Terms

PAYMENT: Deposit is due at the time of reservation. Fifty percent (50%) of the total rent, taxes, and fees shall be paid and received by Agent in the form of a credit card personal check, certified, cashier or bank check or money order within 7 days after the reservation is made, and the balance of rent, taxes, fees and any unpaid security deposit shall be paid and received by Agent no later than thirty (30) days prior to check-in. The security deposit, rent, taxes, and fees may be paid by personal check conditioned upon Agent’s receipt of same more than thirty (30) days before the above-stated check-in date. A valid credit card must be provided no less than seven (7) days prior to check-in whether or not the reservation is paid for by credit card. The credit card will be charged in the event that damages, missing items or excessive use of utilities are not covered by the Guest’s security deposit.
UTILITIES: Utilities are included in the rental amount unless other wise stated, however Agent reserves the right at Agent’s sole discretion to charge Guest for excessive use of utilities if it is determined Guest used any or all of the provided utilities in an abusive or negligent manner. Guest agrees that all excessive use charges will be charged to Guest’s credit card on file and/or withheld from Guest’s security deposit. Guest shall pay cost of all utilities on rentals of more than 30 days unless otherwise stated.
Time is of the essence as to payment pursuant to this Rental Agreement, and any late payments shall, at the sole option of Agent, cause a forfeiture of Guest’s rights pursuant to this Agreement and immediate cancellation of same without further notice to Guest.
CANCELLATIONS: Reservations may be cancelled by Guest with notice to Agent within seven (7) days of the date of the reservation call, and more than thirty (30) days before check-in and any deposit received by Agent shall be refunded to Guest minus a $50.00 administration fee. After seven (7) days from the date of the reservation call, or less than thirty (30) days before check-in, any deposits, rent and fees paid shall become non-refundable if the reservation is cancelled by Guest. In the event of an emergency, Agent reserves the right at Agent’s discretion, to refund on a case by case basis only, part of any deposit, rent or fees paid, minus an administrative fee, upon notice of cancellation by Guest. Any deposit, rent or fees retained by
Agent pursuant to this provision shall be agreed upon liquidated damages, consideration for the execution of this Rental Agreement and in full settlement of all claims.
THIRD: GUEST COVENANTS AND CONDITIONS:
The parties agree that the following are material covenants and conditions of this Rental
Agreement, the breach of which shall result in immediate forfeiture by the Guest of the subject rental premises in accordance with applicable law:
1. Guest shall not damage the rental premises or any part thereof or any personal property or appurtenance therein or thereto, and if the premises, or any part thereof, or any personal property or appurtenance thereto are damaged, obstructed or rendered inoperable by the misuse or negligence of Guest, Guest’s guests, family, agents or employees, Guest shall pay the cost for repair or replacement of same immediately upon presentation by Agent of a bill for same.
2. Guest shall comply with all applicable federal, state, and county local laws, and community rules, regulations, covenants and ordinances including, but not limited to Flagler County, Florida, and the community in which the Guest is staying.
3. Guest agrees not to commit waste or to use the rental premises or any appliances or appurtenances thereof or thereto for any disorderly or unlawful or offensive purpose.
4. Guest shall permit only the people list in Addendum A, incorporated into this agreement by reference, to use and occupy the subject rental premises.
5. No pets are allowed in or around the rental premises at any time, unless specifically permitted by Owner and applicable pet fees are paid at the time this Rental Agreement is executed.
Vehicles identified in Addendum B, not to exceed two (2) vehicles and may be parked on the premises in approved parking places.
Any vehicles not identified in Addendum B shall be towed or removed from the premises at Guest’s expense.
7. In the event the premises become uninhabitable, due to damage from wind, fire, rain, storm surge, or any other cause, and the Owner, at his sole discretion, shall decide not to repair or rebuild the premises, the term of this lease shall end and rent will be prorated up to the time of the damage.
8. Guest agrees not to charge any long distance telephone calls or other charges to the telephone account(s) located at the rental premises. Local calls are permitted.
9. RADON DISCLOSURE: Pursuant to §404.056(8), Florida Statutes, Radon is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time.
Levels of radon that exceed Federal and State guidelines have been found in buildings in
Florida. Additional information regarding radon and radon testing may be obtained from your public health unit.
10. Guest agrees to permit Owner or Owner’s agents to enter the rental premises or any part thereof at any reasonable time for the purpose of examining same, to make necessary repairs, and/or to protect any personal property from damage. Reasonable time for said entry, without further notice to Guest, shall be between the hours of 9:00 a.m. and 5:00 although the parties may agree to additional hours for Owner’s access.
Owner or Owner’s Agent may also enter the rental premises with the consent of Guest, or when necessary in case of an emergency or when the Guest unreasonably withholds consent or access.
11. a. Guest acknowledges and agrees that Owner/Agent may remove or cause to be removed from the rental premises any Guest or guest who, while at the rental premises, illegally possesses or deals in controlled substances, violates any of the terms of this
Rental Agreement, is intoxicated, profane, lewd or brawling, who indulges in any language or conduct which disturbs the peace and comfort of other guests or neighbors, or which constitutes a nuisance, or which injures the reputation, dignity or standing of the
rental premises, or anyone who fails to make payment of rent at the agreed-upon rental rate and fees at the agreed-upon times, or anyone who fails to check-out at the agreed upon time unless an extension of time is expressly agreed to by the Agent and the Guest prior to check out. Admission to and removal from the rental property is not and shall not be based upon race, creed, color, sex, physical disability or national origin. Any notice to vacate may be given orally or in writing by Owner/Agent to Guest, and if in writing shall be as follows: “You are hereby notified that this establishment no longer desires to entertain you as its guest, and you are requested to leave at once. To remain after receipt of this notice is a misdemeanor under the laws of this State.”
b. If any Guest who is asked to vacate early has paid in advance, Agent shall, at the time notice is given, tender to the Guest the unused portion of the advance rent and fees payment without prorating any portion of the day that Guest is noticed to vacate. Agent may retain any security deposit without further notice as agreed upon liquidated damages, consideration for the execution of this Rental Agreement and in full settlement of all claims, or Owner, at Owner’s option, may proceed at law with any damages claim.
Any Guest who remains or attempts to remain in the rental premises after being requested to vacate shall be guilty of a misdemeanor of the second degree punishable in accordance with Florida law. If any person is illegally at the subject rental premises, Owner may call upon any law enforcement officer of this State for assistance. If the Guest is arrested,
Owner shall employ all reasonable and proper means to care for any personal property which may be left at the rental premises by the guest; however, upon arrest, the
Guest/guest shall be deemed to have given up any right of occupancy and to have abandoned such rights.
12. Guest agrees that Owner and Owner’s agents shall not be liable for any loss of or damage to any personal property in or on the rental premises or stored in rooms or places provided to Guest in connection therewith, nor shall Owner or Owner’s agents or employees be liable to Guest, Guest’s family, guests, or agents for failure to repair or maintain any part of the rental premises or property contained therein absent gross negligence. Guest further agrees that neither Owner, nor Owner’s agents or employees shall be liable for any damage to the personal property of the Guest, Guest’s family, guests, or agents arising from theft, vandalism, fire, water, rain, acts of God or government, interruption of utilities, acts of others or other third party or external causes whatsoever.
13. No lifeguard is available on the premises. Guest shall use amenities, pools, beach, ocean with great care and in accordance with any posted rules. All children and elderly, frail adults using said amenities shall be constantly supervised by a responsible adult who can swim. If the amenities are equipped with any safety features such as a fence or other pool or water area barrier, a pool cover, a door latch or a door or window alarm, Guest shall be responsible for correctly operating and using said safety device every time the amenity is used. Any use of said amenities shall be at the sole risk of the user, the responsible adult supervising the user, and the Guest.
14. Guest is responsible for and shall indemnify the Owner and Owner’s agents and hold them harmless from any and all claims, liability, demands, actions, causes of action, expenses, damages, losses or injuries sustained by any person including Guest, Guest’s family, agents, guests or invitees as a result of or arising from the Guest’s subject occupancy and tenancy, including, but in no way limited to claims arising from the use of any pool, hot tub, spa-pool, water area or dock, which are part of the rental premises.
Guest shall also be liable and indemnify Owner for attorney’s fees and court costs incurred by Owner in enforcing any of the terms, covenants or conditions of this Rental
Agreement or which are sustained by Owner as a result of or arising from or during this reservation.
15. Guest may not assign this Agreement or sub-let the rental premises or any portion thereof.
16. Guest agrees that if applicable local and/or state tax rates increase after the time of reservation and before check-in that Guest will pay the additional tax due.
17. Absolutely NO SMOKING is permitted in the residence or on any balconies, patios, etc. attached to said residence unless otherwise noted in writing. Any detection of smoking in the residence will result in automatic forfeiture of the entire security deposit, plus punitive fees.

Lovely home and location Home is lovely - very spacious and generally well kept. Management company was very responsive to 2 issues we reported. Didn’t report this because it was just annoying - lots of white baseboards in house and all are very dusty. Didn’t impact our stay but management company should know this isn’t addressed in cleanings!

Family Reunion/vacation We had a wonderful time at our beautiful vacation home in Cinnamon Beach Resort. First, the entire community is absolutely stunning. All the homes and condominiums are beautiful. The grounds are well kept and landscaping is colorful. Our home was perfect for our 10 adults, a toddler, a 3 dogs. Spacious, <br/>Clean, plenty of beach towels and small coolers provided by the owner. The 2<br/>Pools were great, the family pool had a great setup fir children and adults and the Adult pool was fabulous with the ocean views. Some of us used the gym several days and the community was perfect for bike riding. We had to adjust to the beach with the rocks at the shore line, but we managed. Definitely bring beach shoes. Lots of great little places to eat locally and the Publix right outside the community was really nice and convenient. We would definitely come back again for a great vacation.

Great family getaway We had a great 3 generation vacation where we could all stay under the same roof, use backyard pool and grill fresh fish for dinners. Community center and pools were great, just down/around the block. We had no complaints, would do it all over again. Zero hold ups at the check in for the gated community.

Family get away to rest House had plenty of room was well equipped with everything you need in kitchen and plenty of towels. Nice quiet area with short walk to beach and club house. Only thing that was annoying was that the thermostats were locked and we had to call to get the heat on.

Perfect place for Spring Break Our extended family (my family plus my brothers family) stayed here over Spring Break at the end of March. Ages ranged from 6 to 65. We loved the house - very large clean and modern, the proximity to the beach and really loved the two pools - especially the younger kids just wanted to move from pool to pool to beach. The furniture was very comfortable and modern. I would definitely rent this again, many kudos from all who stayed. The gate is a minor inconvenience and security seems a bit over the top but I am sure the home owners can't do much about this. It would be nice to have free bikes at the house. We went to the Goodwill and bought some.

Great Family Vacation! We visited Palm Coast for a family vacation and it was everything that was described in the posting. We had 10 people staying at the house and there was plenty of room for everyone! The house was well equipped and the game room was a big hit for the kids and adults! Wonderful Vacation in A Beautiful Beach Home! Sunset Key was the perfect house for our annual golf get-together with four other couples. The house is beautifully decorated and so spacious that there was more than enough room for the ten of us. The house was very clean and well-maintained. The location was great, a very short walk to the beach and very close to restaurants and attractions. It is not easy to please ten people but everyone in our group agreed that this was a wonderful place. We would not hesitate to recommend this property to other friends and family. My stay at 12 Cinamon PL. It was super. everything worked well. The east side doos and windows could use some drapes or curtain to shade the sun and keep the inside alittle cooler.

Comfortable house, neighborhood is a hassle. Would not rent again The House was very clean and quite comfortable for 3 families with small kids. Having the beach so close and a private pool was excellent. Kitchen was well-stocked with supplies for cooking. <br/><br/>The gate guard situation was a huge hassle. I supplied a full guest list and my name was still missing. I was the one that made the reservation. Leaving the neighborhood and trying to come back in was ridiculous. We waited 15-20 minutes in line for our turn to go through have our passes scanned. Additionally, I was very disappointed that the Property Management Company did not alert us that the splash pad was under construction and not available. I specifically chose that property over similar homes because of that amenity. <br/><br/>The home is in need of new outdoor furniture as the current furniture is dirty or broken. Some of the pool deck was also taped down with black duct tape in several places. Very unsightly.<br/><br/>In a market saturated with great vacation rental options, I would not rent from this management company nor this home again.

Beautiful Home Great home, very spacious. Pool is a definite plus. Plenty big to accommodate a family of 6-8. Nice kitchen and furnishings. TVs could be bigger, but we didn't take a vacation to sit inside and watch television. Convenient access to beach and club pool. Second year in a row to Cinnamon Beach, nothing but positives to say about resort area, gated access, secure location, easy access to great restaurants, accommodating aspects all around. Great memories made.

Amazing Mother's Day Family Renion Weekend 8 older adult family members from 5 different locations connected at Sunset Key in Cinnamon Beach. The house was perfect as everyone could have their own bedroom AND bathroom. The house had everything we needed and we were able to gather but not suffocate each other. The amenities were fantastic: quiet pool and beach just a block away. John, our property maintenance guy was available and took care of a few minor details immediately. (grill propane tank replacement; trash and recycle bins that hadn't been emptied.) Two points to note, the doors to the patio pool are alarmed--great for young children, seniors had to keep remembering :-) and the staircase to the 2nd floor is steep so those with mobility issues might struggle a bit. There is one master suite downstairs.

Very Nice Home The home was very nice but several conveniences were missing:<br/>1- No handicap bars in showers.<br/>2- No hooks on bathroom door to hang clothes.<br/>3- No extra clothing hooks in bedroom closets to<br/> hang clothes.<br/>4- Need more towel bars in bathrooms.<br/>5- Need shades, curtains or venetian blinds on<br/> windows facing west, these would help keep the<br/> heat out of the home.<br/>6- Garage door extremely noisy when closing. I<br/> believe it need to be re-hung. <br/>7- Rug, on floor in front of front door and in front<br/> of kitchen sink need to have rubber backing to <br/> eliminate sliding. The rug slid out from under<br/> my wife's feet that could resulted in a very<br/> serious accident.<br/>7- Need chairs in all bedrooms and a small table..<br/>8- All shower heads need replacing, they only put<br/> out a small stream of water, which makes it<br/> difficult to take a shower. <br/>9- Hot water pot in kitchen leaks. Once it cools<br/> down water leaks all over the oven range.<br/>10-Water pressure in upstairs shower very low. Again<br/> taking a shower was very difficult.<br/>11.You need to finish decorating the inside of the <br/> home.<br/>I use to be in the home repair business and I know what a home need to be livable. In fact, I fixed a few things during our stay.

Beautiful Sunset Key With my extended family from across the country we gathered in Florida for a family reunion. This home was perfect! Private bedrooms and bathrooms for everyone. It was spotless from top to bottom. If it weren't for hurricane Mathew washing away some of the beach walkways, it would have been perfect! We already have plans to return next year.

Great House and Location! I would recommend this house to anyone and everyone! When we arrived we had a little trouble opening the door but we called and someone was there to help us get in within 3 minutes! House was spectacular when we opened the door, it was Clean and spacious. Beds were comfortable with plenty of pillows and blankets We loved having a bathroom with every room so each couple had privacy. The heated pool was great for morning and night swims after a long day out and about. Frigerator was big but another one maybe in garage would have been nice. We went to Daytona 500 and found the driving distance not long at all. It was close to everything we wanted to do, the beach was about a block and 1/2 away and a short drive to seafood restaurants and bars. Highway A1A is a must drive if you stay. Thanksgiving Vacation This was a great place for our very large group. It comfortably slept nine adults and two toddlers, with some room to spare. <br/><br/>The private bathrooms in three of the bedrooms were a huge plus. <br/><br/>We were overall quite pleased with the entire process. The responsiveness of ownership/management was top-notch.<br/><br/>We made full use of the fitness center, large shared community pool, and of course the beach. <br/><br/>We would definitely recommend this home!!

Sunset Key at Cinnamon Beach, May 2017. First family vacation to Florida. The weather was beautiful. Had a blast with the family at the beach. Great home ..... but Great home in a great neighborhood. Our only complaint was the lack of basic supplies in a rental home of this caliber -- paper towels, trash bags, toilet paper, etc. were in minimal supply with no replenishments provided. Only other complaint was that we chose this property in large part because of its access to what looked like a great kiddie pool. Turned out on a major holiday weekend that it was under construction. Great House for a Big Group This is a lovely home for a large family, a few families, or a group of friends. Our biggest complaint is while the house is more than comfortable for a group of 10, the pool and outdoor area is not. We rented a house with the pool so that we could stay at the house and relax by the pool in private, but we ended up using the community pool (which was still nice, but just not the reason for paying more for the convenience of our own pool). The house is fairly well equipped, however we felt the kitchen could have had a little more. For example, there were not very many plates (just enough for our group, so we were hand washing them between use), virtually no plastic cups, and little things like no measuring cups or spoons. The floors were sandy when we arrived, but the house was otherwise very clean and well maintained. The management company was very responsive and professional. I would definitely stay here again, I'd just know that the pool area is going to be cramped for a big group and I'd bring a few extra items for cooking! The outdoor pool deck area is over 1,000 square feet, which is the maximum allowed for the property, so it's a nice size . We do have 12 chairs and two tables outside and plenty of room to BBQ and enjoy the pool deck. We also have service for 12 in our kitchen for all plates, cups etc plus a top of the line dishwasher for repeated use. The kitchen island holds all the measuring spoons and bakeware and our pantry has over 100 plastic cups. Maybe they didn't realize there are drawers on the island. sunset key Overall satisfied with the layout of the house and its proximity to beach and local amenities. Rental process went smoothly and agent was extremely helpful. Pool and home were clean. That being said, we had some initial trouble when arriving. We'd gotten in early and were told by agent to call house managers for options but unfortunately it proved difficult to get a hold of anyone. (I left 3 voice messages and one email) and none were returned.<br/>The kitchen is massive in size and has a literal arsenal of implements, but lacks quality kitchen wares. Pans were warped, knives were dull, can opener did not function, toaster was of poor quality and the only hot pad was mutilated beyond recognition. Also the broken trash cabinet did not open or close fully. An upgrade is surely merited to reflect the price of the home. “Our fully stocked kitchen” is overstated. One is led to believe that said stocked kitchen has reasonably usable and used equipment, not dirty or shoddy materials. There were also zero pantry items, i.e. salt, pepper, coffee filters or other fairly standard rental homes pantry items. <br/>These things coupled with supplied one-ply toilet paper, pilled sheets, and ivory soap make the house less inviting and take away from its potential. Wonderful Week Sunset Key was a perfect vacation home for a large family gathering. The rooms were bigger than they appeared on the internet and most bedrooms had there own bath. The back patio area was fenced in. We found it very relaxing watching the pond and sunsets while sitting by the pool in the evenings. The community pool and beach were steps away! There is not an ice maker and the pillows were very uncomfortable so I would suggest you bring pillows and ice. Over all, this is a great rental home!

Weekend at the races. This would be a perfect place for a family, snowbirds or golfers to stay. No so much for guys weekend or girls weekend due to the lack of night life activity.<br/>There needs to be a way to turn the back door alarm off if there are no children in the party. my 50th celebration The home and neighborhood were perfect. We all thoroughly enjoyed ourselves. We were a 2 minute walk from the clubhouse, 2 community pools and the beautiful beach. Excellent Vacation Home This house is amazing. Is in excellent conditions, is spacious, feels like new. The heated pool is awesome. Good gas grill. My only constructive criticism is that they should pay more attention to the cleanliness of the grill. Everything else was excellent and I will stay again. We traveled with two more families that have kids and we felt that the house is kids friendly.

I would recommend this house to anyone and everyone! When we arrived we had a little trouble opening the door but we called and someone was there to help us get in within 3 minutes! House was spectacular when we opened the door, it was Clean and spacious. Beds were comfortable with plenty of pillows and blankets We loved having a bathroom with every room so each couple had privacy. The heated pool was great for morning and night swims after a long day out and about. Frigerator was big but another one maybe in garage would have been nice. We went to Daytona 500 and found the driving distance not long at all. The home was very nice but several conveniences were missing:<br/>1- No handicap bars in showers.<br/>2- No hooks on bathroom door to hang clothes.<br/>3- No extra clothing hooks in bedroom closets to<br/> hang clothes.<br/>4- Need more towel bars in bathrooms.<br/>5- Need shades, curtains or venetian blinds on<br/> windows facing west, these would help keep the<br/> heat out of the home.<br/>6- Garage door extremely noisy when closing. I<br/> believe it need to be re-hung. <br/>7- Rug, on floor in front of front door and in front<br/> of kitchen sink need to have rubber backing to <br/> eliminate sliding. The rug slid out from under<br/> my wife's feet that could resulted in a very<br/> serious accident.<br/>7- Need chairs in all bedrooms and a small table..<br/>8- All shower heads need replacing, they only put<br/> out a small stream of water, which makes it<br/> difficult to take a shower. <br/>9- Hot water pot in kitchen leaks. With my extended family from across the country we gathered in Florida for a family reunion. This home was perfect! Private bedrooms and bathrooms for everyone. It was spotless from top to bottom. If it weren't for hurricane Mathew washing away some of the beach walkways, it would have been perfect! We already have plans to return next year.

Great home, very spacious. Pool is a definite plus. Plenty big to accommodate a family of 6-8. Nice kitchen and furnishings. TVs could be bigger, but we didn't take a vacation to sit inside and watch television. Convenient access to beach and club pool. Second year in a row to Cinnamon Beach, nothing but positives to say about resort area, gated access, secure location, easy access to great restaurants, accommodating aspects all around. 8 older adult family members from 5 different locations connected at Sunset Key in Cinnamon Beach. The house was perfect as everyone could have their own bedroom AND bathroom. The house had everything we needed and we were able to gather but not suffocate each other. The amenities were fantastic: quiet pool and beach just a block away. John, our property maintenance guy was available and took care of a few minor details immediately. (grill propane tank replacement; trash and recycle bins that hadn't been emptied.) Two points to note, the doors to the patio pool are alarmed--great for young children, seniors had to keep remembering :-) and the staircase to the 2nd floor is steep so those with mobility issues might struggle a bit. There is one master suite downstairs.
