Terms

PAYMENT: Deposit is due at the time of reservation. Fifty percent (50%) of the total rent, taxes, and fees shall be paid and received by Agent in the form of a credit card personal check, certified, cashier or bank check or money order within 7 days after the reservation is made, and the balance of rent, taxes, fees and any unpaid security deposit shall be paid and received by Agent no later than thirty (30) days prior to check-in. The security deposit, rent, taxes, and fees may be paid by personal check conditioned upon Agent’s receipt of same more than thirty (30) days before the above-stated check-in date. A valid credit card must be provided no less than seven (7) days prior to check-in whether or not the reservation is paid for by credit card. The credit card will be charged in the event that damages, missing items or excessive use of utilities are not covered by the Guest’s security deposit.
UTILITIES: Utilities are included in the rental amount unless other wise stated, however Agent reserves the right at Agent’s sole discretion to charge Guest for excessive use of utilities if it is determined Guest used any or all of the provided utilities in an abusive or negligent manner. Guest agrees that all excessive use charges will be charged to Guest’s credit card on file and/or withheld from Guest’s security deposit. Guest shall pay cost of all utilities on rentals of more than 30 days unless otherwise stated.
Time is of the essence as to payment pursuant to this Rental Agreement, and any late payments shall, at the sole option of Agent, cause a forfeiture of Guest’s rights pursuant to this Agreement and immediate cancellation of same without further notice to Guest.
CANCELLATIONS: Reservations may be cancelled by Guest with notice to Agent within seven (7) days of the date of the reservation call, and more than thirty (30) days before check-in and any deposit received by Agent shall be refunded to Guest minus a $50.00 administration fee. After seven (7) days from the date of the reservation call, or less than thirty (30) days before check-in, any deposits, rent and fees paid shall become non-refundable if the reservation is cancelled by Guest. In the event of an emergency, Agent reserves the right at Agent’s discretion, to refund on a case by case basis only, part of any deposit, rent or fees paid, minus an administrative fee, upon notice of cancellation by Guest. Any deposit, rent or fees retained by
Agent pursuant to this provision shall be agreed upon liquidated damages, consideration for the execution of this Rental Agreement and in full settlement of all claims.
THIRD: GUEST COVENANTS AND CONDITIONS:
The parties agree that the following are material covenants and conditions of this Rental
Agreement, the breach of which shall result in immediate forfeiture by the Guest of the subject rental premises in accordance with applicable law:
1. Guest shall not damage the rental premises or any part thereof or any personal property or appurtenance therein or thereto, and if the premises, or any part thereof, or any personal property or appurtenance thereto are damaged, obstructed or rendered inoperable by the misuse or negligence of Guest, Guest’s guests, family, agents or employees, Guest shall pay the cost for repair or replacement of same immediately upon presentation by Agent of a bill for same.
2. Guest shall comply with all applicable federal, state, and county local laws, and community rules, regulations, covenants and ordinances including, but not limited to Flagler County, Florida, and the community in which the Guest is staying.
3. Guest agrees not to commit waste or to use the rental premises or any appliances or appurtenances thereof or thereto for any disorderly or unlawful or offensive purpose.
4. Guest shall permit only the people list in Addendum A, incorporated into this agreement by reference, to use and occupy the subject rental premises.
5. No pets are allowed in or around the rental premises at any time, unless specifically permitted by Owner and applicable pet fees are paid at the time this Rental Agreement is executed.
Vehicles identified in Addendum B, not to exceed two (2) vehicles and may be parked on the premises in approved parking places.
Any vehicles not identified in Addendum B shall be towed or removed from the premises at Guest’s expense.
7. In the event the premises become uninhabitable, due to damage from wind, fire, rain, storm surge, or any other cause, and the Owner, at his sole discretion, shall decide not to repair or rebuild the premises, the term of this lease shall end and rent will be prorated up to the time of the damage.
8. Guest agrees not to charge any long distance telephone calls or other charges to the telephone account(s) located at the rental premises. Local calls are permitted.
9. RADON DISCLOSURE: Pursuant to §404.056(8), Florida Statutes, Radon is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time.
Levels of radon that exceed Federal and State guidelines have been found in buildings in
Florida. Additional information regarding radon and radon testing may be obtained from your public health unit.
10. Guest agrees to permit Owner or Owner’s agents to enter the rental premises or any part thereof at any reasonable time for the purpose of examining same, to make necessary repairs, and/or to protect any personal property from damage. Reasonable time for said entry, without further notice to Guest, shall be between the hours of 9:00 a.m. and 5:00 although the parties may agree to additional hours for Owner’s access.
Owner or Owner’s Agent may also enter the rental premises with the consent of Guest, or when necessary in case of an emergency or when the Guest unreasonably withholds consent or access.
11. a. Guest acknowledges and agrees that Owner/Agent may remove or cause to be removed from the rental premises any Guest or guest who, while at the rental premises, illegally possesses or deals in controlled substances, violates any of the terms of this
Rental Agreement, is intoxicated, profane, lewd or brawling, who indulges in any language or conduct which disturbs the peace and comfort of other guests or neighbors, or which constitutes a nuisance, or which injures the reputation, dignity or standing of the
rental premises, or anyone who fails to make payment of rent at the agreed-upon rental rate and fees at the agreed-upon times, or anyone who fails to check-out at the agreed upon time unless an extension of time is expressly agreed to by the Agent and the Guest prior to check out. Admission to and removal from the rental property is not and shall not be based upon race, creed, color, sex, physical disability or national origin. Any notice to vacate may be given orally or in writing by Owner/Agent to Guest, and if in writing shall be as follows: “You are hereby notified that this establishment no longer desires to entertain you as its guest, and you are requested to leave at once. To remain after receipt of this notice is a misdemeanor under the laws of this State.”
b. If any Guest who is asked to vacate early has paid in advance, Agent shall, at the time notice is given, tender to the Guest the unused portion of the advance rent and fees payment without prorating any portion of the day that Guest is noticed to vacate. Agent may retain any security deposit without further notice as agreed upon liquidated damages, consideration for the execution of this Rental Agreement and in full settlement of all claims, or Owner, at Owner’s option, may proceed at law with any damages claim.
Any Guest who remains or attempts to remain in the rental premises after being requested to vacate shall be guilty of a misdemeanor of the second degree punishable in accordance with Florida law. If any person is illegally at the subject rental premises, Owner may call upon any law enforcement officer of this State for assistance. If the Guest is arrested,
Owner shall employ all reasonable and proper means to care for any personal property which may be left at the rental premises by the guest; however, upon arrest, the
Guest/guest shall be deemed to have given up any right of occupancy and to have abandoned such rights.
12. Guest agrees that Owner and Owner’s agents shall not be liable for any loss of or damage to any personal property in or on the rental premises or stored in rooms or places provided to Guest in connection therewith, nor shall Owner or Owner’s agents or employees be liable to Guest, Guest’s family, guests, or agents for failure to repair or maintain any part of the rental premises or property contained therein absent gross negligence. Guest further agrees that neither Owner, nor Owner’s agents or employees shall be liable for any damage to the personal property of the Guest, Guest’s family, guests, or agents arising from theft, vandalism, fire, water, rain, acts of God or government, interruption of utilities, acts of others or other third party or external causes whatsoever.
13. No lifeguard is available on the premises. Guest shall use amenities, pools, beach, ocean with great care and in accordance with any posted rules. All children and elderly, frail adults using said amenities shall be constantly supervised by a responsible adult who can swim. If the amenities are equipped with any safety features such as a fence or other pool or water area barrier, a pool cover, a door latch or a door or window alarm, Guest shall be responsible for correctly operating and using said safety device every time the amenity is used. Any use of said amenities shall be at the sole risk of the user, the responsible adult supervising the user, and the Guest.
14. Guest is responsible for and shall indemnify the Owner and Owner’s agents and hold them harmless from any and all claims, liability, demands, actions, causes of action, expenses, damages, losses or injuries sustained by any person including Guest, Guest’s family, agents, guests or invitees as a result of or arising from the Guest’s subject occupancy and tenancy, including, but in no way limited to claims arising from the use of any pool, hot tub, spa-pool, water area or dock, which are part of the rental premises.
Guest shall also be liable and indemnify Owner for attorney’s fees and court costs incurred by Owner in enforcing any of the terms, covenants or conditions of this Rental
Agreement or which are sustained by Owner as a result of or arising from or during this reservation.
15. Guest may not assign this Agreement or sub-let the rental premises or any portion thereof.
16. Guest agrees that if applicable local and/or state tax rates increase after the time of reservation and before check-in that Guest will pay the additional tax due.
17. Absolutely NO SMOKING is permitted in the residence or on any balconies, patios, etc. attached to said residence unless otherwise noted in writing. Any detection of smoking in the residence will result in automatic forfeiture of the entire security deposit, plus punitive fees.

View Cannot Be Beat, but Not All Was Up to Par The location, the view and the lovely beach made our stay a dream come true, but (sadly) for the price we paid, other elements of our stay did not live up to our expectations.<br/><br/>We found the kitchen to be poorly stocked, with what looked like discarded items from a garage sale filling the cabinets. Our first shock was the discovery of dried on food on ALL of the plates in the cupboard, requiring us to do a complete dish washing of all culinary and dishware before using anything. Knowing that we were paying an extra "cleaning fee" made it more than insulting to have to begin to clean before we could feel comfortable preparing food in our kitchen! To make matters worse, our party of six had only four coffee mugs on hand.<br/> <br/>Various other items in the unit was either in need of upgrade, or was not working (the lock mechanism on the front power in the outlets on the balcony...). Overall, the unit was in need of a overhaul. <br/><br/>Just as we have experienced during our prior stays at Cinnamon Beach via the management company, we find the information demanded (names/ages/driver's license numbers/SS numbers) for guests to be excessively intrusive. The expectation that NO other individuals will spend any time in the rental unit during the stay is also absurd, especially if other family members are staying on site, or live in the area. I understand that some folks may have abused the system in the past does not mean that it is wise to treat each guest with such suspicion. <br/><br/>Sorry to be so negative about these issues, but for $400 a night, I expect better.

Great View, Great Beach, Great Condo! The condo was clean and everything was functioning. The furniture was all comfortable and accommodating. The view from the balcony is amazing. So close to the beach.

Beach review.... This is a great property with the best views ever! The unit was well stocked and everything was clean. The unit was very spacious. Our only concern was with the tiny mites we found when my grandson dropped a candy wrapper on the floor! The furnishings are nice but slightly worn. Starting to be in need of better beds. Overall it was a good space for the value. No close activities for swimming or entertainment for kids.

Spring Break This is our 7th year visiting Cinnamon Beach. The resort iis amazing. We love the pools, beach, and other amenities. Unfortunately , this year was a disappointment as our condo was in bad shape. This is the first year we stayed in a place like this. Condo had an order that smelled like mildew (had to wash all of our clothes twice to get smell out when we came home), carpets were stained, furniture was beat up, and I had to buy new pillows at Walmart for everyone to use as they were so dirty / flat. Those are just a few to list. We will be returning to the resort again but will not be staying in this unit ever again. We invited a few other families to Cinnamon Beach with us and I happy they had beautiful units as we saw each one of them. I would of been sad if there units gave a bad impression of the resort. The sun was out all week so we stayed outside as much as possible. No problem with management or resort just not a fan of this unit.

Cinnamon Beach annual visit . Unit 453 has a great view but needs updates to several areas , screen door to porch was rusted and difficult to open and shut , lamp in master beadroom was broken , several lights had burnt out bulbs and the bed in master did not even have a bedspread on it just white sheets which was just weird , the furniture in living area was somewhat worn and needs upgrade along with carpet .The general cleanliness was pretty good and the unit could really be nice with some minor fixable upgrades. I would rent again if some of these issues could be resolved. This area is perfect for a quiet vacation with a nice private beach and plenty of areas to visit.

Great trip! Very happy with our short vacation to Cinnamon Beach. The condo was exactly as described. Beautiful views of both the golf course & ocean. Would highly recommend for close proximity to the beach. Pool was a short walk down the road. Loved our stay at Cinnamon Beach and would recommend to anyone and look forward to coming back!

Location is great! That's about it. Throughout our 4 day stay I tried really hard to keep things positive but the more I thought about the status of the condo the more it made me unhappy. I didn't find the place to be that clean or in great condition to rent. We had issues with the 2 spare bedroom doors that wouldn't close at all and needed to call John to fix them. (John was the only one that picked up his phone. Chris never picked up or went straight to voicemail) There was a broken lamp in the master room that looks like a fire hazard and the TVs reception was questionable at times. It felt like they never bothered to prepare the room for guests because these things were obvious but weren't fixed. The furniture is awful. The beds are hard as rocks. Scott was the one who booked us and he didn't really respond to all my questions in our emails and when I called him it felt like I was bothering him. The whole experience just didn't feel like a vacation but more like renting from some guys trying to turn a profit than give you the best experience possible. They just didn't seem to care. I'd go back to Cinnamon Beach in a heartbeat but not through Scott or Chris and not condo #453 unless things changed.

Great unit Great location and good unit. Unfortunately the hurricane took out the golf course last year. . .So if you are looking for a golf view. . .its just dead grass and construction. Hopefully they finish Fall 2017.

Great location and view from #453 This is the second time I have stayed in this unit #453 and did enjoy the view from the balcony as well as the easy beach access. Their are a few things that need to be taken care of to make it a top notch unit , 1st thing is the carpet needs a good cleaning or replacement as soon as possible and the walls need a fresh coat of paint and lastly get rid of all the fake plants throughout the unit.

Great rental The view from the balcony is amazing. The place was very clean and the kitchen has all the dishes that we needed (not much because we don't cook)! Plenty of towels even beach towels and everything that is needed for the vacation - even toys (though we did not use). The only slight drawback is that the bedding could be replaced in the Master - it is clean but looking a bit worn. Jackie from the rental place is fabulous!

Beautiful condo and great location! We love staying at Cinnamon Beach at Ocean Hammock! The condo was clean and decorated nice. The location is ideal and we love the Cinnamon Beach ammenties. We plan on going back every year.

March at Cinnamon Beach Was supposed to be pet free due to severe allergies but pets had been in the condo. When contacted Management did a great job of cleaning, replacing etc - very responsive but still had impacts throughout the vacation but not as bad. Didn't have toaster or enough coffee cups so we purchased but other aspects of the condo and facilities were very good. Again mgmt were very responsive to our situation. Have rented for 5 weeks next year!

Surprise Birthday Party for our Mom! This was an amazing place. The view was spectacular! The living space was amazing! We had such a great time. The property management company - helped me in a bind with getting on the internet - which was wonderful!~ She even stopped her family dinner to help me. Everyone was so accommodating and helpful - we couldn't have asked for anything more! I would highly recommend this location to all my friends and family!<br/>only issue we did have was the cable TV - not sure if operator errors... LOL - but we managed.

Review Our stay was very nice. The only thing was the walk to the pool was longer than we anticipated, and they ran out of umbrellas and chairs pretty quickly on the beach. The condo was very nice and clean and the view was beautiful!!

Noisy and Dirty We were in unit 453. The units are not very well insulated - this is a very noisy environment and we did not sleep well at all. You could hear people moving chairs, open and closing the sliding glass doors, etc. at all hours of the night. The bedding/comforter in the master bedroom was dirty. The floors were filthy. The bathrooms were dirty. The towels are very old and raggedy. The air vents are rusted. The covered patio was full of mosquitos as well as the hallways leading to each unit. The elevator was also full of mosquitos. The frying pans are all chipped and need to be replaced. The cooking utensils are old and need to be replaced. The lap pool had algae and was not clean. There are not very many good restaurants around. The local shopping areas have many closed down shops. Overall we were very dissatisfied and will not stay here again nor recommend to a friend.

Beautiful Beach; not so the condo We went to Cinnamon Beach because we were invited by friends. We only stayed 3 nights, so we were limited on which condo to rent. condo condition was poor. Master bedroom sheets were worn out and ripped. First night people above us were noisy till 4am. I called the management company. No response. I later found I should have called security. That night I slept in other bedroom, and the comforter had a 12" tear at the seam. We also found left over trash in the garbage drawer. At least we had a good time with our friends. The condo did have a great view of golf course and ocean. And was right by the pier to walk to the beach. There also was trouble with the elevators. Several times we took the steps. This condo was not at all at hotel standards.

Very Nice - exceptional view The condo itself was very nice, tasteful decorated, relatively clean. The view from the condo is spectacular and its immediate access to the beach very convenient. We were also pleased with the elevator for our elderly guests. The year-round residents were very nice and friendly. We visited at a "quiet" time of the year, and it was very peaceful and quiet. The staff we met - the security staff at the gate - were very friendly and helpful answering questions and providing directions. <br/><br/>Only two real complaints: 1) It should be mentioned in the advertising materials (or more prominently) that the golf course running through the property is not accessible by those living/staying in these condos. It is a bit of a let down. I would have gladly paid to be able to play, or paid extra in the rental fee to have access to the course.<br/>2) There were a few appliances that need work. A lamp in the master bedroom was broken, the TV in the guest room with the two single beds did not work. The washing machine sounds like it's about to break down. It was exceptionally cold for the area when we visited and we would have like to turn on the furnace. We tried for a few minutes, but it set off the smoke detectors and we were afraid to use it thereafter. It seems like just checking whether these items are in working order would swiftly reveal those that need to be fixed, replaced, etc. Lastly, a few silverfish were spotted in the Laundry area. This is not unusual for Florida, but the occasional visit from an exterminator would help.

Fantastic! Two families, Two units and five high school seniors! The two units we rented exceeded my expectations. Was overjoyed with the general area and found it far more beautiful than I had imagined. The Publix was just minutes away. The security gate at the main entrance was excellent. We also loved the gate to Cinnamon Beach that closed at 8pm. You had to have the code to get back in. Very secure. We loved this and felt safe letting the girls go to the pool or beach. We were okay with leaving them to hang out with our friends. We did not go looking for a "rowdy spring break" atmosphere and it was definitely not here. Great property manager helped us twice in our unit with the internet and in our friends unit with a TV remote problem. I knew there were rocks on the beach and this was NOT an issue. I thought they were beautiful. We went to St. Augustine for two days and fell in love. Highly recommend. Only two minor negatives. On Thursday night the unit above became very loud. Heard walking and chairs being dragged. Thought is was children but then heard noise until 3 am on Friday. I think some spring breakers might have snuck in. This was not the fault of anyone and I suppose what can happen in a 6 floor villa community. Might have been construction as a unit above was moving out. Still, the noise should have stopped at a reasonable hour. We were leaving the next morning so there was no complaint. The twin beds in both units are hard. Could be a bit more comfortable. Kings were great. Overall this place was fantastic and as well traveled as I am I couldn't believe that I did not know about this place before. Loved it!!!! Would LOVE to come back.

Girl's Getaway We spent three nights for a girls' weekend and had a great time. The condo was the perfect size for 6 adult women and we enjoyed the views and having such a comfortable home base for the beach. The walk to the beach is a path through the dunes right outside the building, which was fairly close and convenient, but would have been nicer with a hose or shower to rinse off. The kitchen could be better equipped with more cups/mugs and cooking items for those who take advantage and eat in. We often had to reuse dishes before the dishwasher ran because there weren't enough items. It could have also been a bit cleaner - the ceiling fans had noticeable cobwebs and dust and some of the sheets didn't seem the cleanest. Otherwise, we had a relaxing stay and really enjoyed our time away. Thanks!

This is a great property with the best views ever! The unit was well stocked and everything was clean. The unit was very spacious. Our only concern was with the tiny mites we found when my grandson dropped a candy wrapper on the floor! The furnishings are nice but slightly worn. Starting to be in need of better beds. Overall it was a good space for the value. No close activities for swimming or entertainment for kids.

This is the second time I have stayed in this unit #453 and did enjoy the view from the balcony as well as the easy beach access. Their are a few things that need to be taken care of to make it a top notch unit , 1st thing is the carpet needs a good cleaning or replacement as soon as possible and the walls need a fresh coat of paint and lastly get rid of all the fake plants throughout the unit.

Great location and good unit. Unfortunately the hurricane took out the golf course last year. . .So if you are looking for a golf view. . .its just dead grass and construction. Hopefully they finish Fall 2017.

The view from the balcony is amazing. The place was very clean and the kitchen has all the dishes that we needed (not much because we don't cook)! Plenty of towels even beach towels and everything that is needed for the vacation - even toys (though we did not use). The only slight drawback is that the bedding could be replaced in the Master - it is clean but looking a bit worn. Jackie from the rental place is fabulous!

The condo itself was very nice, tasteful decorated, relatively clean. The view from the condo is spectacular and its immediate access to the beach very convenient. We were also pleased with the elevator for our elderly guests. The year-round residents were very nice and friendly. We visited at a "quiet" time of the year, and it was very peaceful and quiet. The staff we met - the security staff at the gate - were very friendly and helpful answering questions and providing directions. <br/><br/>Only two real complaints: 1) It should be mentioned in the advertising materials (or more prominently) that the golf course running through the property is not accessible by those living/staying in these condos. Unit 453 has a great view but needs updates to several areas , screen door to porch was rusted and difficult to open and shut , lamp in master beadroom was broken , several lights had burnt out bulbs and the bed in master did not even have a bedspread on it just white sheets which was just weird , the furniture in living area was somewhat worn and needs upgrade along with carpet .The general cleanliness was pretty good and the unit could really be nice with some minor fixable upgrades. I would rent again if some of these issues could be resolved. This area is perfect for a quiet vacation with a nice private beach and plenty of areas to visit.

Very happy with our short vacation to Cinnamon Beach. The condo was exactly as described. Beautiful views of both the golf course & ocean. Would highly recommend for close proximity to the beach. Throughout our 4 day stay I tried really hard to keep things positive but the more I thought about the status of the condo the more it made me unhappy. I didn't find the place to be that clean or in great condition to rent. We had issues with the 2 spare bedroom doors that wouldn't close at all and needed to call John to fix them. (John was the only one that picked up his phone. Chris never picked up or went straight to voicemail) There was a broken lamp in the master room that looks like a fire hazard and the TVs reception was questionable at times. It felt like they never bothered to prepare the room for guests because these things were obvious but weren't fixed. The furniture is awful. The beds are hard as rocks. Scott was the one who booked us and he didn't really respond to all my questions in our emails and when I called him it felt like I was bothering him. The whole experience just didn't feel like a vacation but more like renting from some guys trying to turn a profit than give you the best experienc

Was supposed to be pet free due to severe allergies but pets had been in the condo. When contacted Management did a great job of cleaning, replacing etc - very responsive but still had impacts throughout the vacation but not as bad. Didn't have toaster or enough coffee cups so we purchased but other aspects of the condo and facilities were very good. Again mgmt were very responsive to our situation. Have rented for 5 weeks next year!

This was an amazing place. The view was spectacular! The living space was amazing! We had such a great time. The property management company - helped me in a bind with getting on the internet - which was wonderful!~ She even stopped her family dinner to help me. Everyone was so accommodating and helpful - we couldn't have asked for anything more! I would highly recommend this location to all my friends and family!<br/>only issue we did have was the cable TV - not sure if operator errors... LOL - but we managed.

Our stay was very nice. The only thing was the walk to the pool was longer than we anticipated, and they ran out of umbrellas and chairs pretty quickly on the beach. The condo was very nice and clean and the view was beautiful!!

We were in unit 453. The units are not very well insulated - this is a very noisy environment and we did not sleep well at all. You could hear people moving chairs, open and closing the sliding glass doors, etc. at all hours of the night. The bedding/comforter in the master bedroom was dirty. The floors were filthy. The bathrooms were dirty. The towels are very old and raggedy. The air vents are rusted. The covered patio was full of mosquitos as well as the hallways leading to each unit. The elevator was also full of mosquitos. The frying pans are all chipped and need to be replaced. The cooking utensils are old and need to be replaced. The lap pool had algae and was not clean. There are not very many good restaurants around. The local shopping areas have many closed down shops. Overall we were very dissatisfied and will not stay here again nor recommend to a friend.

We went to Cinnamon Beach because we were invited by friends. We only stayed 3 nights, so we were limited on which condo to rent. condo condition was poor. Master bedroom sheets were worn out and ripped. First night people above us were noisy till 4am. I called the management company. No response. I later found I should have called security. That night I slept in other bedroom, and the comforter had a 12" tear at the seam. We also found left over trash in the garbage drawer. At least we had a good time with our friends. The condo did have a great view of golf course and ocean. And was right by the pier to walk to the beach. There also was trouble with the elevators. Several times we took the steps. This condo was not at all at hotel standards.
