Terms

PAYMENT: Deposit is due at the time of reservation. Fifty percent (50%) of the total rent, taxes, and fees shall be paid and received by Agent in the form of a credit card personal check, certified, cashier or bank check or money order within 7 days after the reservation is made, and the balance of rent, taxes, fees and any unpaid security deposit shall be paid and received by Agent no later than thirty (30) days prior to check-in. The security deposit, rent, taxes, and fees may be paid by personal check conditioned upon Agent’s receipt of same more than thirty (30) days before the above-stated check-in date. A valid credit card must be provided no less than seven (7) days prior to check-in whether or not the reservation is paid for by credit card. The credit card will be charged in the event that damages, missing items or excessive use of utilities are not covered by the Guest’s security deposit.
UTILITIES: Utilities are included in the rental amount unless other wise stated, however Agent reserves the right at Agent’s sole discretion to charge Guest for excessive use of utilities if it is determined Guest used any or all of the provided utilities in an abusive or negligent manner. Guest agrees that all excessive use charges will be charged to Guest’s credit card on file and/or withheld from Guest’s security deposit. Guest shall pay cost of all utilities on rentals of more than 30 days unless otherwise stated.
Time is of the essence as to payment pursuant to this Rental Agreement, and any late payments shall, at the sole option of Agent, cause a forfeiture of Guest’s rights pursuant to this Agreement and immediate cancellation of same without further notice to Guest.
CANCELLATIONS: Reservations may be cancelled by Guest with notice to Agent within seven (7) days of the date of the reservation call, and more than thirty (30) days before check-in and any deposit received by Agent shall be refunded to Guest minus a $50.00 administration fee. After seven (7) days from the date of the reservation call, or less than thirty (30) days before check-in, any deposits, rent and fees paid shall become non-refundable if the reservation is cancelled by Guest. In the event of an emergency, Agent reserves the right at Agent’s discretion, to refund on a case by case basis only, part of any deposit, rent or fees paid, minus an administrative fee, upon notice of cancellation by Guest. Any deposit, rent or fees retained by
Agent pursuant to this provision shall be agreed upon liquidated damages, consideration for the execution of this Rental Agreement and in full settlement of all claims.
THIRD: GUEST COVENANTS AND CONDITIONS:
The parties agree that the following are material covenants and conditions of this Rental
Agreement, the breach of which shall result in immediate forfeiture by the Guest of the subject rental premises in accordance with applicable law:
1. Guest shall not damage the rental premises or any part thereof or any personal property or appurtenance therein or thereto, and if the premises, or any part thereof, or any personal property or appurtenance thereto are damaged, obstructed or rendered inoperable by the misuse or negligence of Guest, Guest’s guests, family, agents or employees, Guest shall pay the cost for repair or replacement of same immediately upon presentation by Agent of a bill for same.
2. Guest shall comply with all applicable federal, state, and county local laws, and community rules, regulations, covenants and ordinances including, but not limited to Flagler County, Florida, and the community in which the Guest is staying.
3. Guest agrees not to commit waste or to use the rental premises or any appliances or appurtenances thereof or thereto for any disorderly or unlawful or offensive purpose.
4. Guest shall permit only the people list in Addendum A, incorporated into this agreement by reference, to use and occupy the subject rental premises.
5. No pets are allowed in or around the rental premises at any time, unless specifically permitted by Owner and applicable pet fees are paid at the time this Rental Agreement is executed.
Vehicles identified in Addendum B, not to exceed two (2) vehicles and may be parked on the premises in approved parking places.
Any vehicles not identified in Addendum B shall be towed or removed from the premises at Guest’s expense.
7. In the event the premises become uninhabitable, due to damage from wind, fire, rain, storm surge, or any other cause, and the Owner, at his sole discretion, shall decide not to repair or rebuild the premises, the term of this lease shall end and rent will be prorated up to the time of the damage.
8. Guest agrees not to charge any long distance telephone calls or other charges to the telephone account(s) located at the rental premises. Local calls are permitted.
9. RADON DISCLOSURE: Pursuant to §404.056(8), Florida Statutes, Radon is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time.
Levels of radon that exceed Federal and State guidelines have been found in buildings in
Florida. Additional information regarding radon and radon testing may be obtained from your public health unit.
10. Guest agrees to permit Owner or Owner’s agents to enter the rental premises or any part thereof at any reasonable time for the purpose of examining same, to make necessary repairs, and/or to protect any personal property from damage. Reasonable time for said entry, without further notice to Guest, shall be between the hours of 9:00 a.m. and 5:00 although the parties may agree to additional hours for Owner’s access.
Owner or Owner’s Agent may also enter the rental premises with the consent of Guest, or when necessary in case of an emergency or when the Guest unreasonably withholds consent or access.
11. a. Guest acknowledges and agrees that Owner/Agent may remove or cause to be removed from the rental premises any Guest or guest who, while at the rental premises, illegally possesses or deals in controlled substances, violates any of the terms of this
Rental Agreement, is intoxicated, profane, lewd or brawling, who indulges in any language or conduct which disturbs the peace and comfort of other guests or neighbors, or which constitutes a nuisance, or which injures the reputation, dignity or standing of the
rental premises, or anyone who fails to make payment of rent at the agreed-upon rental rate and fees at the agreed-upon times, or anyone who fails to check-out at the agreed upon time unless an extension of time is expressly agreed to by the Agent and the Guest prior to check out. Admission to and removal from the rental property is not and shall not be based upon race, creed, color, sex, physical disability or national origin. Any notice to vacate may be given orally or in writing by Owner/Agent to Guest, and if in writing shall be as follows: “You are hereby notified that this establishment no longer desires to entertain you as its guest, and you are requested to leave at once. To remain after receipt of this notice is a misdemeanor under the laws of this State.”
b. If any Guest who is asked to vacate early has paid in advance, Agent shall, at the time notice is given, tender to the Guest the unused portion of the advance rent and fees payment without prorating any portion of the day that Guest is noticed to vacate. Agent may retain any security deposit without further notice as agreed upon liquidated damages, consideration for the execution of this Rental Agreement and in full settlement of all claims, or Owner, at Owner’s option, may proceed at law with any damages claim.
Any Guest who remains or attempts to remain in the rental premises after being requested to vacate shall be guilty of a misdemeanor of the second degree punishable in accordance with Florida law. If any person is illegally at the subject rental premises, Owner may call upon any law enforcement officer of this State for assistance. If the Guest is arrested,
Owner shall employ all reasonable and proper means to care for any personal property which may be left at the rental premises by the guest; however, upon arrest, the
Guest/guest shall be deemed to have given up any right of occupancy and to have abandoned such rights.
12. Guest agrees that Owner and Owner’s agents shall not be liable for any loss of or damage to any personal property in or on the rental premises or stored in rooms or places provided to Guest in connection therewith, nor shall Owner or Owner’s agents or employees be liable to Guest, Guest’s family, guests, or agents for failure to repair or maintain any part of the rental premises or property contained therein absent gross negligence. Guest further agrees that neither Owner, nor Owner’s agents or employees shall be liable for any damage to the personal property of the Guest, Guest’s family, guests, or agents arising from theft, vandalism, fire, water, rain, acts of God or government, interruption of utilities, acts of others or other third party or external causes whatsoever.
13. No lifeguard is available on the premises. Guest shall use amenities, pools, beach, ocean with great care and in accordance with any posted rules. All children and elderly, frail adults using said amenities shall be constantly supervised by a responsible adult who can swim. If the amenities are equipped with any safety features such as a fence or other pool or water area barrier, a pool cover, a door latch or a door or window alarm, Guest shall be responsible for correctly operating and using said safety device every time the amenity is used. Any use of said amenities shall be at the sole risk of the user, the responsible adult supervising the user, and the Guest.
14. Guest is responsible for and shall indemnify the Owner and Owner’s agents and hold them harmless from any and all claims, liability, demands, actions, causes of action, expenses, damages, losses or injuries sustained by any person including Guest, Guest’s family, agents, guests or invitees as a result of or arising from the Guest’s subject occupancy and tenancy, including, but in no way limited to claims arising from the use of any pool, hot tub, spa-pool, water area or dock, which are part of the rental premises.
Guest shall also be liable and indemnify Owner for attorney’s fees and court costs incurred by Owner in enforcing any of the terms, covenants or conditions of this Rental
Agreement or which are sustained by Owner as a result of or arising from or during this reservation.
15. Guest may not assign this Agreement or sub-let the rental premises or any portion thereof.
16. Guest agrees that if applicable local and/or state tax rates increase after the time of reservation and before check-in that Guest will pay the additional tax due.
17. Absolutely NO SMOKING is permitted in the residence or on any balconies, patios, etc. attached to said residence unless otherwise noted in writing. Any detection of smoking in the residence will result in automatic forfeiture of the entire security deposit, plus punitive fees.

Cinnamon Beach 1131 The condo itself was beautiful. The view of the lake was amazing and the hammock on the porch was a favorite of the family’s. The only reason I’m giving this property 4 stars is the location of the condo to the beach and pools. It was over a 6 minute walk to the pool in blazing heat (yes I know it’s hot in Florida). The beach access was not a minute walk like the description says but more like a 3 minute walk. I’m spoiled on being able to walk out of my condo and being just steps to the pool and beach. Beach was shelly but uncrowded. Don’t buy from the bistro on site - $12 for virgin strawberry daiquiris that they automatically added 18% gratuity to.

The BEST Family Vacation Our family of 6 adults and 2 kid had the best time EVER!! From rest and relaxation to fun on the beach and in the waves, from delicious home-cooked meals in the large, well-equipped kitchen to terrific restaurant options, our entire clan had a wonderful time in this nicely furnished and decorated condo. The location couldn't be better. There was plenty of space. We will be reserving time here again next year. Love it!

Unit 1131 was Amazing!!! We absolutely loved the condo, it was super clean and beautiful and that view from the balcony is amazing!! We didn't love the walk to the beach and the huge rocks in the water were dangerous so we didn't even get to enjoy the ocean <br/> and we rode in car to the pool but the pools were very nice. Not a whole lot to do there but the beauty of the community is breathtaking!!!

Bring your own soap Condo was large and clean. Only complaint was lack of toiletries. They provided the smallest bar of soap I&#x2019;ve ever seen (smaller than any hotel). They provided 1 roll of toilet paper in each bathroom. There was no shampoo. Everything else was wonderful.

A Pleasant Surprise When we booked, we didn't know anything about the property. We were very pleased with our condo, the community, and the beach. The condo was very spacious and easily accessible. We loved the hammock on the deck! We are considering returning again right after Christmas.

We discovered a treasure when looking for Refuge from Florence Spacious and beautifully decorated mediterranean tropical theme throughout. ,Very comfortable, clean, equipped. Loved the lake view from the deck and beach view from the kitchen windows. Pet friendly with nearby pet grassy area. Enjoyed the upscale pools and gym. The whole area is gated and upscale. I would love to return for another stay. <br/>

Great time!!! We had a excellent stay. It was perfect for the thanksgiving weekend. The condo was in great shape and the area was what we wanted. Our son enjoyed relaxing in the hammock . The parking was convenient and very safe. I would defiantly return to this condo again.

Great Condo Plenty of room in the unit with a great balcony. It is larger than it appears in the photos. Unit was clean and well equipped. Location was great as we were there for golf and the beach. The only complaint was the televisions. Remotes were missing and you had to be an engineer to figure out how to get the T.V's working. Overall this place exceeded my expectations.

We&#x2019;ll be back! We came to Florida to attend my niece&#x2019;s wedding. After a mishap in our reservation elsewhere, we ended up in Cinnamon Beach. We really enjoyed our stay in this very private community. The grounds are pristine and the neighborhood was exceptionally quiet and spite of our visit during &#x201C;Bike Week&#x201D;. Residents and guests seemed to respect the quiet vibe set in this lush community. Our condo was clean and tastefully decorated in a tropical/Polynesian theme. The condo features 3 bedrooms and 3 bathrooms (2 of the bedrooms feature an ensuite). The kitchen is well equipped and features a breakfast table with seating for 4 people. The dining room offers seating for 6, and there is a breakfast bar with seating for 3. The living room is spacious and opens to a large balcony patio featuring dining for 4, plus additional lounge chairs and a comfy hammock. And that view!!! I was so pleased with the overall appearance and spaciousness of the condo that I hosted an impromptu brunch for 9 people in honor of my niece and her fiancé. The condo is conveniently located just a couple of short miles from shopping, restaurants, banking, gas stations, and I-95. If you&#x2019;re looking for a place to relax, enjoy some peace and quiet and have a bit of elbow-room, this is a fantastic property. If/when I return to this area, I will rebook this property without hesitation.

Great Stay This was a great property in a very good location. We had a very nice relaxing stay. Scott was very prompt and helpfull with answering a couple of requests that we had.<br/>Very short walk to beach and pool. There is a great Mt. Bike trail Mala Compra very close and JTs Captains BBQ and the pizza place are serve really good food. Highly reccomend this place.

Spring Break We really enjoyed our stay at this Condo, but there were a few small issues. The coffee table needs replacing, and some of the cooking pans had holes in them. The legs on the coffee table were broken. The Kitchen table is very wobbly so we elected not to use it at all. The location of condo is great. We loved the cafe at the pool. The food was excellent, but we think charging 18% gratuity was a little high. One more thing was the large rocks at the beach are very dangerous. Families need to be told about them beforehand. We were not aware of them.

Beautiful! We stayed at this condo for a week in November and didn't want to leave. It is absolutely beautiful! I spent most days on the hammock on the outside balcony listening to the sound of the ocean. Despite it being off-season and certain amenities being closed, such as the grill/bar by the pools, we had a wonderful time. Most of the boardwalks to the beach were destroyed from the hurricane this fall, but there was one near the condo that was perfectly fine. Our dog loved going on the beach and chasing the crabs at night. Lots of dogs on the beach, very dog-friendly community, with plenty of poo bins nearby. This property is kind of far from major activities, about 40 minutes from St. Augustine, but it was perfect for us, we wanted a place to relax near the ocean. My teenagers were able to hook up their X-box to the TV in one of the bedrooms, so they were occupied when we weren't outside. Everything about this place feels like home. The kitchen is well-stocked and simply beautiful. The only negative is that the remote control in the bedroom with twin beds was not working, and we were unable to use the TV at all (something with the cable settings is not right). Also, the remote control for the bedroom near the kitchen wasn't working either, but we were able to manually change channels on the back of the TV. Otherwise, we highly recommend this condo and hope to go back again soon!

Beautiful location Have driven through the Hammocks before so we knew the gated community was beautiful. This particular condo is an end unit , largest in size and in an excellent location. Only a minute away from the beach.<br/>I only gave it a three for condition as it really is in need of maintenance. Needs painting, many chips and gouges in walls. Kitchen chair at counter broken at top leaving rough metal exposed and dangerous. Furniture is cute and very tropical but also needs updating. Was impressed as they thought of everything when it comes to the little things. All kinds of tape,magazines,toys,water toys,candles,etc. Iron and board provided,although irons not that good.<br/>Laundry could have been cleaner but the rest of the condo was good.<br/>Check in and check out very efficient.<br/>Guards at the gate friendly, courteous and helpful.<br/>

unit 1131 There were small things that made the experience a little less than what I expected. There was no light on the balcony. Duck Tape was holding the microwave together.

Beautiful Condo Beautifully furnished large condo. Wonderful porch overlooking the lake. Short walk to the beach. Only disappointment was that the children's pool and splash zone were not available during our stay.

The BEST yet! We had a great time at Cinnamon Beach! Our ten days passed way too fast. The view of the lake from balcony was beautiful. We enjoyed the pool as well as the beach. The alligator, otters and turtles were a joy to watch. This was our first stay at Cinnamon Beach and we look forward to next year.

Enjoyable getaway The unit was clean except that one of the beds had not had the sheets changed (sand in the bed). The location was perfect, just steps away from the beach,and a short walk to the pool area.<br/>The manager was very helpful and courteous.<br/>Though there were some restaurants closer we took a 15 minute ride to Flagler Beach where there is a wide variety of restaurants. We enjoyed Tortugas there.Of course there is a Publix very close to the complex so you have the option of picking up food there and eating in.<br/><br/>I would recommend the unit, and may try to come back next year as the pet friendly aspect was wonderful.Pet pick up bags are provided at many grassy areas which was convenient.<br/><br/>

Unforgettable Memories at Cinnamon Beach My mother, my siblings and I spent four fantastic days in a Cinnamon Beach vacation rental. Although we had a party of eight people, we had plenty of space. We cooked fish fresh from the ocean, we had epic game nights, we watched otters play in the lake, we swim in the pool and hot tub, and we never once worried about our accommodations. Everything about the rental experience was on point. Even when I found out that we had unexpected dinner guests coming, the property managers got a parking pass for our guests with 20 minutes notice. They were very responsive and extremely helpful.

Nice facility, good location Stayed at Cinnamon Beach for the 3rd time this summer - the place has definitely been discovered and was more crowded that previous years. Unit was nice, enjoyed the corner unit layout. More attention could have been paid to upkeep (several lights were blown, some maintenance needed) but overall the unit was fine and met our needs

Steele Vacation July 2016 Could not have been happier. Condo was very spacious, clean and as promised. The building was well kept and quiet. Property as a whole was very inviting and enjoyed our stay very much. Our realtor, Scott, was very easy to work with - responded quickly and accommodated several requests.

Foley's Review It was ok; however, there were concerns. In 2015, they did not finish cleaning my room until 5:30 PM, I showed up with groceries that needed refrigeration, it was not convienent having to carry them to my nieces' room. This year 2016, when I arrived the dishwasher was full, not sure if they were clean so I had to wash them and put them away. The corner of the hall carpet stuck up, two people tripped over it including myself. My room had a lock box with one key, I needed my kids to have access to the room so we had to keep using the lockbox. This was awful, needed a flashlight to capture the code at night. My niece called twice about a second key, two promises they would deliver one but no shows on both.

Our family thoroughly enjoyed our stay. The condo was perfect for us and well appointed. But, there was a lot of noise outside with the construction, power washing, and constant cleaning of the grounds.

This condo is both spacious and convenient, It has a gorgeous view on the lake and its entertaining wildlife. The Cinnamon Beach Rental folks were attentive and pleasant in addressing our needs.

It was ok; however, there were concerns. We stayed at this condo for a week in November and didn't want to leave. It is absolutely beautiful! I spent most days on the hammock on the outside balcony listening to the sound of the ocean. Despite it being off-season and certain amenities being closed, such as the grill/bar by the pools, we had a wonderful time. Most of the boardwalks to the beach were destroyed from the hurricane this fall, but there was one near the condo that was perfectly fine. Our dog loved going on the beach and chasing the crabs at night. Lots of dogs on the beach, very dog-friendly community, with plenty of poo bins nearby. This property is kind of far from major activities, about 40 minutes from St. Augustine, but it was perfect for us, we wanted a place to relax near the ocean. My teenagers were able to hook up their X-box to the TV in one of the bedrooms, so they were occupied when we weren't outside. Everything about this place feels like home.
