Terms

PAYMENT: Deposit is due at the time of reservation. Fifty percent (50%) of the total rent, taxes, and fees shall be paid and received by Agent in the form of a credit card personal check, certified, cashier or bank check or money order within 7 days after the reservation is made, and the balance of rent, taxes, fees and any unpaid security deposit shall be paid and received by Agent no later than thirty (30) days prior to check-in. The security deposit, rent, taxes, and fees may be paid by personal check conditioned upon Agent’s receipt of same more than thirty (30) days before the above-stated check-in date. A valid credit card must be provided no less than seven (7) days prior to check-in whether or not the reservation is paid for by credit card. The credit card will be charged in the event that damages, missing items or excessive use of utilities are not covered by the Guest’s security deposit.
UTILITIES: Utilities are included in the rental amount unless other wise stated, however Agent reserves the right at Agent’s sole discretion to charge Guest for excessive use of utilities if it is determined Guest used any or all of the provided utilities in an abusive or negligent manner. Guest agrees that all excessive use charges will be charged to Guest’s credit card on file and/or withheld from Guest’s security deposit. Guest shall pay cost of all utilities on rentals of more than 30 days unless otherwise stated.
Time is of the essence as to payment pursuant to this Rental Agreement, and any late payments shall, at the sole option of Agent, cause a forfeiture of Guest’s rights pursuant to this Agreement and immediate cancellation of same without further notice to Guest.
CANCELLATIONS: Reservations may be cancelled by Guest with notice to Agent within seven (7) days of the date of the reservation call, and more than thirty (30) days before check-in and any deposit received by Agent shall be refunded to Guest minus a $50.00 administration fee. After seven (7) days from the date of the reservation call, or less than thirty (30) days before check-in, any deposits, rent and fees paid shall become non-refundable if the reservation is cancelled by Guest. In the event of an emergency, Agent reserves the right at Agent’s discretion, to refund on a case by case basis only, part of any deposit, rent or fees paid, minus an administrative fee, upon notice of cancellation by Guest. Any deposit, rent or fees retained by
Agent pursuant to this provision shall be agreed upon liquidated damages, consideration for the execution of this Rental Agreement and in full settlement of all claims.
THIRD: GUEST COVENANTS AND CONDITIONS:
The parties agree that the following are material covenants and conditions of this Rental
Agreement, the breach of which shall result in immediate forfeiture by the Guest of the subject rental premises in accordance with applicable law:
1. Guest shall not damage the rental premises or any part thereof or any personal property or appurtenance therein or thereto, and if the premises, or any part thereof, or any personal property or appurtenance thereto are damaged, obstructed or rendered inoperable by the misuse or negligence of Guest, Guest’s guests, family, agents or employees, Guest shall pay the cost for repair or replacement of same immediately upon presentation by Agent of a bill for same.
2. Guest shall comply with all applicable federal, state, and county local laws, and community rules, regulations, covenants and ordinances including, but not limited to Flagler County, Florida, and the community in which the Guest is staying.
3. Guest agrees not to commit waste or to use the rental premises or any appliances or appurtenances thereof or thereto for any disorderly or unlawful or offensive purpose.
4. Guest shall permit only the people list in Addendum A, incorporated into this agreement by reference, to use and occupy the subject rental premises.
5. No pets are allowed in or around the rental premises at any time, unless specifically permitted by Owner and applicable pet fees are paid at the time this Rental Agreement is executed.
Vehicles identified in Addendum B, not to exceed two (2) vehicles and may be parked on the premises in approved parking places.
Any vehicles not identified in Addendum B shall be towed or removed from the premises at Guest’s expense.
7. In the event the premises become uninhabitable, due to damage from wind, fire, rain, storm surge, or any other cause, and the Owner, at his sole discretion, shall decide not to repair or rebuild the premises, the term of this lease shall end and rent will be prorated up to the time of the damage.
8. Guest agrees not to charge any long distance telephone calls or other charges to the telephone account(s) located at the rental premises. Local calls are permitted.
9. RADON DISCLOSURE: Pursuant to §404.056(8), Florida Statutes, Radon is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time.
Levels of radon that exceed Federal and State guidelines have been found in buildings in
Florida. Additional information regarding radon and radon testing may be obtained from your public health unit.
10. Guest agrees to permit Owner or Owner’s agents to enter the rental premises or any part thereof at any reasonable time for the purpose of examining same, to make necessary repairs, and/or to protect any personal property from damage. Reasonable time for said entry, without further notice to Guest, shall be between the hours of 9:00 a.m. and 5:00 although the parties may agree to additional hours for Owner’s access.
Owner or Owner’s Agent may also enter the rental premises with the consent of Guest, or when necessary in case of an emergency or when the Guest unreasonably withholds consent or access.
11. a. Guest acknowledges and agrees that Owner/Agent may remove or cause to be removed from the rental premises any Guest or guest who, while at the rental premises, illegally possesses or deals in controlled substances, violates any of the terms of this
Rental Agreement, is intoxicated, profane, lewd or brawling, who indulges in any language or conduct which disturbs the peace and comfort of other guests or neighbors, or which constitutes a nuisance, or which injures the reputation, dignity or standing of the
rental premises, or anyone who fails to make payment of rent at the agreed-upon rental rate and fees at the agreed-upon times, or anyone who fails to check-out at the agreed upon time unless an extension of time is expressly agreed to by the Agent and the Guest prior to check out. Admission to and removal from the rental property is not and shall not be based upon race, creed, color, sex, physical disability or national origin. Any notice to vacate may be given orally or in writing by Owner/Agent to Guest, and if in writing shall be as follows: “You are hereby notified that this establishment no longer desires to entertain you as its guest, and you are requested to leave at once. To remain after receipt of this notice is a misdemeanor under the laws of this State.”
b. If any Guest who is asked to vacate early has paid in advance, Agent shall, at the time notice is given, tender to the Guest the unused portion of the advance rent and fees payment without prorating any portion of the day that Guest is noticed to vacate. Agent may retain any security deposit without further notice as agreed upon liquidated damages, consideration for the execution of this Rental Agreement and in full settlement of all claims, or Owner, at Owner’s option, may proceed at law with any damages claim.
Any Guest who remains or attempts to remain in the rental premises after being requested to vacate shall be guilty of a misdemeanor of the second degree punishable in accordance with Florida law. If any person is illegally at the subject rental premises, Owner may call upon any law enforcement officer of this State for assistance. If the Guest is arrested,
Owner shall employ all reasonable and proper means to care for any personal property which may be left at the rental premises by the guest; however, upon arrest, the
Guest/guest shall be deemed to have given up any right of occupancy and to have abandoned such rights.
12. Guest agrees that Owner and Owner’s agents shall not be liable for any loss of or damage to any personal property in or on the rental premises or stored in rooms or places provided to Guest in connection therewith, nor shall Owner or Owner’s agents or employees be liable to Guest, Guest’s family, guests, or agents for failure to repair or maintain any part of the rental premises or property contained therein absent gross negligence. Guest further agrees that neither Owner, nor Owner’s agents or employees shall be liable for any damage to the personal property of the Guest, Guest’s family, guests, or agents arising from theft, vandalism, fire, water, rain, acts of God or government, interruption of utilities, acts of others or other third party or external causes whatsoever.
13. No lifeguard is available on the premises. Guest shall use amenities, pools, beach, ocean with great care and in accordance with any posted rules. All children and elderly, frail adults using said amenities shall be constantly supervised by a responsible adult who can swim. If the amenities are equipped with any safety features such as a fence or other pool or water area barrier, a pool cover, a door latch or a door or window alarm, Guest shall be responsible for correctly operating and using said safety device every time the amenity is used. Any use of said amenities shall be at the sole risk of the user, the responsible adult supervising the user, and the Guest.
14. Guest is responsible for and shall indemnify the Owner and Owner’s agents and hold them harmless from any and all claims, liability, demands, actions, causes of action, expenses, damages, losses or injuries sustained by any person including Guest, Guest’s family, agents, guests or invitees as a result of or arising from the Guest’s subject occupancy and tenancy, including, but in no way limited to claims arising from the use of any pool, hot tub, spa-pool, water area or dock, which are part of the rental premises.
Guest shall also be liable and indemnify Owner for attorney’s fees and court costs incurred by Owner in enforcing any of the terms, covenants or conditions of this Rental
Agreement or which are sustained by Owner as a result of or arising from or during this reservation.
15. Guest may not assign this Agreement or sub-let the rental premises or any portion thereof.
16. Guest agrees that if applicable local and/or state tax rates increase after the time of reservation and before check-in that Guest will pay the additional tax due.
17. Absolutely NO SMOKING is permitted in the residence or on any balconies, patios, etc. attached to said residence unless otherwise noted in writing. Any detection of smoking in the residence will result in automatic forfeiture of the entire security deposit, plus punitive fees.

Almost Heaven This rental house is very nice. We stayed a week with our three adult children and two grandsons. The home is in a very good and quiet location. Everything was furnished for a wonderful vacation. The only thing I could suggest would be a comfortable chair or couch in the master bedroom. Other than that, it was perfect.

A week by the beach The house was ideal for our family of five, with all three kids being 18+. Pool, beach, cable TV, Wi-Fi and air-con - what else could be needed? The house is relatively new and very well furnished.<br/>A 30 minute drive to either St Augustine or Daytona.<br/>

Palm Coast Family Reunion 2016 We really enjoyed our stay at South of Charleston. The home is beautiful and very tastefully decorated. We stayed for one week in July for a family get-together. The lower level had a nice game room, a bunk room for the kids, and a beautiful back patio with a screened in pool, hammock, and nice table and chairs. The middle level had two bedrooms, a beautiful living room area, a huge dining room table where we had our family meals, a very nice kitchen, and a lovely outdoor area with comfortable seating and a table with seating for six. The third level had an amazing master suite with a king bed, huge bathroom, and a beautiful balcony with an ocean view. There was an elevator to take you to the different levels. The only concerns were that the pool pump and dishwasher were not working consistently and we could have used more plastic storage containers and serving bowls in the kitchen. Overall, our stay was awesome! We had a short walk to the beach as well as the community pools. We enjoyed bike rides around the beautifully maintained neighborhood. We would definitely stay here again!

Fantastic time at the 'South of Charleston' home Absolutely loved this home in Cinnamon Beach. Family reunion for 9 adults with plenty of room. Huge kitchen which was perfect since we cooked in for our stay. John, the property manager, was quick to respond to one small problem. Pool and game room was a bonus. The home is very close to the community pool, restaurant, bar and beach access. We would stay at this home again.

Great location, but many cleanliness issues, and lack of response We were very pleased with the location of the property in relation to the ocean as well as the property pools. Our issues were all about the condition of the home upon arrival. It appeared as though the home hadn't been cleaned for a while, and many things were missed. The comforters on the bed didn't appear to be clean (one had dried blood on it) and there were no other blankets provided to use. We had to clean the bathrooms ourselves in order to get rid of the prior renters' "hairs", dried toothpaste and urine on the toilet seat. The shower curtain in the main floor bathroom was beyond disgusting. The patio areas and pool area were dirty and full of cobwebs so we had to wipe everything down ourselves. Also all the pool equipment and toys were dirty and full of mildew. I contacted Chris Gallo, the property manager, right away, and he told me he'd get a housekeeper over. That was our first day there. We waited each day for the housekeeper to arrive, and no one ever did. Not once....for 5 days. We were extremely disappointed in the management's lack of follow-through or concern for our satisfaction with our stay. The house was nice, but would've been great....if it was cleaned. It was especially disappointing considering how much is charged for cleaning services. Aside from that, we loved the area and had a wonderful time at the community pool. The staff at the pool/grille was great and the security at the gate was personable as well. I wouldn't recommend the place if you have small children, as the master bedroom is on a different floor from the rest of the bedrooms. The view from the 3rd floor balcony is beautiful. The pool is fairly small and was quite chilly. We used it very briefly and spent the rest of our time at the community pool. The area is conveniently close to Daytona and St Augustine and it was handy to have a Publix so close as well.

Nice Vacation Home And Great Location The home was very nice and in the perfect location. <br/> <br/>The beach was a five minute walk and the community pool was about a three minute walk. The floor plan was nice and with 4700 sq ft. there was plenty of room in the home. <br/> <br/>The only problem was with the homeowner as for some reason there was a lot of trash they took out and left in the driveway in two trash cans. This was apparently done after the normal Thursday trash pickup. Not sure why there was so much trash since no one stayed in the home the previous week. <br/> <br/>Called the property managers and they came right away and cleaned up the mess which was in the driveway near the garage and was smelling pretty bad too. <br/> <br/>The other problem was that the home owner apparently sold the home during the week and had the wifi mistakenly turned off on Wednesday during the week and blamed it on the internet provider saying it was supposed to be Saturday at the end of the week. <br/> <br/>Called the property managers and they called the owner and got the wifi turned back on until the end of the week. <br/> <br/>The rental company was excellent and so were the property managers Chris and John but the homeowner was a different story which is hard for the property mangers to completely cover for. <br/> <br/>Would give the rental company and property managers five out of five but the homeowner probably a three. <br/> <br/>Would stay here in the future and definitely recommend to friends and glad there will be a new owner in the future. <br/> <br/>Thanks! <br/> <br/> <br/><br/>

Loved Our Time at Cinnamon Beach! The South of Charleston was a great house for our large family. My kids and grandkids had an awesome time. Great game/family room on lower level for kids. Nice pool. Very clean. Only thing I would have added is maybe more utensils for the kitchen and there were no trash cans other than the kitchen and one of the bathrooms. Also, not sure of the size of the 2 beds on 2nd floor. Didn’t seem large enough for queens. Other than that we loved it. Great location also!!!

Lockhart/Miller wedding week Our family had an amazing week. The home and community was a perfect location for our family to celebrate this special occasion. July 2015 This house is in a great location. Very nice community and great proximity to the beach access and community pool. The house is beautiful with great views! However, the home was not thoroughly cleaned before our stay. The main living area and dining area were nicely furnished but the bedroom furniture and all mattresses left a lot to be desired. A little maintenance and a few minor upgrades/additions and this house would be absolutely perfect!

Great Vacation House Great place. We had 6 adults and 5 children ranging from 3 yrs to 16 yrs, everyone loved the house and location. We have been to Ocean Hammock previously so knew what to expect as far as amenities. Having our own pool at the house was a big plus for the kids. Elevator was a big plus for me since house is 3 stories and I have a bad knee. Also very handy for getting luggage and groceries upstairs. Will definitely book this house in the future. Crystal Belleview at the management company was very helpful and responsive to the few small issues we had.

Beautiful place with very correctable minor maintenance issues It is a very beautiful place as described for our three generations of famil members. We love it and we might come back next year. We like the beach, the club and the nearby shopping center. Everyone has fun.<br/><br/>The minor issues are linens are quite worn out,some need to be retired. The mattress in second floor bedroom is not firm enough. It has no soft padded mattress cover, but a plastic one without padding which is very torn. Furthermoe, thE cleaning crew used a flat sheet instead of a fitted sheet so it was slipping off the slippery plastic sheet and we had to change it orselves. The entire room is quite substandard like a third rate motel. <br/>Very important, please install grab bars and provide rubber bathtub mat for safety. When someone falls, the consequence is serious. This is very easy correction.

Great House We had a wonderful experience staying in this home. Everything we needed was accounted for. There was plenty of space for our 4 kids and the grandparents as well. We had no issues with this home and would stay there again.

Spectacular Home & Ideal Location The pictures do not do this house justice! It is very upscale yet comfortable. The 1st floor is perfect for kids/teens with a rec room, table/chairs, bar fridge, TV/DVD, arcade game, games, full bathroom & bedroom with 4 beds (2 bunks). The 2nd floor hosts a chefs dream kitchen with all stainless steel appliances including a double oven. There are also 2 bedrooms (queens), 2 bathrooms and laundry facilities. The 3rd floor is the master retreat that is absolutely gorgeous! The balcony overlooks the lake where wildlife sightings were plentiful including daily visits from sea otters! There is also a spacious balcony on the 2nd floor ideal for relaxing with a book or for morning coffee. Top top it off this house has an elevator that was fantastic to take luggage, groceries etc. to each floor. Nothing has been overlooked. You could not ask for a better location. It is literally a 2 minute walk to the beach/ocean as well as the clubhouse. There are 2 access points for the beach but you access the beach via the clubhouse, longers, chairs and umbrellas are provided free of charge. The beach is very secluded. It is like having your own private beach. It has sand bars and is clear with tons of shells. A gated community with securtity, loads of bike trails, golfing etc. The property management were a delight to deal with and check-in was a breeze! We have rented many homes throughout Florida and this is by far the best house/location! We look forward to returning.

A perfect home away from home Our Christmas week vacation was perfect at the South of Charleston. We were 4 children and 4 adults that enjoyed the serenity and accommodations, there was even a Christmas tree that added to the holiday spirit. The house is decorated lovely with a seaside theme, the children had their own space and the decks provide beautiful views. Within a short walk you're on peaceful cinnamon colored sandy dog friendly beach. We all look forward to returning for another awesome vacation.

Feedback The home was obviously very new, very neat and very clean. There were a couple of items that kept it from perfect. The water pressure on the third floor (master bath) was terrible. Second, the home sleeps 12, seats 10 at the table yet there was only ONE pot in the cabinet that could be used to cook a large meal. Making spaghetti sauce and boiling pasta was truly funny! Thanks so much for hosting us.

Perfect says it all! The pictures do not come close to have fab this house is! We had 3 families with a total of 5 kids and it was great that the kids had their own level with fun things to do. The arcade was a big hit! Can't wait to plan my nextt trip to Cinnamon Beach.

South of Charleston Review House was very nice, but missing several essentials. Namely, a working icemaker, can opener, wash cloths, and grilling tools. The management company did not bring the requested grilling tools. Also, although the website advertizes this as a "no pets" rental. It was clear that the owners have a dog (or dogs). There was pet hair on many of the couch cushions. Our son is allergic to dogs. We needed to know that the house was not truly pet free.

Supertastic The property was absolutely gorgeous. The quality of the property was first class. The location to the beach was awesome with stunning views from both balconies. the club amenities were very good. The security is first class as well. Overall this will be a spot that my family will return to in the future.

Lovely South of Charleston This is the 3rd year in a row that we have rented from Cinnamon Beach Vacations. Each year we have been blown away by the outstanding properties and accomodations. This rental house is very nice. We stayed a week with our three adult children and two grandsons. The home is in a very good and quiet location. Everything was furnished for a wonderful vacation. The only thing I could suggest would be a comfortable chair or couch in the master bedroom. Other than that, it was perfect.

We really enjoyed our stay at South of Charleston. The home is beautiful and very tastefully decorated. We stayed for one week in July for a family get-together. The lower level had a nice game room, a bunk room for the kids, and a beautiful back patio with a screened in pool, hammock, and nice table and chairs. The middle level had two bedrooms, a beautiful living room area, a huge dining room table where we had our family meals, a very nice kitchen, and a lovely outdoor area with comfortable seating and a table with seating for six. The third level had an amazing master suite with a king bed, huge bathroom, and a beautiful balcony with an ocean view. There was an elevator to take you to the different levels. The only concerns were that the pool pump and dishwasher were not working consistently and we could have used more plastic storage containers and serving bowls in the kitchen. Absolutely loved this home in Cinnamon Beach. Family reunion for 9 adults with plenty of room. Huge kitchen which was perfect since we cooked in for our stay. John, the property manager, was quick to respond to one small problem. Pool and game room was a bonus. The home is very close to the community pool, restaurant, bar and beach access. We were very pleased with the location of the property in relation to the ocean as well as the property pools. Our issues were all about the condition of the home upon arrival. It appeared as though the home hadn't been cleaned for a while, and many things were missed. The comforters on the bed didn't appear to be clean (one had dried blood on it) and there were no other blankets provided to use. We had to clean the bathrooms ourselves in order to get rid of the prior renters' "hairs", dried toothpaste and urine on the toilet seat. The shower curtain in the main floor bathroom was beyond disgusting. The patio areas and pool area were dirty and full of cobwebs so we had to wipe everything down ourselves. Also all the pool equipment and toys were dirty and full of mildew. I contacted Chris Gallo, the property manager, right away, and he told me he'd get a housekeeper over. That was our first day there. We waited each day for the housekeeper to arrive, and no one ever did. Not once....for 5 days. We

The home was very nice and in the perfect location. <br/> <br/>The beach was a five minute walk and the community pool was about a three minute walk. The floor plan was nice and with 4700 sq ft. there was plenty of room in the home. <br/> <br/>The only problem was with the homeowner as for some reason there was a lot of trash they took out and left in the driveway in two trash cans. This was apparently done after the normal Thursday trash pickup. Not sure why there was so much trash since no one stayed in the home the previous week. <br/> <br/>Called the property managers and they came right away and cleaned up the mess which was in the driveway near the garage and was smelling pretty bad too. <br/> <br/>The other problem was that the home owner apparently sold the home during the week and had the wifi mistakenly turned off on Wednesday during the week and blamed it on the internet provider saying it was supposed to be Saturday at the end of the week. <br/> <br/>Called the property managers and they calle

The South of Charleston was a great house for our large family. My kids and grandkids had an awesome time. Great game/family room on lower level for kids. Nice pool. Very clean. Only thing I would have added is maybe more utensils for the kitchen and there were no trash cans other than the kitchen and one of the bathrooms. Also, not sure of the size of the 2 beds on 2nd floor. Didn’t seem large enough for queens. Other than that we loved it. Great location also!!!

This house is in a great location. Very nice community and great proximity to the beach access and community pool. The house is beautiful with great views! However, the home was not thoroughly cleaned before our stay. The main living area and dining area were nicely furnished but the bedroom furniture and all mattresses left a lot to be desired. A little maintenance and a few minor upgrades/additions and this house would be absolutely perfect!

Great place. We had 6 adults and 5 children ranging from 3 yrs to 16 yrs, everyone loved the house and location. We have been to Ocean Hammock previously so knew what to expect as far as amenities. Having our own pool at the house was a big plus for the kids. Elevator was a big plus for me since house is 3 stories and I have a bad knee. Also very handy for getting luggage and groceries upstairs. Will definitely book this house in the future. Crystal Belleview at the management company was very helpful and responsive to the few small issues we had.

It is a very beautiful place as described for our three generations of famil members. We love it and we might come back next year. We like the beach, the club and the nearby shopping center. Everyone has fun.<br/><br/>The minor issues are linens are quite worn out,some need to be retired. The mattress in second floor bedroom is not firm enough. It has no soft padded mattress cover, but a plastic one without padding which is very torn. Furthermoe, thE cleaning crew used a flat sheet instead of a fitted sheet so it was slipping off the slippery plastic sheet and we had to change it orselves. The entire room is quite substandard like a third rate motel. <br/>Very important, please install grab bars and provide rubber bathtub mat for safety. When someone falls, the consequence is serious. This is very easy correction.

The pictures do not do this house justice! It is very upscale yet comfortable. The 1st floor is perfect for kids/teens with a rec room, table/chairs, bar fridge, TV/DVD, arcade game, games, full bathroom & bedroom with 4 beds (2 bunks). The 2nd floor hosts a chefs dream kitchen with all stainless steel appliances including a double oven. There are also 2 bedrooms (queens), 2 bathrooms and laundry facilities. The 3rd floor is the master retreat that is absolutely gorgeous! The balcony overlooks the lake where wildlife sightings were plentiful including daily visits from sea otters! There is also a spacious balcony on the 2nd floor ideal for relaxing with a book or for morning coffee. Top top it off this house has an elevator that was fantastic to take luggage, groceries etc. to each floor. Nothing has been overlooked. You could not ask for a better location. It is literally a 2 minute walk to the beach/ocean as well as the clubhouse. There are 2 access points for the beach but you access the beach via the club
