Terms

PAYMENT: Deposit is due at the time of reservation. Fifty percent (50%) of the total rent, taxes, and fees shall be paid and received by Agent in the form of a credit card personal check, certified, cashier or bank check or money order within 7 days after the reservation is made, and the balance of rent, taxes, fees and any unpaid security deposit shall be paid and received by Agent no later than thirty (30) days prior to check-in. The security deposit, rent, taxes, and fees may be paid by personal check conditioned upon Agent’s receipt of same more than thirty (30) days before the above-stated check-in date. A valid credit card must be provided no less than seven (7) days prior to check-in whether or not the reservation is paid for by credit card. The credit card will be charged in the event that damages, missing items or excessive use of utilities are not covered by the Guest’s security deposit.
UTILITIES: Utilities are included in the rental amount unless other wise stated, however Agent reserves the right at Agent’s sole discretion to charge Guest for excessive use of utilities if it is determined Guest used any or all of the provided utilities in an abusive or negligent manner. Guest agrees that all excessive use charges will be charged to Guest’s credit card on file and/or withheld from Guest’s security deposit. Guest shall pay cost of all utilities on rentals of more than 30 days unless otherwise stated.
Time is of the essence as to payment pursuant to this Rental Agreement, and any late payments shall, at the sole option of Agent, cause a forfeiture of Guest’s rights pursuant to this Agreement and immediate cancellation of same without further notice to Guest.
CANCELLATIONS: Reservations may be cancelled by Guest with notice to Agent within seven (7) days of the date of the reservation call, and more than thirty (30) days before check-in and any deposit received by Agent shall be refunded to Guest minus a $50.00 administration fee. After seven (7) days from the date of the reservation call, or less than thirty (30) days before check-in, any deposits, rent and fees paid shall become non-refundable if the reservation is cancelled by Guest. In the event of an emergency, Agent reserves the right at Agent’s discretion, to refund on a case by case basis only, part of any deposit, rent or fees paid, minus an administrative fee, upon notice of cancellation by Guest. Any deposit, rent or fees retained by
Agent pursuant to this provision shall be agreed upon liquidated damages, consideration for the execution of this Rental Agreement and in full settlement of all claims.
THIRD: GUEST COVENANTS AND CONDITIONS:
The parties agree that the following are material covenants and conditions of this Rental
Agreement, the breach of which shall result in immediate forfeiture by the Guest of the subject rental premises in accordance with applicable law:
1. Guest shall not damage the rental premises or any part thereof or any personal property or appurtenance therein or thereto, and if the premises, or any part thereof, or any personal property or appurtenance thereto are damaged, obstructed or rendered inoperable by the misuse or negligence of Guest, Guest’s guests, family, agents or employees, Guest shall pay the cost for repair or replacement of same immediately upon presentation by Agent of a bill for same.
2. Guest shall comply with all applicable federal, state, and county local laws, and community rules, regulations, covenants and ordinances including, but not limited to Flagler County, Florida, and the community in which the Guest is staying.
3. Guest agrees not to commit waste or to use the rental premises or any appliances or appurtenances thereof or thereto for any disorderly or unlawful or offensive purpose.
4. Guest shall permit only the people list in Addendum A, incorporated into this agreement by reference, to use and occupy the subject rental premises.
5. No pets are allowed in or around the rental premises at any time, unless specifically permitted by Owner and applicable pet fees are paid at the time this Rental Agreement is executed.
Vehicles identified in Addendum B, not to exceed two (2) vehicles and may be parked on the premises in approved parking places.
Any vehicles not identified in Addendum B shall be towed or removed from the premises at Guest’s expense.
7. In the event the premises become uninhabitable, due to damage from wind, fire, rain, storm surge, or any other cause, and the Owner, at his sole discretion, shall decide not to repair or rebuild the premises, the term of this lease shall end and rent will be prorated up to the time of the damage.
8. Guest agrees not to charge any long distance telephone calls or other charges to the telephone account(s) located at the rental premises. Local calls are permitted.
9. RADON DISCLOSURE: Pursuant to §404.056(8), Florida Statutes, Radon is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time.
Levels of radon that exceed Federal and State guidelines have been found in buildings in
Florida. Additional information regarding radon and radon testing may be obtained from your public health unit.
10. Guest agrees to permit Owner or Owner’s agents to enter the rental premises or any part thereof at any reasonable time for the purpose of examining same, to make necessary repairs, and/or to protect any personal property from damage. Reasonable time for said entry, without further notice to Guest, shall be between the hours of 9:00 a.m. and 5:00 although the parties may agree to additional hours for Owner’s access.
Owner or Owner’s Agent may also enter the rental premises with the consent of Guest, or when necessary in case of an emergency or when the Guest unreasonably withholds consent or access.
11. a. Guest acknowledges and agrees that Owner/Agent may remove or cause to be removed from the rental premises any Guest or guest who, while at the rental premises, illegally possesses or deals in controlled substances, violates any of the terms of this
Rental Agreement, is intoxicated, profane, lewd or brawling, who indulges in any language or conduct which disturbs the peace and comfort of other guests or neighbors, or which constitutes a nuisance, or which injures the reputation, dignity or standing of the
rental premises, or anyone who fails to make payment of rent at the agreed-upon rental rate and fees at the agreed-upon times, or anyone who fails to check-out at the agreed upon time unless an extension of time is expressly agreed to by the Agent and the Guest prior to check out. Admission to and removal from the rental property is not and shall not be based upon race, creed, color, sex, physical disability or national origin. Any notice to vacate may be given orally or in writing by Owner/Agent to Guest, and if in writing shall be as follows: “You are hereby notified that this establishment no longer desires to entertain you as its guest, and you are requested to leave at once. To remain after receipt of this notice is a misdemeanor under the laws of this State.”
b. If any Guest who is asked to vacate early has paid in advance, Agent shall, at the time notice is given, tender to the Guest the unused portion of the advance rent and fees payment without prorating any portion of the day that Guest is noticed to vacate. Agent may retain any security deposit without further notice as agreed upon liquidated damages, consideration for the execution of this Rental Agreement and in full settlement of all claims, or Owner, at Owner’s option, may proceed at law with any damages claim.
Any Guest who remains or attempts to remain in the rental premises after being requested to vacate shall be guilty of a misdemeanor of the second degree punishable in accordance with Florida law. If any person is illegally at the subject rental premises, Owner may call upon any law enforcement officer of this State for assistance. If the Guest is arrested,
Owner shall employ all reasonable and proper means to care for any personal property which may be left at the rental premises by the guest; however, upon arrest, the
Guest/guest shall be deemed to have given up any right of occupancy and to have abandoned such rights.
12. Guest agrees that Owner and Owner’s agents shall not be liable for any loss of or damage to any personal property in or on the rental premises or stored in rooms or places provided to Guest in connection therewith, nor shall Owner or Owner’s agents or employees be liable to Guest, Guest’s family, guests, or agents for failure to repair or maintain any part of the rental premises or property contained therein absent gross negligence. Guest further agrees that neither Owner, nor Owner’s agents or employees shall be liable for any damage to the personal property of the Guest, Guest’s family, guests, or agents arising from theft, vandalism, fire, water, rain, acts of God or government, interruption of utilities, acts of others or other third party or external causes whatsoever.
13. No lifeguard is available on the premises. Guest shall use amenities, pools, beach, ocean with great care and in accordance with any posted rules. All children and elderly, frail adults using said amenities shall be constantly supervised by a responsible adult who can swim. If the amenities are equipped with any safety features such as a fence or other pool or water area barrier, a pool cover, a door latch or a door or window alarm, Guest shall be responsible for correctly operating and using said safety device every time the amenity is used. Any use of said amenities shall be at the sole risk of the user, the responsible adult supervising the user, and the Guest.
14. Guest is responsible for and shall indemnify the Owner and Owner’s agents and hold them harmless from any and all claims, liability, demands, actions, causes of action, expenses, damages, losses or injuries sustained by any person including Guest, Guest’s family, agents, guests or invitees as a result of or arising from the Guest’s subject occupancy and tenancy, including, but in no way limited to claims arising from the use of any pool, hot tub, spa-pool, water area or dock, which are part of the rental premises.
Guest shall also be liable and indemnify Owner for attorney’s fees and court costs incurred by Owner in enforcing any of the terms, covenants or conditions of this Rental
Agreement or which are sustained by Owner as a result of or arising from or during this reservation.
15. Guest may not assign this Agreement or sub-let the rental premises or any portion thereof.
16. Guest agrees that if applicable local and/or state tax rates increase after the time of reservation and before check-in that Guest will pay the additional tax due.
17. Absolutely NO SMOKING is permitted in the residence or on any balconies, patios, etc. attached to said residence unless otherwise noted in writing. Any detection of smoking in the residence will result in automatic forfeiture of the entire security deposit, plus punitive fees.

October Family Visit Very good location. Condo oven doesn't shut properly, Supplies for kitchen lacking; measuring spoons, facility need update. <br/>Maintenance crew get 5 stars for quick response and repairs. <br/>Recommend Cinnamon Beach very much but suggest another unit.

Peaceful Holiday Retreat We have been to Cinnamon Beach several times now but this is the first time in this unit. The unit was clean and neat. There were a few things that made the stay uncomfortable for us. One is the guest bedroom in the front with 2 beds were very uncomfortable. It looks like the beds use to be a bunk bed set that was taken apart. If you have only adults staying this room is not going to be comfortable. The only other issue is that at the pool, it seems that that quiet pool have become very lax. There was a group of adults drinking all day long, getting loud and had their own radio on over the pool music. Also at the pool, there were children in the quiet pool, jumping and horsing around, and finally there were children with floats and diapers and it clearly states in the rules that these are not allowed. <br/><br/>With that said, the unit was great and would refers others to this unit but only if they had kids for that 3rd bedroom.

not the same as last year Dear Owner, <br/><br/>I was a bit surprised to compare your 931 with other 2 apartments we rented as well which are 921 and 941. <br/><br/>Here what we did not like:<br/>1) The kitchen has really bad pots and pans. We actually had to go to the wallmart and purchase pots and pans as the current ones are all scratched and old. <br/>2) The master bedroom washroom has 2 issues<br/>a) bathroom door is not locking properly<br/>b) the toilet's handle and inner chain are loose, making the toilet circulation the water 24/7 making it hard to fall asleep<br/><br/>3) The balcony in the living room was missing an panels around the doors, making it look like a construction is in progress<br/><br/>4) the dishwasher had horrible stains inside, thus, leaving us with no choice but hand wash daily<br/><br/>The positive thing is the local site facilities and amenities like swimming pool, hot tubs, ocean, etc.<br/><br/>I am happy that our friends had rented other units as I have recommended this resort to them, and I would be very embarrassed if they had stayed in this unit.<br/><br/>I will be coming back to Cinnamon Beach, but not into the same unit. Too bad that the owner had stopped taking care of this apartment. Everything in this apartment is outdated (1990's) and does need some cosmetic work to get it back to normal

Reeves at Cinnamon Beach Condo was well decorated, spacious, and only a short walk to the beach. Really enjoyed the two heated swimming pools. Palm Coast is a sleepy destination, not overly commercialized, very nice Florida location to vacation. Highly recommend this unit and location. Ann Gordon made it easy to get gate access parking figured out. I can't thank her enough.

Condo a 10 the beach a 4 Condo was beautiful, clean, the deck was amazing! The condo itself was one of the best we have stayed at. The beach however is more about looking and enjoying the view than playing on. I was pretty disappointed in the beach. Rocks in the water can be seen during low tide. Even though pretty, it is not kid friendly. The sand was more of crushed seashells and would stick to you. Great place for older people not looking for an on the beach vacation. NOt much for teenagers to do.

Relaxing Family Weekend Getaway Did you have a good overall stay? <br/>Overall my family had a great time.<br/>Was the vacation rental in a great location? <br/>Location was of rental was actually steps away from the beach and pool as well as restaurants.<br/>Was the home clean and in good shape? <br/>The home was exactly as pictured and accommodated all of our needs.<br/>Was the vacation rental management staff helpful? <br/>For the minor questions that I had management available via phone or email with a quick response.

Beautiful Condo at Cinnamon Beach My family and I had a wonderful time. We had a total of 3 condos and they were all very clean with everything we needed for our stay. The view of the lake was beautiful and very relaxing. We had a very good time at the beach and also the pools. The Staff at the pool was excellent especially our waitress Michelle. I Would highly recommend Cinnamon Beach to other family members and friends.

Good Condo was clean and great location. Only a couple is issues, the owners had several locked closets including the pantry. The other issue is that we had very loud guests above us. However, after 2 calls/visits from Security, things got better.

Blanton family Vacation Our overall stay was great at the condo and area that we stayed. The view from the deck was nice over looking the water. One of the bathrooms shower looked as though had not been cleaned and a bedroom door would not close all the way.With three families staying the door and bathroom situation should have been fixed while we were there. Reported it and just received an email saying that the maintenance, house keeping and management worked together on issues. I wasn't satisfied with just that email. Housekeeper should have been sent to clean the bathroom that wasn't cleaned well. Other than that, our family our family was pleased!

Palm Coast Paradise Unit 931 was a spacious 3 bedroom 3 bath Unit with all the amentities needed to feel comfortable and relaxed. This unit was close to the beach and to the pools. We faced the pond tand thoroughly enjoyed watching the turtles and otters each morning. We love Palm Coast but our experience is made better by using Cinnamon Beach Vacations.

Family Getaway at Cinnamon Beach Spent a week in Unit 931 with 8 adults and a baby....great location because it was close to the beach and close to the pools. It was very spacious. The MB and bath were huge. It also had a very large balcony with plenty of furniture that overlooked the lake so had a beautiful view. There was ample parking close to the building. We had a great week and loved the condo overall. A few negatives were one of the love seats had a broken leg that had been repaired but broke again during our stay. The kitchen was well-stocked but the cooking knives were dull and one had a broken handle.

Great resort, but not the best condo This was our 4th year at this resort and this was our least favorite condo. The molding around the sliding patio door was missing, along with the crown molding. We learned after a heavy rain the reason why the molding was off. There was leak coming from the condo above. Maintenance was called and pictures were sent. I guess they fixed it after our stay. One of the chairs on the patio had 2 broken legs. The carpet needs stretching at the living room and master bedroom. They had the pantry door locked, so was not able to put our food in the pantry. The wifi was AWFUL! Whole family was unhappy with this condo.

SOME PROS AND CONS uNIT 931 is the fifth Unit we have stayed in at Cinnamon Beach over the past 5 years.<br/><br/>It is the LARGEST one so far......3 bedrooms and 3 bathrooms.<br/><br/>We rented through Cinnamon Beach Vacations. (In previous years we have rented through Vacation Rental Pros but were able to get this LARGER Unit at a much better rate through Cinnamon Beach Vacations than we would have paid for a SMALLER 3 bedroom, TWO bathroom Unit through Vacation Rental Pros.) <br/><br/>PROS and CONS of Unit 931:<br/><br/>PROS - L A R G E unit.......3 bathrooms........huge balcony.......obliging Owner who allowed us to bring our small (15lb) non-shedding dog if we paid a $250 non-refundable Cleaning Deposit. FREE LONG DISTANCE phone calls to anywhere in USA or CANADA.........FREE HI-SPEED INTERNET. Crystal, the Property Manager was a pleasure to deal with and VERY helpful.<br/><br/>CONS - some what sparsely decorated (as opposed to other Units we have rented)........needs a paint job inside..........there splotches of primer paint all over the walls throughout the Unit as if someone had started to paint some time in the past but never got around to finishing the job.........bedding and draperies need replacing.......carpet needs a good cleaning........clothes dryer sounds like it is 'on its last legs'. Patio Furniture on Balcony starting to deteriorate........could use a larger flat-screen HDTV in Living Room.......much of the Unit is dark to the extent that we had to leave lights on all day.

I wish I never had to leave We spent a week here and it was fantastic. The proximity to the beach was awesome, and the pool was perfect for the kids. We had to stay two nights in Orlando after we left you're place. I literally burst into tears when we opened the door to our new hotel room. It was so dark and dingy and depressing. Out entire family already plans to cine back in another year or two. Thank you so much for an unforgettable vacation.

Fun in the Sun!! My 7 best girlfriends and I had a great time at this condo. We spent the entire weekend on the beach and by the pool and the accommodations were perfect for all 8 of us!

#931 @ 1000 Cinnamon Beach Way Condo was very large and roomy. Close to the pool and walkway to the beach. Quiet location on the lake. Upon arrival at the unit my daughter had to remove multiple insects from 4 of the window sills and the light fixture over the dining room table was covered in cob webs. Unit was a NO SMOKING and there was cigarette butts on the porch. Did not have enough dishes, cooking utensils or cookware for the stay. White towels in the unit needed to be bleached. Disturbed that instructions state upon leaving the unit that you remove the sheets and leave the spread and blankets. Appears that the spreads are not cleaned on a regular basis.

Great getaway Cinnamon Beach is ideal for my getaway month from our cold, dreary winter in Rochester. The condos are exceptionally spacious with plenty of space for visitors. This year we were on the pond rather than the ocean and we loved it, enjoying the afternoon sun and beautiful sunsets sitting on the balcony. There were a few things that needed attention when we got there.The property management team was super responsive, correcting everything.

Great Vacation! We had a week long vacation and every day was great! We even had guests come visit us on short notice and the property manager helped get the guests added and in the gate quickly. This is our second year staying here and it will be our yearly retreat. Quiet, clean, beautiful.

Our overall stay was great at the condo and area that we stayed. The view from the deck was nice over looking the water. One of the bathrooms shower looked as though had not been cleaned and a bedroom door would not close all the way.With three families staying the door and bathroom situation should have been fixed while we were there. Reported it and just received an email saying that the maintenance, house keeping and management worked together on issues. I wasn't satisfied with just that email. Housekeeper should have been sent to clean the bathroom that wasn't cleaned well. Other than that, our family our family was pleased!

Condo was clean and great location. Only a couple is issues, the owners had several locked closets including the pantry. The other issue is that we had very loud guests above us. However, after 2 calls/visits from Security, things got better.

Unit 931 was a spacious 3 bedroom 3 bath Unit with all the amentities needed to feel comfortable and relaxed. This unit was close to the beach and to the pools. We faced the pond tand thoroughly enjoyed watching the turtles and otters each morning. We love Palm Coast but our experience is made better by using Cinnamon Beach Vacations.

My family and I had a wonderful time. We had a total of 3 condos and they were all very clean with everything we needed for our stay. The view of the lake was beautiful and very relaxing. We had a very good time at the beach and also the pools. The Staff at the pool was excellent especially our waitress Michelle. I Would highly recommend Cinnamon Beach to other family members and friends.

uNIT 931 is the fifth Unit we have stayed in at Cinnamon Beach over the past 5 years.<br/><br/>It is the LARGEST one so far......3 bedrooms and 3 bathrooms.<br/><br/>We rented through Cinnamon Beach Vacations. (In previous years we have rented through Vacation Rental Pros but were able to get this LARGER Unit at a much better rate through Cinnamon Beach Vacations than we would have paid for a SMALLER 3 bedroom, TWO bathroom Unit through Vacation Rental Pros.) <br/><br/>PROS and CONS of Unit 931:<br/><br/>PROS - L A R G E unit.......3 bathrooms........huge balcony.......obliging Owner who allowed us to bring our small (15lb) non-shedding dog if we paid a $250 non-refundable Cleaning Deposit. FREE LONG DISTANCE phone calls to anywhere in USA or CANADA.........FREE HI-SPEED INTERNET. We spent a week here and it was fantastic. The proximity to the beach was awesome, and the pool was perfect for the kids. We had to stay two nights in Orlando after we left you're place. I literally burst into tears when we opened the door to our new hotel room. It was so dark and dingy and depressing. Out entire family already plans to cine back in another year or two. Thank you so much for an unforgettable vacation.
