RESERVATION POLICIES/AGREEMENT

BE SURE TO READ OVER THESE TERMS AND CONDITIONS
AND MAKE SURE THAT EVERYONE IN YOUR PARTY IS AWARE OF THEM

This agreement is between the person named in the reservation made online (herein referred to as Guest) and the Property Manager. (herein referred to as PM).Guest authorizes the total amount of the reservation to be charged to the credit card used at time of booking and will be on file with the Property Manager. Half of the total is currently charged as requested at booking and the balance will be automatically charged 10 days prior to arrival.

RENTAL ACKNOWLEDGMENT: Guest acknowledges and understands that he (she) is a licensee of the Owner and not a tenant; and that he (she) is not acquiring any interest in the property. It is understood that each unit is privately owned including all furnishings, with PM acting solely as Agent for the Owner.

VERIFICATION: Presentation of the Guests' driver’s license or legal ID is required at check in, plus the credit card used to pay for rentals or packages. The credit card holder must be present at check in to sign authorization. If the cardholder will not be present, credit card authorization paperwork must be completed and received prior to check in. It is a crime to obtain this rental property under false pretenses. Communication about a reservation, even after departure, must only be with the guest named on the reservation.

OCCUPANCY AND USE: Occupancy and use of premises shall not be such as to disturb or offend neighbors or residents. These vacation homes were designed for individual and family use only. If a disruptive party or situation develops or is suspected, all guests will be asked to leave immediately without refund of payments or deposits. This policy is enforced without exception. The minimum age to reserve a cabin is 21. Cabin occupancy is determined by the number of guest over the age of 12 years old. Children, teenagers, and young adults MUST be accompanied by a parent or legal guardian.
The Property Manager hereby reserves the right to refuse service to anyone who they feel does not serve the best interests of the owner of the cabin. If it is determined at check in that inappropriate behavior will be transpiring in the cabin or the guest is representing a group of individuals PM would otherwise not allow to check in, PM reserves the right to refuse service and at its discretion, no refund will be given. PM reserves the right to enter and inspect the cabins without notice or the guest being present.
PM does not charge a per person rate as long as the occupancy does not exceed the maximum number for the cabin being rented. No cabin may exceed the legal occupancy limits.

MINIMUM STAYS: We have a two-night minimum stay on all reservations. Some holiday and other peak season weekends require a 3- or 4-night minimum stay. See our Rates web page at to view these dates. Online reservations in violation of a minimum night stay will not be processed.

PAYMENT: At the time of reservation, 50% of the gross rent will be charged to your credit card. The remaining 50% is automatically charged to your card 10 days prior to the date of your arrival. This same policy applies whether you have used a credit card or a debit card. PM does NOT accept personal checks. If the guest chooses to use a secondary credit card for payment, changes to credit card information must be made with (an agent of) PM. Guest must present all credit cards used for payments at the time of check-in to secure the reservation and cabin. Otherwise, PM will have to move all charges to a credit card in the possession of the reserved guest. A processing fee to transfer charges from previously used card(s) to a card in the guest’s possession will be charged to the guest equal to 2% of each balance transfer and removal. Processing fees may be applied if a reservation is subsequently changed. Guest(s) must notify the Property Manager at of any discrepancies in the reservation immediately upon receiving the confirmation.


CHECK IN/CHECK OUT: The Guest(s) understand and agree that check in time begins after 4:00 p.m. Every attempt is made to have cabins prepared for check in at that time, but access to the property is given only after the home has been cleaned and inspected. No one can pick up a key code except the renter, unless prior written consent has been received by PM. Check out time is no later than 11:00 a.m. with no exceptions; key codes will expire at check-out time automatically. An additional night’s stay will be charged for late checkouts.
All Guests will be emailed directions to the cabin and we will text the door code when the cabin is cleaned and inspected. All Guests who arrive after our office closes and have not been reached during office hours to confirm receipt of directions and door code will be provided a map and key code to the cabin for pick up at the rental office located in the second cabin of the complex directly behind the real estate office on Wears Valley Road. There is a mail box to the left of the front door which is where the packet of information will be obtained. Guests agree to abide by all guidelines given at check in.

USE OF THE PREMISES: Guest(s) understand they are solely responsible for any property damage, accident, injury to any person(s) or loss sustained by any person, including loss of money, jewelry and other items of personal property, arising out of or in any way related to Guest(s) use of the premises or the items of personal property provided by PM on behalf of the owner at Guest(s) request. Guest(s) shall inspect and be familiar with proper use and application of such items in the home prior to using them.
Guest (s) hereby agrees to indemnify and hold PM and/or homeowner harmless from any and all claims including those of third parties, arising out of or in any way related to Guest(s) use of premises of the items of personal property provided therein. Guest(s) assumes the risk of injury or other losses relating to any recreational activities and will hold owner and its agents harmless with respect thereto.
We require that a group leader and/or chaperone be present with your group at all times while you are at the cabin. At our discretion, we may require and arrange for a security service to patrol your cabin. We will attempt to notify you if this becomes necessary and your group will be charged for this service at $150.00 per night per cabin.

TAX-EXEMPT RESERVATIONS: A Tennessee tax-exempt certificate or 501c3 tax –exempt certificate must be provided by any group wishing to claim tax exemption. For these types of reservations, several criteria must be met: (1) The reservation must be made in a group name. (2) Payment must be made by a form of payment showing the group name (i.e. credit card issued in group name, check with the group name on the account, etc). (3) The group name on the tax-exempt certificate must match all of the above. Request for tax-exemption must be made at the time of the booking. A valid tax-exempt certificate (as stated above) must be submitted to the rental agent at the time the signed Agreement is returned, which should be within 14 days of making the reservation. Group payments may not be held in escrow.


DAMAGE/THEFT: Guest (s) agrees to leave the premises in a clean, undamaged condition. In consideration of a non-refundable damage waiver fee, guest will not be held responsible for reported unintentional damages which may occur to the property during the guest’s occupancy period, if the damages are reported in writing. Damage Waiver fees and coverage are as follows: 1 bedroom cabins $35 for $350 of unintentional damages; 2 bedroom cabins $40 for $400 of unintentional damages; 3 bedroom cabins $45 for $450 of unintentional damages; 4 bedroom cabins $50 for $500 of unintentional damages; 5 bedroom cabins $55 for $550 of unintentional damages; 6 bedroom cabins $60 for $600; 7 bedroom cabins $65 for $650; 8 bedroom cabins $70 for $700; 9 bedroom cabins $75 for $750 of unintentional damages; 10 bedroom cabins $80 for $800 of unintentional damages. Guest accepts full responsibility for all pet damages, and intentional or reckless damages, which include damages while under the influence of drugs or alcohol, caused by any member of the party staying in or visiting the reserved cabin.
PM reserves the right to require a damage deposit when the Property Manager determines that the situation warrants it. The amount of the deposit will be determined by the Property Manager based on the situation. If damages exceed the deposit amount, the guest will be responsible for payment of charges in excess of the deposit.
Guest hereby authorizes the Agent to charge any expenses related to repairing intentional or reckless damage, cleaning of the unit beyond normal wear and tear, or related to theft of any property from the unit to the Guest’(s) credit card on file. Should the Guest(s) dispute the charges or the credit limit on the credit card not be sufficient to cover the theft and/or repairs/cleaning required due to excessive use of the cabin, Agent reserves the right to charge the Guest(s) with vandalism and pursue collection from the Guest(s) with venue being in the county of Sevier, State of Tennessee. All reasonable attorney fees will be at the expense of the Guest(s) should collection become necessary. Missing or damaged items from cabins will be replaced at current retail value plus a minimum $100.00 service fee and charged to the Guest(s), with the Agent reserving the right to adjust the service fee as necessary on a case-by-case basis.

POOL USAGE: Resort community and private in-cabin pools are to be used by registered guests only. No diving in the pool, horseplay around the pool, and no running in the pool area. NO glass or food of any kind is allowed in the pool area. Guests use the pool at their own risk. NO pets allowed in the pool or pool area. Children age 3 and under MUST wear approved swimming diapers when swimming in the pool. NO smoking in the pool area. All children under the age of 18 MUST be accompanied and supervised by an adult when in the pool area; NO exceptions. Please do not allow any guest with an open sore or wound use the pool. Private in-cabin pools will be inspected after each rental. If any items such as household items, food, alcohol, etc. are found in the pool, the Guest will be charged a cleaning fee of $300.00. Damage to any solar/thermal cover will result in a charge up to and including full replacement and reinstallation. Covers should remain laid out flat on the surface of the pool at all times when not in use. Additional fees may apply.

HOT TUB USAGE: Hot tubs will be inspected after each rental. If any items such as soaps, bath products, food, alcohol, etc. are found in the tub, the Guest will be charged a cleaning fee of $150.00. Damage to any cover will result in a $450.00 charge. Covers should remain on the hot tub at all times when not in use. No children under the age of 12 years old are permitted in the hot tubs. Guest agrees to follow the hot tub usage instructions posted at the hot tub. Please leave the bromine floater in the hot tub at all times. If PM is required to drain and clean the hot tub during the reservation, there will be an additional charge to be determined by the circumstances. Guest(s) authorize PM to charge the credit card on file for any of the above charges. All hot tubs are drained, cleaned and refilled after every checkout. Guest is not to drain hot tub. Additional fees may apply. PM assumes no responsibility for any occurrence associated with the hot tub usage. Guest(s) with skin, ear, genital or other body infections, open sores or wounds should not use the hot tub due to the possibility of spreading infection.

CABIN SUPPLIES: PM will provide a starter supply of soap, dishwasher detergent, toilet paper, trash bags and paper towels. All cabins are supplied with linens and towels as well as kitchenware and utensils. All linens, towels, kitchenware, game systems and utensils are inventoried upon check out. The reservation holder’s credit card on file will be charged for any missing/damaged items.

PETS/SMOKING: Pets are allowed only in designated pet-friendly cabins, subject to our pet policy and with payment of a non-refundable pet fee. Our pet policy applies if a pet is present in the cabin at any time during a reservation. Smoking is not permitted inside any cabin. Smoking outside or on the decks is permitted. Charges will be assessed based on damages or for any deviation of policy,including extra cleaning charges (minimum charge $150).

WEAPONS AND DRUGS: Drugs, fireworks, and firearms are prohibited in all properties unless carried/held lawfully with proper prescriptions/permits/other legal documentation. Any fireworks, drugs, and/or weapons found will be reported to local law enforcement, who will recover such items and take possession. Airsoft (and similar) guns are prohibited in all properties at all times. Any evidence of the use of such a weapon will result in penalties up to $300. Additionally, any and all damage resulting from the discharge or use of ANY weapon or fireworks will be the full responsibility of the reservation holder, and damages will be charged to the credit card on file.

ITEMS LEFT IN UNIT: PM will not be responsible for any personal items left in the units. A $20.00 service charge, plus the actual cost of shipping, is requiredif you request us to ship any items found in the unit. Shipping is assigned to a third party shipping company.

MALFUNCTIONS: We do not guarantee that utilities, appliances or amenities will not fail; but we do guarantee that repairs will be made as soon as possible. In the event repairs cannot be made in a timely manner, we reserve the right to move the guest(s) to another available cabin. No refunds or other compensation will be given due to any failures or malfunctions. Internet access is an amenity provided by outside services, and not within PM’s control.Guests understand and agree that there are circumstances beyond the control of PM when there is a malfunction and that no recourse or action can be brought against PM for these circumstances which include but are not limited to: an in-cabin amenity malfunction, malfunction of plumbing or electrical, construction activity, failure of public utilities, amenities withdrawn by an owner/ HOA or other situations over which PM has no control. We provide after-hour services for emergencies only, such as lack of power, heat, air, water, accidents, and cabin lock-outs.

If the property booked by the guest cannot be accessed due to snow, ice, or other acts of God, PM will not be held responsible and no refunds will be given due to these issues. These are acts of God over which PM has no control, and is why we strongly encourage each guest to purchase travel insurance for reimbursement related to travel problems. During the winter season the guest should consider using a 4-wheel drive vehicle or chains depending on the location of the property they have selected to rent. PM will attempt to locate the guest in an alternate property until the roads make the original booked property accessible, at which time the guest must relocate to the original booked property. There will be a cleaning fee assessed to the guest for the occupancy of the alternate cabin during the time period the guest cannot reach the original booked property. PM will not reimburse for travel expenses related to acts of God.

SUBSTITUTION: In the event that the owner of the vacation home elects to remove his property from our management responsibility, we will transfer the reservation to a comparable or upgraded cabin. No Refunds.

PREPAID RENT: Prepaid rent is held in an interest bearing account with interest accruing to the benefit of PM

PRIVACY STATEMENT: PM does not divulge a guest’s personal information to any third party without the guest’s expressed written consent.

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

POLICY HIGHLIGHTS:
Only a starter supply of paper and soap products is provided. Maid service is not provided, but is available upon request for an additional fee.

Check-in begins after cabin inspection is completed, no earlier than 4:00 p.m. local time. We will check guests in as soon as the cabin is ready. We cannot guarantee early check-in or late check-out requests.

No person under the age of 21 will be allowed to check in. If anyone under 21 reserves a cabin without our knowledge, they will not be permitted to check in and will not receive a refund.

We require the Guest to present the credit card holder's driver's license and credit card upon check-in. If the credit card owner will not be present at check-in, we will need a credit card authorization form completed in advance.

Additional Fees may apply (such as pool fee, hot tub and cleaning fees, pet fee, etc.)

I understand that my reservation is subject to the Property Manager's Rental Agreement and I have read and agree to abide by all policies and checkout procedures, including pet policies if applicable. I understand there are absolutely no refunds through the Property Manager and once a reservation is booked my only recourse is to file with a 3rd party travel insurance company. If I decline insurance I understand that that there are no refunds. I understand payment in full will be charged 10 days prior to my arrival.

I authorize the total amount of my reservation to be charged to the credit card I have on file with the property manager. A deposit portion of the total above is currently charged as requested at booking and the balance will be automatically charged 10 days prior to arrival.

Hidden Gem Loved the hidden driveway! You were concealed from every one around you! The cabin was awesome, the view out of the back porch was beautiful. Mountain Experience Great except for the crowds of people in pigeon forge and gatlinberg and the driveway down to the cabin was a little scary. Lovely cabin but a bit noisy Moonlight Memories is a very clean, attractive n nicely decorated cabin. We were rather dismayed to see the proximity of so many other cabin. From the front doo you look right at the air conditioning unit of the next cabin. The people in the cabins below us had motorcycles which were coming and going at all hours so it did not feel at all like a quiet week in the mountains. Sad as it was expensive. We are sorry that your neighbors were so disrespectful. Typically most guests are courteous of their neighbors. In the future if you ever have an issue with noisy neighbors we would encourage you to call the police. While we cannot do anything to address other cabin rental company guests the police authority is far greater than any management company is in these types of situations. Amazing ,comfortable, and relaxing Stay !!! Our cabin was updated with all the needed items from nice size televisions to kitchen appliances.Even other family members who visited my cabin thought it was much more updated than some of he rest. Very comfortable especially the beds. My family and I enjoyed every moment. My 8 and 9 year old did not want to leave. The view from the back was amazing!! Only minus is the drive way that is made funny but it is best to pull in backwards. It really was not a big deal except when having visitors . In addition, main railing going upstairs to game room can use a little tightening.Overall ,I would stay in this cabin again because everything else was great! Not as spectacular as we expected Pretty disappointed by our stay at Moonlight and Memories. I'll preface by saying that our expectations were pretty high, but not unreasonable. I'll also start out by saying that while some may write off much of this as nitpicking, but for the amount folks pay to stay at these properties they are still important.<br/><br/>First off, we knew the driveway going to the cabin was steep from other reviews. From the photos, we were under the impression it was far more secluded and private than it actually is. The cabin is in a "neighborhood" of other cabins. Being down the hill gave it a bit more privacy, but essentially you step out your front door and your neighbors are right there. Not a deal breaker, but wish we would have had the forethought to search for the cabin by name on Google Maps and seen how it was not as secluded as we thought.<br/><br/>The cabin is beautiful overall but needs some attention paid to it's upkeep. As far as cleaning goes, there was a noticeable soap scum ring around the Whirlpool tub. One of the bathroom mirrors was also pretty dirty and some large cobwebs on the bedroom ceiling. The toilet seats in the bathroom have some wear to them and the garbage cans in the bathrooms are either broken or pretty beat up. There are a couple of extra pillows for each bed, but two were upstairs and two were in dresser drawers; would have been nice if they were on the bed to begin with. <br/><br/>No problems in the kitchen. Refrigerator was clean and plenty of dishes, etc. We cannot comment on the functionality of the dishwasher, the stove, any of the small appliances, etc. as we did not use them. <br/><br/>The living room has a nice entertainment system enjoyable from the couch or kitchen. However, the components either don't work or are not properly hooked up. The surround sound system was not hooked up so we couldn't use that. There is a Blu-ray player, but it is broken (the tray doesn't open - there is a separate DVD player but we didn't try it). AUGUST VACATION we had a great time, the cabin was in great shape and the views were awesome. there are only two minor things I'd like to bring up. Needed a place for one night and they accommodated us Liked it very much, very nice and clean. The only thing we didn't like was the parking, it was tough to get 2 vehicles down the hill, had to back yp the hill, not good. Poor customer service The hot tub did not work!! Requested my money back for 1 night plus the $25 fee to clean the tub and was treated like dirt by the rental staff at Eden Crest! Unfortunately we cannot anticipate or prevent items from breaking. We will however move quickly to address any issues that arise. Your demands for a full refund of the entire night due to one amenity breaking was not an appropriate demand from the owner of this cabin based on the circumstances. One amenity did not nullify the entire cabin. While the rental agreement clearly stipulates that no refunds will be given if an amenity becomes non functioning during your stay, we offered you a gift certificate or refund that you refused. We acted in good faith and are very sorry that the hot tub broke on the last night of your stay.

Beautiful cabin with poor customer service Had to call to get the gate code and door code, after my check in time. Was told it would be sent prior.<br/><br/>Electrical switch was not working, no lighting around the air hockey table. Handy man came by to fix it, after a half hour he said he would have to come back in the morning. It was never fixed during our stay.<br/><br/>On our second day I called multiple times to try to access the wifi. The person gave me two codes to try, but could not tell me which network. I tried both passwords on all 5 networks that showed up, none of which worked.<br/><br/>On Our last day with check out at 11:00, I received an email at 10:07 with the wifi password and the code to the pool. Moonlight & Memories was FANTASTIC! We enjoyed our cabin immensely! The cabin was perfect. However, a few little things on behalf of management would have gone a long way in easing their guests into a seemless transition of operating controls for TVs, DVRs, etc. for each unit:<br/><br/>1. NO BATTERIES were in either of the two remotes for the second bedroom. <br/><br/>2. NO CHANNEL GUIDES were provided to assist the operater with the Dish Satellite System installed in every room.<br/><br/>3. SPECIAL DRIVING INSTRUCTIONS should Be specified to outline the 45 degree angle of the unit's driveway, including, but not limited to, the lack of view from the actual street the unit is located on.<br/><br/>OVERALL, I loved the unit... it was very clean! The worse mountain stay ever Upon Arrival to our cabin the code to the Gate they gave us did not work and it was already dark, so we waited for the next car to pull up and followed them into the Gate. Went into the cabin had NO phone connection , NO internet and had a cabin with 4 TVs that NONE of them worked . I stepped outside in rain and cold Called them right away to get someone to come and they said it was not eMERGENCY and no one could come . The next morning I woke up thinking FOR SURE they would show up, but when they did not I went outside and called again and they said sorry it's thanksgiving no one is coming. So make it short 3 days stay in mountains , our vacation time from work and as soon as it got dark we were so bored all we could do is sleep. There was no DVDs there fir us to even do that !! Beautiful mountain views from a great location This cabin has a real cozy at home feeling, great for relaxing. The view from the deck and hot tub is amazing. The cabin is decorated for Christmas with a wonderful moose themed Christmas tree. The way the cabin is situated is very private. We will certainly return to this cabin in the near future. Moonlight and Memories - Spring 2017 Overall we had a very good experience. However few items I would like to suggest to improve customer experience.<br/><br/>1) Text the code to the property and cabin in advance. The email we received did not include code to the property and cabin. Had to wait an hour to get the information.<br/>2) My son was stung by a wasp inside the cabin in the second floor. This was not a good experience. We received a note that maintenance took care of the situation, but this wasn't a good experience<br/>3) Please leave inside the cabin the password to connect to Wi Fi and instructions for operating the hot tub.<br/>4)Finally, our welcome bag wasn't in the cabin. I called about it and customer service replied to stop by the office to pick it up. Very Nice A clean, comfortable, pretty cabin. Loved the layout. 2 master suites each with their own bathrooms. Plenty of room with the sofa sleeper and futon in the game area. Drive way can be a little tricky, but it was manageable. Beautiful view. A good location. Best of both worlds, not in town but not to far away from town. Will definitely stay again. we had a great time, the cabin was in great shape and the views were awesome. there are only two minor things I'd like to bring up.
