is beautifully and comfortably furnished. The walk to/from the pool was easy and worked right into longer beach walks. Although the distance from St Augustine was a little further than expected, it was super easy and offered scenic ocean views along the way.<br/>One thing to be prepared for: This particular unit offered very little in terms of supplies. We (just 4 of us in a condo that sleeps 8) had no kleenexes, and ran out of paper towels and toilet paper after just a half day there. We were also very short on hand soap as well as laundry and dishwasher detergent. Thankfully the Publix store is close, but later in our stay we discovered Walmart is much more reasonably priced and not much further away. <br/>Overall, we were very happy with the property and the relaxing ambience.

Fabulous trip Fabulous!! This unit does not have any beach items, so remember to bring your own chairs, boards, and so forth. A great unit! We will come back every year!!

Satisfactory with a few disappointments. Appoinments and furniture were weathered and had seen better times especially the balcony furniture (rusted and chipped), master bed (concave in the middle), deep shag rug ( fuzz machine), window dressing ( torn and broken in 2 places). Not what I would expect from a 1st class location.

We actually rented 2 different units as we vacationed with our entire family, both were very nice condo's, pictures on the web site are exactly as the condo is, very clean and everything worked as is was meant to be, the entire complex was clean and well maintained, nice quiet area, check in and out was a breeze, we are already planning our next years vacation and plan to stay here again

Beach was beautiful and pools were both very nice. Condo was nice but needs some updating with the furniture. Outside furniture needs to be replaced rusty and old, a couple of the chairs you can't even sit in. Living room set is old and the rug was so dirty it should be thrown out. Master bed was had dips in it so we ended up sleeping across the bed side to side. Kitchen is very slimly stocked and only the very basic needs are there. Not even a dish strainer? Mostly just looks like the owners are never there and is just a income property for them.

We enjoyed our stay at this beautiful condo very much. Everything was clean and just as it appears in the photos. The views from this unit are breathtaking. The whole area is gorgeous and not overly developed. One word of warning -- there is a $2.00 bridge toll to return to the condo from Palm Coast. We got tired of paying $2 each time we headed back from town, so we ended up going to Flagler Beach to eat most nights. It's right on the beach and has many reasonably priced restaurants and shops.<br/> The only problem we experienced in the condo was with the sliding door. It is quite difficult to open and shut. We were told maintenance would take a look at it, so hopefully they fixed the problem. <br/> A suggestion for the owner would be to add some toys. A condo of this size will most likely accommodate children on a regular basis. It would be great if there were a few items to keep toddlers busy in the condo and on the beach. We actually bought beach toys and left them there for future guests. <br/>

We loved the beach, the community, the amenities and the apartment! The only issue we had was the sliding glass door to the balcony. It was too heavy to required two hands, and neither of our kids could get it open.

One negative was that they were working on the pool area and had the children's area closed. Couldn't this be done another time of the year and not during prime vacation rental time?<br/>The condo I stayed in had this long shag rug. It might look cute but was a mess with constant with dust balls and a trip hazard. That rug needs to go. The unit was not child friendly with its suede couch and dining chairs too.

Amazing gem just south of St. Augustine. Perfect private family vacation spot. FYI--Pools were advertised as heated, but pool attendants say May 1st they turn off the heaters. We were there week before Memorial Day, pools were colder than the ocean but tolerable.

Everything about the condo rental was great except for the restaurant management at the pool. They have very strict rules about outside food/ drinks in the pool area, although, they are not consistent. We walked up from the beach with a small cooler that only holds 2 waters (at most) and immediately they were on us letting us know the cooler wasn't allowed. We looked around to see people drinking Publix water bottles and they were not told those weren't allowed. We were forced to take the cooler back to the condo before we could enjoy the pool. The clubhouse management was only downside to this resort. Rules are rules but at least be consistent. Condo was exactly as shown in the photos.

We stayed for 8 days and had a wonderful time. Due to scheduling problems we needed to extend our stay a day and accomplished it without any problems. The condo was great and coffee on the balcony watching the ocean was perfect. The beds were comfortable, there were plenty of linens and the kitchen was efficient and well stocked. Really enjoyed the stay.

Very comfortable condo, spacious, love the amenities. Fitness center has all new machines which we used at least 4 times. Working with Scott Massey was a very professional experience. Had all of our papers ready and e mailed to us before arrival.<br/>Loved the code on the front doors - did not have to go to an office to pick up a key. Can't wait to return. Beautiful neighborhood.
