GUEST AGREEMENT

PLEASE READ CAREFULLY
This contract constitutes an agreement between the Guest and the property Owner, represented by the Property Manager.
For Guests staying in the following properties, there is a mandatory resort fee in addition to the rental rate:

WAIPOULI BEACH RESORT (Beginning January 1, 2014) - $12/day (included with rental fees)
HANALEI BAY RESORT - $15/day (to be paid at check in at front desk)

DEPOSIT, PAYMENT AND CANCELLATION POLICY: Upon confirming your reservation, 25% of the total amount is required upfront upon booking the reservation. The final payment, including taxes, is due no later than 60 days prior to Guest’s arrival date. Expenses (including, but not limited to: extra clean fees, room charges, telephone charge, cable television charges, utility etc. ) incurred during your stay will be charged against Guest’s credit card.

Reservations not paid in full sixty (60) days prior or by the listed due date shall be subject to cancellation and forfeiture of all monies. Each property is individually owned. Rental fees are not transferable from property to property. If Guest’s check is returned by the bank, Agent reserves the right to require payment to be made by certified check or money order including a service charge of $50.00.

If cancellation is made at least 90 days prior to scheduled arrival, all monies will be refunded less the processing fee of $90.00 and up to $165.00 for larger homes. If cancelled less than 90 days prior to arrival, the 25% booking payment upon confirming will be forfeited. Cancellations made less than 60 days prior to arrival will result in forfeiture of the rent and taxes, with the exception of the cleaning fee and Security Deposit (if applicable). Guests are responsible for the entire time booked. No rental refunds are given for early departure or late cancellation. All cancellations must be made in writing (email and Fax acceptable). We do not make exceptions. In order to protect your vacation payments we strongly suggest travel insurance.

TRAVEL INSURANCE: You are a valued guest and we want to do everything possible to make your trip enjoyable and worry free. Because the unforeseen and unexpected can occur before you leave or when you’re away from home we recommend CSA’s Vacation Rental Insurance Plan. The premium for Vacation Rental Insurance can be included in the cost of your rental. Vacation Rental Insurance reimburses for pre-paid non-refundable expenses due to certain unforeseeable circumstances that may cause you to cancel, interrupt or delay your trip. Please review our cancellation policy in this Agreement.

TRUST ACCOUNT: The Deposit, the Final Payment, Security Deposit (if applicable), and any other fees will be deposited into Agent’s trust account at First Hawaiian Bank, Princeville, HI 96722.
CONDITION OF PREMISES: The property and its contents are privately owned, withthe Property Manager acting solely as the Owner’s Agent. It is rented with Owner’s furnishings and neither Owner nor Agent will be responsible for providing any additional furnishings or equipment. No items belonging to Owner shall be removed from the property. Any household appliance and equipment malfunctions reported will be handled as quickly and professionally as possible during normal business hours. In the event of an after- hours emergency, please call Cyrila Pycha at. Guest agrees to keep it in good, clean condition.

Additionally, the Property Manager shall not be responsible for any loss, expense, damages, claims or injury direct, indirect, consequential or otherwise caused by reason of military actions, acts of God, or by any agents, employees, subcontractors, servants or services as provided.. Should the contracted property become unavailable, the Property Manager will act in good faith and use its best efforts to substitute with accommodations or services of a type comparable to those contracted. The Property Manager in their sole discretion reserves the right to refuse or discontinue service to any person(s) and/or to rescind any contract for accommodations or guest services. The Property Manager will not be liable under any circumstances, including substitutions, to refund any unused portion of booked accommodations or services. The Property Manager is not responsible for valuables left in rental properties.

Guest authorizes Agent to repair damages or losses caused by Guest or invitees of Guest, at the expense of Guest. Guest accepts responsibility for the acts of their children, visitors or guests and service animals. Guest will not remove or rearrange inside or outside furniture. Guest renting homes/condos with air conditioning for thirty (30) days or more will be responsible for excessive utility billing.

PESTS: Hawaii is a tropical climate in which insects, rodents and lizards unfortunately thrive. All properties are on a quarterly maintenance program, but Guest may encounter these pests during stay. Contact with a “pest” inside or outside of Guest's rental is not reason for termination of this agreement. If this does occur, please contact the Property Manager to make a report as a trouble call will be scheduled.

GAS GRILLS: Gas grills are not allowed at Condominium projects. Charcoal BBQ's and Hibachis are prohibited in all properties unless already provided. Any reported illegal use of a gas or fire barbecue from the association will result in a fine, which will be charged against your credit card account.

MANDATORY OCCUPANCY DISCLOSURES: It is mandatory to disclose the exact number and names of guests who will be occupying the premises during the rental term. Guest must immediately notify Agent, by phone and/or in writing, if the number of occupants changes. Additional charges may apply. The premises shall be used for residential vacation rental purposes only. Special events such as parties, receptions, etc., shall not be allowed without the express written consent of Agent. Shall guest refuse to adhere by this policy, additional charges may apply. In no event shall the premises be sublet or this agreement reassigned without the written consent of Agent.

CHECK IN / CHECK OUT: We want you to enjoy your stay and when possible will accommodate early check in or late check out. However, we are not always able to do so. Guest agrees to abide by stated check in / check out times unless express permission is given by rental agent.

SUBJECT TO CHANGE: Advertised amenities are subject to change without notice or compensation. Changes can occur after a reservation is made as a result of sale of unit, remodeling, mechanical failure or servicing. Should a property be made unavailable for any reason beyond the control of Agent, Agent may substitute another like or better property. If no other property is available the limit of liability by property Owner, the Property Manager or its Owners, is to refund any pre-paid rents that have been paid by the registered Guest.
SECURITY FEE: A non-refundable security fee is included in Guest's rent in lieu of requiring a Security Deposit. This is intended to limit out of pocket expenses from accidental damages to the leased premises or contents during the guest stay. A description of the Security Fee can be found at for review and is incorporated herein by reference. PLEASE READ IT CAREFULLY. In order to honor a claim under the security fee guidelines, Agent must be made aware of any damage prior to check-out.
SECURITY DEPOSIT: In the case of Special Events (e.g. Weddings, Graduations, etc.) a Security Deposit is required. Guest agrees to be responsible for any damage to the Premises or its contents. The Security Deposit shall be applied to actual damages caused by Guest. After Guest's occupancy, the Premises will be inspected to determine if such damage or theft including additional cleaning, has occurred. In such event, Agent shall deduct the cost of such damage or theft including additional cleaning from the Security Deposit and Guest will be notified in writing. In addition, Agent may deduct from the Security Deposit the amount of any long distance or per call telephone charges and cable television charges such as but not limited to pay per view movies that may have occurred during the dates of Guest's rental period. Agent shall apply, account for, or refund Guest's security deposit within forty-five (45) days following the end of the tenancy.
HOUSEKEEPING:

The property has been cleaned and prepared prior to Guest’s arrival. Fresh linens and towels are placed in the property along with a starter supply of soaps and paper products. Additional supplies that may be needed are the responsibility of the Guest. Each property is equipped with a washer and dryer. Excessive use of the linens and towels resulting in extra loads of laundry upon check-out is subject to additional charges. The Cleaning Fee stated on the Agreement is subject to change.

Daily Maid Service is not included.

In addition to your one-time out clean fee, mid-stay cleaning(s) and/or deep cleaning(s) may be required for extended rental periods of thirty (30) days or more at guest’s expense. Please notify our office at least one week in advance of your arrival if you wish to make these arrangements.

Please note that animals are not allowed, however, in the event a guest requires a service animal and has proper documentation for said animal; there will be an additional cleaning charge applied to the final balance.

PHONES: The private phones in each unit are for Guest's convenience. Local calls (Kauai) are free. Please charge all long distance calls to a credit card or third party.

OWNER’S CLOSET: Locked closets reserved for Owner are not to be accessed by Guest.

RULES, REGULATIONS AND LAWS: All properties are SMOKE FREE. Any smoking is to be done 20 feet from any entrance of the property per Hawaii State Law. Detection of any smoking within the property is subject to a $450 fine to guest. Our rental properties are located in residential areas and guests are asked to be considerate of neighbors' privacy and right to quiet enjoyment of their homes by keeping any noise at acceptable levels. Guest will take all reasonable steps to assure that property occupants adhere to the Rules, Regulations and Laws that affect the property, Homeowner’s Association, the Property Manager and the State of Hawaii.

Customer understands that the owner of this rental retains the right to sell their rental or change management companies at any time. In the event the vacation accommodation is sold by the owner or transferred into a new management regime, the Property Manager, acting as an intermediary between you and the Owner, will use its best efforts to provide a substitute vacation accommodation of equal or greater value. If the Property Manager is unable to find such accommodations, then at the Property Manager or customer's option this Agreement shall be cancelled and terminated and the Property Manager, acting as an intermediary between you and the Owner shall refund to customer all payments made by customer under this Agreement, and the Property Manager and customer shall thereafter not have any liabilities or obligations to the other arising out of the unavailability of the rental property and/or customer's travel arrangements.

Customer acknowledges that the rental owner and/or their agent retain the right to enter the rental for any legitimate reason, including showing a prospective buyer the rental, by giving customer at least Twenty-Four (24) hours notice of such showing.

NON-LIABILITY AND INDEMNIFICATION OF OWNER AND AGENT: Guest agrees to hold harmless and indemnify the Owner and Agent from any and all costs, expenses, legal proceedings, legal fees, suits, claims, or demands, whether from loss of life or injury to Guest and/or invitees of Guest, unless same was due solely to the willful act or gross negligence of the Owner or Agent.

The above rental information, while deemed reliable, is not guaranteed. Changes in inventory and or decor occur from time to time and such changes will not void or alter the terms of the rental and is not a valid reason for cancellation.
AGREEMENTS: Signing this Agreement and the Rental Agreement constitutes a contract, namely:
1) Acceptance of all terms, conditions, policies and procedures detailed therein.
2) Acceptance of full financial responsibility for late departures, any loss of inventory, excessive housekeeping and damage or repairs due to abuse or neglect for the property occurring within the duration of your stay.
3) All disputes arising out of this Agreement shall be subject to the exclusive jurisdiction and venue of the Hawaii State courts of Kauai County, Hawaii, (or, if there is exclusive federal jurisdiction, the United States District Court for Hawaii) and the parties consent to the personal and exclusive jurisdiction and venue of these courts.
4) Customer agrees and acknowledges that this rental arrangement is not subject to the residential landlord/tenant code of the state in which this rental is occurring (such as the Hawaii Revised Statutes chapter 521) since this is not a long term residential rental.
5) Acceptance of rental charges as stated on page one of this rental agreement.

Any alterations made to this Agreement by Guest without the approval of Agent, renders this Agreement null and void.

Clean with Everything The location was great and the place clean. Beach towels, chairs, and body boards were available. The neighborhood was peaceful and the driveway and garage were huge amenities to have. Air conditioning worked great (most places do not have AC!).There is some street noise from the main road in the back and the water pressure is low in this area. These are nit picky things to mention because they did not take away from the location and well maintained condo. I felt it should be noted for those expecting perfection (This place is as close as it gets, we have been to Kauai multiple times). We will book this place again.

Right near the golf club A well eqipped unit. The beach gear was a bonus & very handy when visiting the beaches. The unit was right next to the golf course. As it was on the corner the traffic morning & night was noisy. The outlook over the mountains was magificent especially after the rain as lots of waterfalls. You need transport to stay there. There is a path to the village about a 25min walk. Very comfortable.

Princeville Plantation #111 We had a great stay. The place was well equipped for our family of four and the beds were great! The condo is in need of a few updates (sliding doors that don’t slide, blinds that we didn’t allow the kids to adjust for fear of breaking them,a very fussy dishwasher and poor water pressure in the showers) but overall in good condition.<br/>However it was clean and as pictured in its ad.<br/>The biggest down fall to this unit was the location in relation to a busy street. The street noise was constant, daysnd night. If you are a light sleeper it is a big downfall.

Princeville Condo Unit was the perfect size for us and location fantastic. Only complaint was traffic noise and could have used a few more/better pots and pans. Other than that we really enjoyed our stay in spite of heavy rain and flood warnings for more than half our time there...

The Good and the Bad It was noisy from traffic and the drain system in both shower needed to be clean( i personal clean it myself but needs attention) . Water pressure seam to be low if both showers are in operation. Otherwise the condo was okay if you're not in the condo. One thing that the shower head in the guess room was ready to fall off so I had to tighten it. Wonderful Week! We woke up and had coffee with the mountains and a waterfall in the background each day! We can't wait to come back to Kauai and can't imagine staying anywhere else. This rental is in perfect condition, and it really felt like home for the week!

Island oasis We really enjoyed waking up every morning to the view of mountains while drinking our morning coffee. This unit is in a nice neighborhood. It is fully equipped with beach towels and laundry services. The fans kept the bedrooms cool and lulled us to sleep every night.

Excellent Condo, Terrible ReMax Conceige Service The condo and the area was amazing! The ReMax Concierge Service was terrible. Received an email from the Concierge saying if I needed any help with activities to send them an email, so I did. Three weeks went by not a peep, not even a hey we received your email and we are working on it. Three days before departure received an email from Concierge saying we arranged your activities for you please send credit card information. They didn't even say what they arranged or how much it was going to cost me. Comfortable, clean and awesome location!! My friends and I had a wonderful and comfortable stay! Very clean and wonderful location! The only thing we wished was operating was the DVD player with instructions on how to operate the TV. Other then that, we had a great time!! Wish we were still there!!! The process of booking this property online was easy and efficient. The location on the north shore of Kauai is beautiful. The condo was very clean,well appointed and quiet. There is some noise from the road that runs along the unit but not enough to be a distraction for us. I would recommend this property to family and friends. Thanks for the use of your home. We look forward to coming back in the future. Plantations 111 is a great vacation property! Clean, comfortable, had everything we needed. Great location accessible to Island spots we wanted to visit. Loved the hot tub! Only one issue, the dishwasher didn't work properly we called the technician. Hope the dishwasher is replaced because we'd like to go back!

Pfeifer Family Vacation at Plantations # 111 My rental vacation stay was nice. We did however experience a slow clogged guest bath tube, rather large **** roaches in kitchen and guest restroom ( due to filthiness)there were wet dishes put away in kitchen closets and wet towels in bathroom closets, rear door leading to garage had screws and bolts coming out of lower portion of door frame and the worst of all the over freezing of AC Unit. AC unit would freeze over everyday and heat up home to over 81 degrees. hotter inside then outside. We had maintenance man out and he removed an extremely dirty filter from AC and after it had drained water all over floor, unit was turned back on by maintenance man. There continued to be problems with AC Unit. I wouldn't recommend unit to people with small kids because unit is not kid friendly. There was way too much glass property inside and unit to close to major road for outside playing. Over all Unit worked out for us. We had already paid in full for rental unit with nowhere else to go on an unfamiliar Island. Cute Beachy Condo My family and I really did like the look of this condo. The decor is quaint and there are many good books about the island in the bookshelf. The beds were all pretty comfortable and the bathrooms are nice and big. The downside to this rental is that the dishes were not cleaned properly. The dishwasher did not properly clean the dishes and the pans in the cupboard were scratched theplon or some non cast iron type. I was excited to have a dishwasher as i do not have one at home but unfortunantley eneded up washing dishes on my vacation. Beautiful This was the best vacation ever. My husband and I and a couple of friends stayed for only a week. We so enjoyed our stay and everything was provided. The condo was beautiful and the view.....wow the view. It was very comfortable. The managers were very nice and accommodating. We needed to have a late check out and this was so nice.

Great family get-a-away! We had a great time staying on the north side of Kauai! This condo is in a perfect location. Close to some amazing beaches and short drive to others. Close to grocery and shopping as well as trails for running/walking. Quiet considering it's a resort area and very safe and friendly. Our condo had everything we needed. We felt very much at home, beds were super comfortable, huge master suite, and kids loved their room with 2 double beds. Loads of room and stocked with everything for entertaining and beach days??

Great Condo! Alhoa! I recently stayed here for 10 days and this condo was awesome! It was super cute and super clean. The lanai was perfect for sitting outside and eating a wonderful breakfast while listening to the birds chirp. The amenities were great too. It was nice not having to rent or buy beach items after arrival. The only issue I had was the air conditioning wasnt working properly the last few days of my stay. Luckily I wasnt at the condo frequently over those days to make it unbearable. Overall this was the perfect condo for what I was looking for, and I'd certainly recommend it to anyone staying on the north shore! Mahalol!

Plantations 111 This was an excellent location for a small family vacation. Centrally located in Princeville, it is a quick drive or a pleasant walk to the stores, the golf course, or even the queen's bath. The cost was quite reasonable. The condo is well kept. We would definitely stay here again.

A Great Place to Stay We have been to Princeville several times and have enjoyed the various places we have stayed. The Plantations was great it. We took two of our Grandkids and we all enjoyed it. It was clean well maintained and we would recommend it to others and would stay their again.

Condo Needs Personal Touches & Updates We've stayed in Plantations before, but direct from a condo owner, so can attest to far better options than Unit #111. This unit has no character, no pictures on walls, no decor at all - aside from the turtle shown on the coffee table. The annoying overuse of vinyl tablecloths everywhere was bizarre. In the guest bedroom, the dresser had a kitchen themed cloth reflecting spices. In the living room, there were lace cloths that snagged on everything. The couch and chair are beyond uncomfortable. The cushions are so soft, you sink in and it is difficult to sit upright. The location description is misleading. Yes, the unit is on the corner - of TWO main streets. The major one leads to other condos and the St. Regis. At night, constant headlights easily penetrate the blinds in the guest bedroom. The other street is how you access Plantations and a neighboring development. We noticed on weekends, high volume of traffic on both roads was common, not slowing down until around midnight. We didn't bother using the porch because of the traffic, and filthy furniture. In addition to the two metal chairs and table, there were also two white, plastic chairs as well. These were covered in filth, not inviting at all. Cleanliness of the actual condo was off as well. For the most part, bathrooms were clean (toilets, baths), but the guest bath sink had toothpaste all over it. Kitchen was decent, except the oven door was disgusting - as was the inside. Based on hearing traffic majority of the time, and having to clean a few areas ourselves, along with lacking a usable porch - we would not stay in this unit again.

Will definately return!!!!! First of all let me say that the Remax family felt like family from the first moment we spoke to the. Our plans changed due to the hurricane. However everyone did everything to make our stay seamless. We had personal cell numbers that they answered and helped us. We trusted them from the get go. Cannot say enough about the condo as well. Great place to stay Our family of 5 stayed here for 15 nights. The place was clean, and had everything we needed. It was very handy to have the garage so close to the kitchen when unloading groceries. It was sometimes noisy (street noise) if that's a factor for some. But overall we highly recommend this place.

Simply Paradise Our honeymoon stay at this condo was perfect! The view is absolutely breathtaking. We ate lunch on the patio everyday and felt very secluded by the hedges of flowers. The furniture and kitchen are all very new. I was especially happy with the master bathroom which was enormous including a double sink, soaking tub, and separate room for the toilet. We loved having a garage attached to the condo and used the beach equipment we found there. We also used the Netflix. The only negative was that we never received an email with the check in information so when we arrived at 11 pm we had to track down the owner's number and get the key code.

Princeville condo The condo had everything we needed, brand new, most of it, so it worked fine for us. It was lacking in personality, though. There were no pictures on the wall, no bookcase of books to look at. The corner location with all the traffic was not ideal, workable, but not peaceful. Princeville weather was very spotty, lots of cool, windy, cloudy days. Great weather for hiking. We drove to Kapaa or further south most days to find a sunny beach. The main road into Princeville is atrocious, lumpy, bumpy, full of potholes. You would think with all the homeowners fees, it would be much better kept.<br/>Angela Pycha with Remax was very helpful when we missed our plane (the highway closed due to an accident) and had to stay a couple extra days. Newer Princeville Location with A/C I would definitely recommend the Plantations #111 condo! It is newer, light, spacious with large master bedroom. Beautiful views of the mountains and I could even see a couple of waterfalls off the mountain while sitting at the dining table. There are nice amenities like boogie board, beach towels, umbrella and sand toys. The washer/dryer are a huge benefit and I would throw a load of beach towels and swim suits in every night. The pool and hot tub are nice and the exercise room looked good although we never used it. <br/><br/>Two minor negative points is that it being on the main street on Princeville and it being on the bottom floor, there was enough noise we didn't want to open the windows but it was definitely quiet enough with the windows closed and with the A/C we didn't need it opened. (Also some slight noise from upstairs unit like toilet and shower mostly.) Secondly, however, the A/C is just in the master bedroom and kitchen/living room area. The second bedroom did not have A/C and it did get a bit warm with the windows closed (which we did because of the noise). There was also a cat that came around and I really don't care for cats so one more reason to not open the doors.

Very Nice Visit The condominium is older but nicely and recently updated. Well equipped and excellent location on the north shore of Kauai. Be aware that this unit is right on a busy intersection and traffic noise is very apparent. If you are seeking peace and quiet in Kauai this may not be the place for you. The coffee maker will only accommodate up to 4 cups and should be upgraded. Overall, this property represents a good value.

Great place! This was our first time renting a condo instead of getting a hotel and honestly we didn't know what to expect. This place in Plantations was really great though! It was really big, had a garage, really comfortable beds and furniture, washer dryer. They also had cable (HD) and a flat screen tv and great wifi for streaming. It was a really great place to come back to after being at the beach. Plus, the pool, hot tub, and fitness room in the community were a great way to pass some of the rain that came. Location is great, about 10 or so minutes from Hanalei Bay. We talked about staying here again with some friends next time we are on the island. Not to mention, the price was great! Getaway for Two This space was beautiful and exactly what we were looking for. The owners provided a starter kit of paper towels, soaps, toilet paper; as well as a well stocked kitchen with all the tools one could need. <br/>The space was clean and tidy. Neighbors/other guests in the area were friendly and quiet. The spot was perfect for any couple looking to get away from the noise and still be walking distance to a collection of shops one direction and the beach the other. This is also located across the street from an amazing golf course. <br/><br/>After booking my trip through flipkey and trip advisor I'm confident I won't need to book any more vacations through a hotel in the future. It was noisy from traffic and the drain system in both shower needed to be clean( i personal clean it myself but needs attention) . Water pressure seam to be low if both showers are in operation. Otherwise the condo was okay if you're not in the condo. One thing that the shower head in the guess room was ready to fall off so I had to tighten it.

My rental vacation stay was nice. We did however experience a slow clogged guest bath tube, rather large **** roaches in kitchen and guest restroom ( due to filthiness)there were wet dishes put away in kitchen closets and wet towels in bathroom closets, rear door leading to garage had screws and bolts coming out of lower portion of door frame and the worst of all the over freezing of AC Unit. AC unit would freeze over everyday and heat up home to over 81 degrees. hotter inside then outside. We had maintenance man out and he removed an extremely dirty filter from AC and after it had drained water all over floor, unit was turned back on by maintenance man. There continued to be problems with AC Unit. I wouldn't recommend unit to people with small kids because unit is not kid friendly. There was way too much glass property inside and unit to close to major road for outside playing. Over all Unit worked out for us. We had already paid in full for rental unit with nowhere else to go on an unfamiliar Island.

The condo and the area was amazing! The ReMax Concierge Service was terrible. Received an email from the Concierge saying if I needed any help with activities to send them an email, so I did. Three weeks went by not a peep, not even a hey we received your email and we are working on it. Three days before departure received an email from Concierge saying we arranged your activities for you please send credit card information. They didn't even say what they arranged or how much it was going to cost me.

The process of booking this property online was easy and efficient. The location on the north shore of Kauai is beautiful. The condo was very clean,well appointed and quiet.
