Terms

PAYMENT: Deposit is due at the time of reservation. Fifty percent (50%) of the total rent, taxes, and fees shall be paid and received by Agent in the form of a credit card personal check, certified, cashier or bank check or money order within 7 days after the reservation is made, and the balance of rent, taxes, fees and any unpaid security deposit shall be paid and received by Agent no later than thirty (30) days prior to check-in. The security deposit, rent, taxes, and fees may be paid by personal check conditioned upon Agent’s receipt of same more than thirty (30) days before the above-stated check-in date. A valid credit card must be provided no less than seven (7) days prior to check-in whether or not the reservation is paid for by credit card. The credit card will be charged in the event that damages, missing items or excessive use of utilities are not covered by the Guest’s security deposit.
UTILITIES: Utilities are included in the rental amount unless other wise stated, however Agent reserves the right at Agent’s sole discretion to charge Guest for excessive use of utilities if it is determined Guest used any or all of the provided utilities in an abusive or negligent manner. Guest agrees that all excessive use charges will be charged to Guest’s credit card on file and/or withheld from Guest’s security deposit. Guest shall pay cost of all utilities on rentals of more than 30 days unless otherwise stated.
Time is of the essence as to payment pursuant to this Rental Agreement, and any late payments shall, at the sole option of Agent, cause a forfeiture of Guest’s rights pursuant to this Agreement and immediate cancellation of same without further notice to Guest.
CANCELLATIONS: Reservations may be cancelled by Guest with notice to Agent within seven (7) days of the date of the reservation call, and more than thirty (30) days before check-in and any deposit received by Agent shall be refunded to Guest minus a $50.00 administration fee. After seven (7) days from the date of the reservation call, or less than thirty (30) days before check-in, any deposits, rent and fees paid shall become non-refundable if the reservation is cancelled by Guest. In the event of an emergency, Agent reserves the right at Agent’s discretion, to refund on a case by case basis only, part of any deposit, rent or fees paid, minus an administrative fee, upon notice of cancellation by Guest. Any deposit, rent or fees retained by
Agent pursuant to this provision shall be agreed upon liquidated damages, consideration for the execution of this Rental Agreement and in full settlement of all claims.
THIRD: GUEST COVENANTS AND CONDITIONS:
The parties agree that the following are material covenants and conditions of this Rental
Agreement, the breach of which shall result in immediate forfeiture by the Guest of the subject rental premises in accordance with applicable law:
1. Guest shall not damage the rental premises or any part thereof or any personal property or appurtenance therein or thereto, and if the premises, or any part thereof, or any personal property or appurtenance thereto are damaged, obstructed or rendered inoperable by the misuse or negligence of Guest, Guest’s guests, family, agents or employees, Guest shall pay the cost for repair or replacement of same immediately upon presentation by Agent of a bill for same.
2. Guest shall comply with all applicable federal, state, and county local laws, and community rules, regulations, covenants and ordinances including, but not limited to Flagler County, Florida, and the community in which the Guest is staying.
3. Guest agrees not to commit waste or to use the rental premises or any appliances or appurtenances thereof or thereto for any disorderly or unlawful or offensive purpose.
4. Guest shall permit only the people list in Addendum A, incorporated into this agreement by reference, to use and occupy the subject rental premises.
5. No pets are allowed in or around the rental premises at any time, unless specifically permitted by Owner and applicable pet fees are paid at the time this Rental Agreement is executed.
Vehicles identified in Addendum B, not to exceed two (2) vehicles and may be parked on the premises in approved parking places.
Any vehicles not identified in Addendum B shall be towed or removed from the premises at Guest’s expense.
7. In the event the premises become uninhabitable, due to damage from wind, fire, rain, storm surge, or any other cause, and the Owner, at his sole discretion, shall decide not to repair or rebuild the premises, the term of this lease shall end and rent will be prorated up to the time of the damage.
8. Guest agrees not to charge any long distance telephone calls or other charges to the telephone account(s) located at the rental premises. Local calls are permitted.
9. RADON DISCLOSURE: Pursuant to §404.056(8), Florida Statutes, Radon is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time.
Levels of radon that exceed Federal and State guidelines have been found in buildings in
Florida. Additional information regarding radon and radon testing may be obtained from your public health unit.
10. Guest agrees to permit Owner or Owner’s agents to enter the rental premises or any part thereof at any reasonable time for the purpose of examining same, to make necessary repairs, and/or to protect any personal property from damage. Reasonable time for said entry, without further notice to Guest, shall be between the hours of 9:00 a.m. and 5:00 although the parties may agree to additional hours for Owner’s access.
Owner or Owner’s Agent may also enter the rental premises with the consent of Guest, or when necessary in case of an emergency or when the Guest unreasonably withholds consent or access.
11. a. Guest acknowledges and agrees that Owner/Agent may remove or cause to be removed from the rental premises any Guest or guest who, while at the rental premises, illegally possesses or deals in controlled substances, violates any of the terms of this
Rental Agreement, is intoxicated, profane, lewd or brawling, who indulges in any language or conduct which disturbs the peace and comfort of other guests or neighbors, or which constitutes a nuisance, or which injures the reputation, dignity or standing of the
rental premises, or anyone who fails to make payment of rent at the agreed-upon rental rate and fees at the agreed-upon times, or anyone who fails to check-out at the agreed upon time unless an extension of time is expressly agreed to by the Agent and the Guest prior to check out. Admission to and removal from the rental property is not and shall not be based upon race, creed, color, sex, physical disability or national origin. Any notice to vacate may be given orally or in writing by Owner/Agent to Guest, and if in writing shall be as follows: “You are hereby notified that this establishment no longer desires to entertain you as its guest, and you are requested to leave at once. To remain after receipt of this notice is a misdemeanor under the laws of this State.”
b. If any Guest who is asked to vacate early has paid in advance, Agent shall, at the time notice is given, tender to the Guest the unused portion of the advance rent and fees payment without prorating any portion of the day that Guest is noticed to vacate. Agent may retain any security deposit without further notice as agreed upon liquidated damages, consideration for the execution of this Rental Agreement and in full settlement of all claims, or Owner, at Owner’s option, may proceed at law with any damages claim.
Any Guest who remains or attempts to remain in the rental premises after being requested to vacate shall be guilty of a misdemeanor of the second degree punishable in accordance with Florida law. If any person is illegally at the subject rental premises, Owner may call upon any law enforcement officer of this State for assistance. If the Guest is arrested,
Owner shall employ all reasonable and proper means to care for any personal property which may be left at the rental premises by the guest; however, upon arrest, the
Guest/guest shall be deemed to have given up any right of occupancy and to have abandoned such rights.
12. Guest agrees that Owner and Owner’s agents shall not be liable for any loss of or damage to any personal property in or on the rental premises or stored in rooms or places provided to Guest in connection therewith, nor shall Owner or Owner’s agents or employees be liable to Guest, Guest’s family, guests, or agents for failure to repair or maintain any part of the rental premises or property contained therein absent gross negligence. Guest further agrees that neither Owner, nor Owner’s agents or employees shall be liable for any damage to the personal property of the Guest, Guest’s family, guests, or agents arising from theft, vandalism, fire, water, rain, acts of God or government, interruption of utilities, acts of others or other third party or external causes whatsoever.
13. No lifeguard is available on the premises. Guest shall use amenities, pools, beach, ocean with great care and in accordance with any posted rules. All children and elderly, frail adults using said amenities shall be constantly supervised by a responsible adult who can swim. If the amenities are equipped with any safety features such as a fence or other pool or water area barrier, a pool cover, a door latch or a door or window alarm, Guest shall be responsible for correctly operating and using said safety device every time the amenity is used. Any use of said amenities shall be at the sole risk of the user, the responsible adult supervising the user, and the Guest.
14. Guest is responsible for and shall indemnify the Owner and Owner’s agents and hold them harmless from any and all claims, liability, demands, actions, causes of action, expenses, damages, losses or injuries sustained by any person including Guest, Guest’s family, agents, guests or invitees as a result of or arising from the Guest’s subject occupancy and tenancy, including, but in no way limited to claims arising from the use of any pool, hot tub, spa-pool, water area or dock, which are part of the rental premises.
Guest shall also be liable and indemnify Owner for attorney’s fees and court costs incurred by Owner in enforcing any of the terms, covenants or conditions of this Rental
Agreement or which are sustained by Owner as a result of or arising from or during this reservation.
15. Guest may not assign this Agreement or sub-let the rental premises or any portion thereof.
16. Guest agrees that if applicable local and/or state tax rates increase after the time of reservation and before check-in that Guest will pay the additional tax due.
17. Absolutely NO SMOKING is permitted in the residence or on any balconies, patios, etc. attached to said residence unless otherwise noted in writing. Any detection of smoking in the residence will result in automatic forfeiture of the entire security deposit, plus punitive fees.

A Christmas Vacation The mgmt. company was very responsive to any questions we had. The property location is very good. It has excellent ocean and golf hole views.<br/><br/>Our primary concerns were with the maintenance and cleaning. Shower heads in two bathrooms need to be replaced. Electrical outlet cover place is partially missing in twin bed room. Vacuum in twin bedroom tripped circuit breaker every time we tried <br/>to turn it on. ( Both items are safety hazards) Ants were a problem in one of the bathrooms. Dishes were put away dirty and rugs were gritty from the minute we walked in. Also, the sliding glass door to the deck is almost impossible to open and close. <br/><br/>Some much needed maintenance, pest control and closer inspection of the cleaners work, by the owner, would result in a much higher rating for this property. <br/><br/>While I said I would not recommend this property below, if it is maintained to a reasonable standard I would recommend it.

Vacation The experience that I had with my family was one of the best that I ever had in Florida. The place is clean , private and safe environment. Definitely will come back.

Fall Break Enjoyed every bit of Ocean Hammock community and #341 Cinnamon Beach. The condo views are spectacular, clean and lots of room, close proximity to the beach, pools and hot tubs. Quiet but easy drive to restaurants. Great vacation!!

Beautiful Beach The beach was beautiful. We will definitely be back, but not in the same condo. The people staying above us sounded like they were rearranging the entire condo at 3am every night. It would go on for hours. We let management know, but nothing came of it.

Amazing Girl's weekend getaway! My friends and I plan a girl's trip every year and had an extremely memorable experience at this property in Cinnamon Beach. There were five of us and we had plenty of space and a beautiful view of the ocean every day. Very short walk to the beach and pool/restaurant. Couldn't have asked for anything better and will be returning!

400 Cinnamon Beach Unit 341 Unit was perfect for our needs, 3 bathrooms with 6 people was a blessing. Great view of golf course and ocean. The sliders are very hard to open and several light bulbs were out. Maintenance guy was great fixed all light bulbs 30 mins after we called but slider is what it is, hard to close! The only negative we had was the amount of time required to get in the initial gate. One lane to enter if a guest, sometimes we waited 30 min. The golf course is private would be nice if Cinnamon Beach could work out a deal for guests to be able to play it. Over all a great week! Also anyone traveling from unit across intra-coastal there is a $2 fee everytime to get back across and they do not accept sunpass.

Great stay for our family The description of the unit was accurate. The place was very clean and well maintained. Very nice views of the golf course and the ocean in the background. The unit had plenty of room for our family of 8. Very nice sized patio to watch golfers and stare at the ocean. kitchen is great sized with eat in area and a formal dining room. Unit was everything we expected and more. management company was responsive when we needed something and very accommodating.

Great location and great view Our experience in renting this unit was very smooth and without any flaws. The unit had a great view. The beach access was very close. We found the unit to be very clean and comfortable. The kitchen utencils were also in great shape, newer pots and pans.<br/>Scott was an enormous help. He was very responsive and prompt with paperwork.<br/>We had no issues with this unit.

Really great spot Beautiful spot and condo with an excellent view from large balcony. Very clean and comfortable. You can't go wrong with this property. They do not provide more than one roll of TP, one paper towel roll and one garbage bag so pack yours. Rocks in the water off the quiet pool are sharp so if you have kids, just hit the close sandy beach. Property does not give you access to Ocean Hammock facilities. Pool is strict about no drinks or food. Coffee, sugar, salt and pepper in the cabinets - nothing else yet.

FANTASTIC - would highly recommend The condo was SUPER clean, gorgeous views, the space was perfect for our family. We would most definitely recommend this condo and Cinnamon beach. It was the best vacation we ever had - we loved that it is in a gated community. There is a kids pool and an adult pool - white sandy beach, just fantastic. We had no complaints at all.

Mother's Day Getaway The whole family had a great time during our stay. We were centrally located between St. Augustine and Flagler Beach. We loved St. Augustine. Enjoyed great food at Harry's and A1A Ale House in St. Augustine and Flagler Fish Company and Funky Pelican in Flagler Beach.

Unit 341 This is our 3rd stay on Cinnamon Beach and 400 Cinnamon Beach Way- Unit 341 has been by far our favorite. The unit was very nicely decorated, welcoming but not crowded. The unit was very clean and well provisioned with kitchen ware and utensils. The unit had a very large balcony and although not beachfront, had a lovely beach view. Parking was more than adequate and the unit was only a very short walk to one of several beach walkways.

Wonderful Palm Coast vacation! We had a wonderful vacation at Cinnamon Beach. The unit was very clean with a beautiful view. Our only issue with the unit was that the sliding glass door was very difficult to open. Our 12 year old couldn't do it on his own. The community facilities were very nice and the beach was pristine. The management company was very helpful and professional. We had a fabulous time. My husband and daughter were able to secure a guest tee time at the resort golf course and they said it was a gorgeous course to play! The pool restaurant staff were very nice and helpful as well. Other places we visited... Captains BBQ Bait and Tackle has some of the best BBQ we have ever had. Marineland was awesome and we got to see a newborn dolphin. Of course, lots to do in St Augustine. We are planning to come back next year. Just need a sliding door that opens. :-)

First Family vacation with children, teens, adults & grandparents With all there is to do at cinnamon beach the best was spending days on the beach doing nothing. Kids loved The activity center and the children's pool area. <br/> Fireworks on the beach and in other areas viewable from the amazing deck area were a hit with the whole family.

Fantastic Time with a Family of 19 Overall, my family was pleased with our stay at Cinnamon Beach. We rented a couple of condos and they were clean and well equipped. The community is excellent for riding bikes, running or other activities. Although our condo was clean, three of the dinning room table chairs were broken and we could not use the chairs which presented a problem when we would gather for dinner. Also, the beach and pool areas had no life guards, I think this is not safe or encouraging for families. I would like to see a life guard at a minimum on the beach for the stretch of beach that is for the private community. Also, the elevator had no circulation or air and it was extremely hot and humid. Other than the couple of things noted above, the stay was really good. My family and I plan to return next year and I hope to feel air circulation in the elevator and life guards on the beach.<br/><br/>Mary D

Always love this place Our family has stayed here numerous times over the past several years and we always enjoy it. The beach is not as populous as Daytona Beach, PCB or even Destin which is very nice. You are very close to St. Augustine and Daytona if you want a little bit more hustle and bustle for a day or two. It was a great time.

Exceeded expectations! We thoroughly enjoyed our stay at Cinnamon beach. The condo was spacious, clean and nicely decorated. The pool and anenties were very nice. Our only suggestion for the unit we stayed in is it needs black out curtains or blinds in bedrooms.

Great Vacation! We planned this vacation at the last minute and the owner of the condo and property management company were fantastic to deal with and made the process seamless. The condo exceeded our expectations. It was clean, extremely spacious and the view was absolutely breath taking. We enjoyed our meals outside on the balcony and couldn't believe how lucky we were to have that view and hear the ocean. The ocean was beautiful and clean and we also enjoyed the pools and the views. We would definitely return to this condo.

Beautiful apartment and view The condominium was beautiful and spacious, security was efficient, information for departure was clear and displayed in multiple spots. It was well stocked for linens and cooking but had only 1/4 roll of toilet paper in one bath and 1/2 rolls in other baths for 5 guests - we had to purchase more. It took some time to find the pool which was lovely but children were jumping and adults swimming laps so it was not as "quiet" as it was titled. Great stay and beautiful condo.

341 Cinnamon Beach - Great Condo!! First time to the area. Condo was immaculate with plenty of room for the entire family. Could have been better communication with the property manager - felt like I had to chase down information at times. The vacation turned out great and location was centralized for a number of day trips we made while we were in Florida.

Cinnamon Beach Adams Great find. We've always stayed in St. Augustine when comign to teh east coast but were looking for something a little nicer and newer this time. I wish there were a way to package stays at Cinnamon Beach Condos with a golf package at the course in Ocean hammock.

Great But. With all the water and places to fish, I would expect accomidations for boats. A small fenced in area to store a boat.

Cinnamon Way Condo Stay The Condo was very spacious and quiet. The beach was great, pools were very nice. Only negative in the location was the city of Palm Coast decided to place a toll booth to charge $2 every time you drive across the causeway to area shops and restaurants. Otherwise was a great stay.

With all there is to do at cinnamon beach the best was spending days on the beach doing nothing. Kids loved The activity center and the children's pool area. <br/> Fireworks on the beach and in other areas viewable from the amazing deck area were a hit with the whole family.

We had a wonderful vacation at Cinnamon Beach. The unit was very clean with a beautiful view. Our only issue with the unit was that the sliding glass door was very difficult to open. Our 12 year old couldn't do it on his own. The community facilities were very nice and the beach was pristine. The management company was very helpful and professional. We had a fabulous time. My husband and daughter were able to secure a guest tee time at the resort golf course and they said it was a gorgeous course to play! The pool restaurant staff were very nice and helpful as well. Other places we visited... Captains BBQ Bait and Tackle has some of the best BBQ we have ever had. Marineland was awesome and we got to see a newborn dolphin. Of course, lots to do in St Augustine. We are planning to come back next year. Just need a sliding door that opens. :-)

This is our 3rd stay on Cinnamon Beach and 400 Cinnamon Beach Way- Unit 341 has been by far our favorite. The unit was very nicely decorated, welcoming but not crowded. The unit was very clean and well provisioned with kitchen ware and utensils. The unit had a very large balcony and although not beachfront, had a lovely beach view. Parking was more than adequate and the unit was only a very short walk to one of several beach walkways.

My family and I couldn't have asked for a better place to vacation, plenty of room for everyone to have their own space, yet cozy enough to enjoy family dinners every evening. We will be back!

The whole family had a great time during our stay. We were centrally located between St. Augustine and Flagler Beach. We loved St. Augustine. Enjoyed great food at Harry's and A1A Ale House in St. Augustine and Flagler Fish Company and Funky Pelican in Flagler Beach.

Beautiful spot and condo with an excellent view from large balcony. Very clean and comfortable. You can't go wrong with this property. They do not provide more than one roll of TP, one paper towel roll and one garbage bag so pack yours. Rocks in the water off the quiet pool are sharp so if you have kids, just hit the close sandy beach. Property does not give you access to Ocean Hammock facilities. Pool is strict about no drinks or food. Coffee, sugar, salt and pepper in the cabinets - nothing else yet.

The balcony runs the entire length of Cinnamon Beach 341, then turns a corner and expands your view. Make it the place you both begin and end your day, with spectacular sunrises and starry nights. The warm, soft sea air has soothing properties, while the murmur of the surf (just yards away!) lulls you. You can't help but feel on top of the world when you're cozied up on this balcony.

With the brand new boardwalk within a 30 second walk from this unit you will have your toes in the sand in no time.


When you must go indoors, you're immediately rewarded by the sight of our open-plan living and dining area. With tiled floors (cool on those hot "beach feet"!), the living room invites you to collapse and enjoy your favorite movies and music with the whole family.
