Terms

The Property Manager (hereafter referred to as "we", "us", or "our") provides rental management services on behalf of homeowners ("Owners") who rent their properties (including the associated fixtures and furnishings)(the “Home”) to guests (the "Guest" or "you") seeking accommodations on a short term or long term basis (collectively, the “Services”). We are the Owner's property manager and authorized agent, who will perform the Services related to your reservation. By using the Home and Services, you agree to comply with and be legally bound by the terms and conditions of this guest agreement (the "Agreement"). This Agreement only applies to short term rentals and not long term rentals, which will be governed by the specific terms of your lease agreement with us.

1. Policies: Please treat our Owner's Home with the care you would at your own home and abide by following policies:

*Behave as you would in any home in which you live, with respect for property and neighbors.
*Unless otherwise stated in the Home listing, you must be over the age of 25.
*You will be an occupant of the unit during the entire reserved period and other occupants of the Home during your stay will be family members, friends, responsible adults or children under direct adult supervision.
*Do not exceed the maximum occupancy of the Home.
*No parties, noise that can be heard beyond the home lot line or in adjacent units, or any illegal activity may occur at the Home.
*No pets are allowed unless otherwise noted for specific properties and where you have paid a pet fee in connection with your booking in advance of your reservation.
*No smoking is allowed in or around any Home.
*Check-in time is 3pm and check-out time is 10am - we will notify you via email in advance if early check-in or late check-out will be available.
*Please use common courtesy at the home by keeping it clean, reporting any problems or damages, washing dishes as used, taking garbage to the outside bins, leaving towels in the bathrooms and sheets in the bedrooms, and not re-arranging furniture.

2. Cleaning: Each home will be cleaned and inspected by third-party cleaning contractors after your departure. We ask you to help us enable the cleaning crews as much as possible. They will appreciate simple things like leaving the home tidy, running the dishwasher, starting to wash the towels, and taking out the trash.

3. Swimming Pools, Hot Tubs, or Beach: If the home that you have reserved includes a pool or hot tub, or is on a beach, these can all be obviously dangerous. Guests should observe and adhere to all rules and policies as posted at the home and supervise all children at all times. Lifeguards are not provided. Decks and patios can be slippery when wet and can result in injury to anyone who is not careful. Guest accept and assumes all risks involved in or related to the use of a pool, hot tub, beach and deck/patio areas.

4. Home Damage Waiver: Each guest will be offered an optional Damage Waiver that protects you against unintended damage done to the Property. This is not insurance, and the Damage Waiver does not apply to intentional damage done by the Guest or your guests, or excessive wear and tear due to parties, smoking, pets or otherwise, or additional cleaning charges due to stains or spills, or fines incurred by the police or HOA due to noise, excessive trash or parking, or damage over the purchased amounts of either $3,000 or $5,000. If Tenant does not wish to purchase this Damage Waiver, a security deposit of $3,000, $5,000, or greater depending on Property will be required at the time of booking. If a Home requires an additional security deposit, we will explain this to you before confirming a reservation. Guest acknowledges that any damage or fines not covered by the Damage Waiver or above the amount of any security deposit can be charged to Guest (and Guest’s card on file). The Damage Waiver can be purchased up to the day prior to your reservation but not after it has started. You do not have to purchase this Damage Waiver. Please contact the Property Manager directly at if you do not wish to purchase the Damage Waiver.

5. Excessive Wear and Tear, Noise and Occupancy: If excessive wear and tear is found for the Home, or additional cleaning is necessary due to spills, trash left on site, stains to furniture, carpeting, linens, paint, wallpaper, or flooring, Guest authorizes the Property Manager to charge Guest for additional fees. Tenant will be provided with a receipt for any additional fees incurred upon request or as required by local laws or regulations. If at any time the maximum number of the Home’s occupants is exceeded or if we receive information about excessive noise, the Property Manager has the right to evict Guest and all occupants immediately and to charge Guest a minimum service fee of $250 with no refund for the balance of the remaining reservation. If any sign of smoking is discovered Guest authorizes the Property Manager to charge Guest an additional minimum $500 cleaning fee. Unless the reservation for the Home specifically allows a pet, if any sign of a pet is discovered, then Guest authorizes the Property Manager to charge Guest an additional minimum $500 cleaning fee. The Property Manager will return any balance of a security deposit to Guest, less any charges or amounts owed by Guest, within fourteen (14) days after the end of the reservation or as otherwise required by local laws or regulations. Any charges owed by Guest may be charged by the Property Manager to Guest’s card on file in addition to seeking any relief provided by law.

6. Maintenance and Access: We have the right to enter the home at any time during guest stay and we will diligently attempt to address maintenance issues as they occur. This is an associated risk of renting a single family residence or condo. If a maintenance issue occurs that cannot be fixed in a reasonable amount of time, and significantly affects your stay; we reserve the right to refund at our discretion or offer to relocate you to another home.

7. Phone and Internet: Unless otherwise specified, all homes are equipped with a high-speed Wi-Fi connection where service is available and we will provide you with any required Wi-Fi passwords. We do not provide a land line phones for all homes and suggest that you please use your mobile phone or Wi-Fi enabled phone for calls.

8. Furnished Rental and Supplies: The Property Manager's properties are fully furnished properties that will include bedspreads, linens, blankets, pillows, towels, a fully equipped kitchen, TV, furnishings unless otherwise specified. A limited starter supply of paper products, bath and dish soap are provided, but will not be replaced if consumed during your stay so we recommend bringing additional personal items with you. Staples (salt, pepper, foils, wraps, etc) are generally stocked by the owner of the home, however the Property Manager cannot commit these supplies being present. Guest is responsible for replacing stocked items as they are consumed. If there is a special type of item you are accustomed to using please provide for those items by bringing them with you. Extra towels are always recommended for homes on the beach, or with a pool or hot tub.

9. Weather and Other Unforeseen Events: The Property Manager does not accept liability for any inconveniences arising from any temporary defects or stoppage in supply of water, gas, electricity or plumbing, damage caused by weather/road conditions, natural disasters, acts of God or other reasons beyond its control. No refunds will be given for any delays or cancellations due to such conditions. Travel Insurance is highly recommended for any stay.

10. Homeowners Association: The Property Manager cannot warrant the usability or condition of amenities provided through homeowner associations, including, but not limited to pools, hot tubs, club houses, tennis courts, golf facilities, and picnic & beach facilities.

11. Indemnity: Neither Owner nor the Property Manager assumes any liability for loss, theft, damage or injury to Guest, his/her guests or other occupants in the Home. The Guest, for himself/herself, his/her heirs, assignors, executors and administrators, fully releases and discharges Owner and the Property Manager from any and all claims, demands and causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the Guest, his/her guests or other occupants of the Home as a result of, or in connection with the occupancy of the Home and agrees to hold Owner and the Property Manager free and harmless of any claim or suit arising therefrom. In any action concerning the rights, duties or liabilities of the parties to this Agreement, or their principals, agents, successors or assignees the prevailing party shall be entitled to recover reasonable attorney fees and costs.

12. Sale Contingency: In the rare event the Home that that you have reserved is for sale, and/or is under a contract to sell, the Property Manager reserves the right to provide Guest with a comparable home at no additional cost to the Guest. Showings during occupancy are by appointment only at your prior approval.

13. Payment and Cancellations: We accept all major credit cards. For reservations made more than 30 days in advance, we only charge a deposit of 10% of the total reservation upon booking, with full payment due 30 days prior to check-in. For all reservations made within 30 days of check-in, we collect payment in full at the time of booking. All reservations which are made more than 10 days in advance are fully refundable if the guest cancels the reservation within 72 hours after the time of booking. After this cancellation period expires, all guest payments are non-refundable.

14. Other Terms and Conditions: Your booking is subject to the the Property Manager 's Terms, Privacy Policy and this Guest Agreement which can be found at /terms. Additionally, where specifically required by the terms of any applicable laws, regulations or Homeowner's Association rules (as determined by the Property Manager), then this Rental Agreement shall constitute a lease of the premises. If you would like to extend your reservation for additional dates, please call us for availability and pricing.

Great location This house is in a nice area that’s not too close to all the touristy stuff and not too far from the mainland. There is plenty of room for hanging out with a large group and plenty of privacy too. No shortage of towels and basic necessities. If you’re planning to cook, you’ll need to bring your own supplies as there are no bowls for mixing or much of anything else to cook with. The house could use a really good cleaning overall. We would stay here again.

Great spot at Lost Colony Wonderful! House was as expected. Kitchen had sufficient tools to cool all meals. Beds were comfortable. About 10 minute walk to the beach.

Excellent Stay Everything was as expected,great beach access.Definitely a good walk but not a trek. Bring a wagon to carry all your stuff. House was great with the big upstairs kitchen and kitchenette down stairs. Lots of sliding glass doors for the ocean breeze. Under deck space was awesome for our six hammocks.<br/>

Good Stay Rental was ok. Furniture is a little outdated and home needs a good deep cleaning. A towel in the downstairs unit was put out as clean but had a red stain as it had been used. We had an issue with the toilet, which I called and we had a quick response and toilet got fixed. Best Family Vacation My family and I loved the house! The location was great, the walk up to the beach was not bad at all. I wish we had access to the parking lot on the other side of the gate at the end of the street but like I said the walk was not bad at all. With 4 kids and one of them being four years old he did not complain walking about 2 minutes from the house. We rented the house for a couple of days during the week so it was very quiet. Loved to barbecue and had a great diner outside. The only complaint would have to be that it was not clear that the downstairs was not accountable from inside the house. Our 16 year old took the downstairs so it was not that big of a deal she didn&#x2019;t really mind having her own apartment for a couple of days lol. Over all it was a great experience and I would love to rent this property again from TurnKey. Lost Colony Villa #37 rental Overall, we were satisfied with our stay. It was nice inside with seaside decorations. The main floor was quite adequate. The downstairs was slightly disappointing, as there is no inside connecting stairs. There were not enough towel bars/hangers for the number of guests we had staying below.<br/>It takes about 8 minutes to walk to the beach; not ideal, but doable, and not 15 minutes as mentioned in the rental description. It was disappointing due to misleading photos for the swimming pool. It was tiny. The main swimming pool is not available for villa guests, only for house guests right next to the beach.<br/>I would rate this rental , compared to the rentals we've used over the 20 years we've been going to Mustang Island, as average. We've stayed at much nicer places that were cleaner and closer to the beach. I doubt we would rent this house again. A wonderful family vacation We had a wonderful vacation.The house was great for our needs. The only problem we had was the patio door handle in the dining area was missing a screw. In the down stairs house there was no curtain over the patio door. My daughter was putting my grandson down for a nap while the men mowing were walking back and forth across the patio passed the door. They never looked in but would have made me feel better about her being down there. Especially at night. Port A Vacation The location, area, and views were great. Nice place for a short visit. We stayed 75 days, too long for this house. The washer/dryer was in bad shape and had to be replaced. It took 5 weeks to do this. The refrigerator temperature wasn't adjustable so many of the products inside froze. Never got fixed. The fill valve in the hall bathroom is defective. Never got fixed. The toaster failed. I just replaced it. We also had trouble with the oven. It wasn't cooking right. The new washer on/off button receded. Never got fixed. Very small pantry. I asked to see another unit that I considered for next year but TK doesn't allow previews of the homes, So, I rented someplace else for next year. I was disappointed in the upkeep of this house, although it was decorated very nicely. Multi family friendly beach house We had a family of 5 and 3 dogs. The only down fall to the house is that when we arrived we found the only way to get from the downstairs to upstairs part of the house was by the outside stairs. Not a big deal for us since our childeren are much older but it limits family time when the point of a family vacaction is to be together. This house would be better suited for seperate families vacationing together. It&#x2019;s a duplex style set up. <br/>We ended up not using the down stairs except for the restroom and everyone stayed upstairs. <br/>Other than that detail the house is very cute, clean and in a great location. Loved the neighborhood and the walk to the beach was perfect for the dogs and us to stretch our legs. Only a 5 min walk. We liked that it was quiet and secluded and the beach was private. For 2 days we were practically the only people out there. Going mid week helped out with that. Water was clear and cool. <br/>We would definitely stay here again but will be bringing another family or friends with us.

Birthday beach trip We had a great time! Plenty of room for 6 adults and a short walk to the beach and had everything we needed for a 3 night stay. We didn't use the dishwasher but the door doesn't work and n eeds to be replaced. It's a beach house not a 5 star resort... Wife's birthday and work vacation. We had a great time hadn't been to the coast in several years. The place was very clean with everything that you might need. For the price you couldn't ask for a better place to stay. Had a rep show up as we arrived to see if we needed anything, just had one issue with the BBQ pit and he took care of it right away. Beach Vacation The property description was very accurate. When we arrived it was very clean. The only thing is the couches and hammocks outside have a little wear on them. Port Aransas Stay 9-17-2015 The rental unit was great and clean. It does have some maintenance issues -- dishwasher needs to be re-installed more sturdily, pull chains on ceililng fans needs replacing, and we had intermittent performance from the TV in the living room. Someone from Turnkey came out and could not fix it either, so hopefully it has been reported. Overall, I would definitely recommend this rental company and the unit. Unforturnately the Red Tide was present along the beach where the unit was located, but no Red Tide closer into Port Aransas. Not good The unit had numerous maintenance issues including a part of the floor which sank when walked on. And it was dirty. Really dirty. Kitchen had to be cleaned before we could cook in it and both bathrooms were dirty. Would not stay here again. And i called 3 tumes during our stay and was called back 2 days after returning home. Beach House - You can see the dunes from the upper deck. The downstairs was really dated, but had a beach house theme. The upstairs was totally separate from the downstairs, with stair case on outside. The upstairs was much newer and more of a modern theme, nice decks.The beach was a little trek down the drive, around the condos, down the boardwalk to the beach. Hint - Drive your stuff to the on the beach using access road 2 miles down the road. Beware of some of the eating places in Port Aransas- Quite the tourist traps. Disappointed with our stay facilities We were very disappointed with the rental house. Bathrooms were non operational. We booked the house for 12 people and the sleeping arrangement was only for 8 people, no blankets, pillows, towels. Broken and smelly kitchen sink. Port A Beach House Review The overall experience was great. Lost Villa I enjoy the Lost Colony area as the beach is very nice and not too crowded. So, I try to stay in this area. This was the first time that I had problems with a house in this neighborhood. First, the beds were different than the pictures online. So, it messed up the sleeping arrangements that I planned for me and my guests. There was no pantry to store our food in. So we had to put our food all over the kitchen counters. There were no pot holders, no dish towels,etc. This made it difficult to remove food from the oven and dry dishes as there were few dishes to use for a crowd of 8-even though they advertise up to 12. The dishwasher door fell fast and hard onto my foot as I opened it. The door opens all the way to the floor! Others in my group had their foot smashed by this door too. We did not have an extra trash bags. The grill was an old propane grill now being used as a charcoal grill. It was very difficult to cook on as the rack did not fit right and was slanted. The downstairs toilet flooded the bathroom. It leaked from the bottom thru the tiles and ran outside onto the driveway. We cleaned it up as no one was available to come out for a few hours. We ended up using our towels. Outside the home was overtaken by mosquitos. We could not use the deck due to mosquitos and that the deck boards were warped and many were not attached to the frame anymore. One could easily trip and fall over these warped boards. It looked very insecure. When we first got there, there was water dripping from one ceiling fan onto the coffee table in the living room. The door lock code was a 10-digit number. This is inconvenient as it is hard to memorize. You will need to keep your phone with you to get back in! I love Port A but will be careful to which house I choose next time in Lost Colony area. Nice but needs work The house was lovely but very put dated. The washer and dyer, the couches, the bedding especially in the master the comforter was torn and needs new pillows. The patio furniture was very out dated and faded. The stairs are a little scary to climb to go up and down. Maybe needs a rail for help. The kitchen was well stocked with cooking supplies. The towels need to be changed for newer ones they were cleaned but felt rough and some had make up stains in them. The walk to the beach isnt too far like 10 mins. I would suggest bringing a wagon to load up your beach stuff on to carry over. The hammocks were a nice touch very relaxing and peaceful. The downstairs had a lot beach gear in the closet which was nice. Not too far from the pool just right across the street. I liked this house it just needs some updating. I would recommend this house to a family it was an overall fun time. We will definitely rent from lost colony again. Great Place for a family of 12 This home was exactly what we needed for our family trip. The up & down stairs are completely separated, which was perfect for a family with early 20's year old children. SO the adults (>40yrs)stayed on the second floor and the young adults stayed in the loft space area down stairs. The beach is about 7 min walk...not bad at all. We took the advice of another review and drove to the entrance of the beach entry to unload our coolers and beach stuff. Everything in the home worked and it was very comfortable. I would suggest bringing cooking spices/salt/pepper and grill...the grill was about to fall apart but it held on till we got done with the meat. We also noted that there was not a broom, but we didn't make to much of a mess...we would have swept had there been a broom /:<br/>Other than that, this home was a nice place and housed our family comfortably. <br/>We hope to visit again. I had a roof over my head and I was at the beach.... House was where I rented it...got there and it was very dirty. There were clean sheets on the bed though. Fridge smelled horrid, dirty floors and doors, toothpaste in sink basins, no towels for everyone and no washcloths.Cleaned the whole house myself before my friends and family came. Knew that the oven was due to get fixed the week we were there, but no one answered me(texted, left phone message, emailed AND talked face to face)about the condition of the oven(cookable-it wasn't ruined a dinner and breakfast) and if the repair could be done later than 8am on my vacation. Repair man came at 7:54. That same day another repair man walked right in to fix the dishwasher. Unannounced and scared the **** out of me. Wifi didn't work and TV had difficulties. Turnkey NEVER got back to us. The lock downstairs jammed and Turnkey did not get back to us on that either. I called and stayed on hold 40 minutes till Lara answered and she saved my sanity. She said all the right things and did refund the housekeeping fee and $200 for food. It was a start but it just kept going. No communication from local Turnkey. Port Aransas Family Trip The home was not clean when we arrived. We were charged extra for housekeeping, but we had to pick up chips off of the rug and we tried to clean the floors with paper towels. There also were not enough towels in the home for the number of people that they are advertising it for. On the last morning we were cooking breakfast, but in 30 minutes the oven only heated up to 165 degrees. We had to toss the uncooked food. Lost Colony #37 Norbert Property was not clean. BBQ grill not functional had to have a new one delivered. Beds skirts lower level were very dirty. Very poor collection of cooking pots and pans. Property needs serious updating and maintenance. Cushions for outdoor furniture are all torn. amazing We are frequent visitors to the area but never have rented a beach house. The house we stayed in was beautiful and clean. First AirB7B experience in Port A Unfortunately we were very disappointed with our stay in this home. Over half of the beds were located downstairs, which would have been perfect for our family, however the throw rug was soaked and concrete floor wet and there was a musty smell to the lower level that was unpleasant. Since there were no screens on the windows, it could not be aired out. I called Turnkey to see what could be done and left a voice message, but they did not return my call.<br/>Also, outdoor cushions with furniture were worn to shreds. Indoor pillows on couches and chairs very old and musty. Even before the electrical storm, one side of the house had no electricity to its outlets.<br/>Also poorly supplied with essentials. Unsafe and too close to the road It was old and tired with a soft spot in the living room floor which indicated some issue with rot in the structure. The wind blew the circuit breaker box open and my husband went to close it to find everything inside totally corroded.<br/>The mosquitoes were so bad as it was in a marsh that we couldn't open the windows the entire trip as they would swarm in. Though listed as beach front it was actually a quarter mile walk to the beach and it was close to a very busy road which would be dangerous for children and was very noisy. The rental unit was great and clean. It does have some maintenance issues -- dishwasher needs to be re-installed more sturdily, pull chains on ceililng fans needs replacing, and we had intermittent performance from the TV in the living room. Someone from Turnkey came out and could not fix it either, so hopefully it has been reported. Overall, I would definitely recommend this rental company and the unit. Unforturnately the Red Tide was present along the beach where the unit was located, but no Red Tide closer into Port Aransas.

Our 3BR/3BA beach house is located across from the community pool in Lost Colony, a neighborhood only steps from the Gulf waters in Port Aransas. The first level has a studio apartment layout, with the sleeping, living and a fully-equipped kitchen areas combined in one main room. This space comes complete with a large sleeper sofa, a futon, two queen-size beds, a TV with a DVD player, and a full bathroom with a shower/tub combo. Ascend the outside stairs at the right of the house to gain entry into the second floor suite, where you will find the well-appointed main living room, dining room and kitchen.
