RENTAL RATE INCLUDES: Property rental for a maximum of : 4 for 1 bedroom_&_ 6 for 2 bedroom & 8 for 3 bedroom__occupants dand check-in service at the property. ADDITIONAL CHARGES/NOT INCLUDED: The rental rate does not include security/damage deposit,transfers, baggage handling, maid service, chef service, food, beverages, personal laundry service, extra person charges, excessive out-cleaning charges or any other items or services not specifically listed in this agreement.SECURITY/DAMAGE & INCIDENTALS DEPOSIT: In addition to the rental charges this property requires a security/damage guarantee, to assure payment for damages exceeding normal wear and tear, excessive cleaning costs, long distance phone charges and any other items which may be charged to the guest’s incidentals account during occupancy. This deposit can be made in the form of a Credit Card Authorization, in lieu of cash payment. If no Credit Card Authorization is on file, a $500 cash deposit must be received 60 days prior to arrival, or when Final Payment is made. This deposit will be held as a security deposit for 14 days at which time it will be changed to an incidental deposit balance to be refunded within 45 - 60 days.
RESERVATIONS & PAYMENTS: A reservation is being held for the dates specified above. We must receive a signed copy of this completed Rental Agreement, and the applicable deposit/payment, by thedate shown below or the reservation will automatically be canceled. We must receive the $500 deposit and 50% of rental amount within seven business days by a check, or credit card. Reservations require 50% due upon booking and the remaining balance due 60 days prior to arrival.$500 refundable security deposit due upon booking to reserve dates requested. ACCEPTANCE & PAYMENT TERMS
You must sign this Agreement and make your required payment within 24 hours to avoid cancellation. Once your signed agreement and your deposit or full rental fee are received, a confirmation will be issued to you. If you do not receive a confirmation this does not void this agreement.
If your required payment is a deposit, the balance of your full payment is due 60 days prior to the commencement date of your rental period. By authorizing a deposit payment via credit card, you are also authorizing the same credit card to be charged for the balance of the total charges 60 days prior to the check in date of your rental period. This additional authorization shall be exactly as though you have presented the card number for payment at the time the balance becomes due. If you book your rental less than 60 days in advance of your stay, we will charge your full payment immediately by credit card. If the card will not process, you will be liable for the remaining balance due and authorize us to charge your credit card account on file, exactly as though you have presented the card number for payment at that time, until your outstanding balance is satisfied. Once we receive your payment in full, as a courtesy we will send you, by e-mail, a confirmation notice to confirm receipt of payment.
FAILURE TO MAKE FINAL PAYMENT ON A TIMELY BASIS WILL RESULT IN PROPERTY MANAGER HAVING THE RIGHT TO CANCEL YOUR RESERVATION WITH THE INITIAL DEPOSIT PAID 100% NON-REFUNDABLE IN KEEPING WITH OUR NO-CANCELLATION POLICY, TO WHICH YOU AGREE TO BY SIGNING THIS AGREEMENT.
NO-CANCELLATION AND NO-REFUND POLICY
WHILE PROPERTY MANAGER MAY CANCEL YOUR RESERVATION FOR FAILURE TO PROVIDE FULL PAYMENT BY THE REQUIRED DATE, YOU MAY NOT CANCEL YOUR RESERVATION AT ANY TIME ONCE THE NON-REFUNDABLE DEPOSIT IS SUBMITTED AND YOU AGREE TO THE TERMS & CONDITIONS OF THIS AGREEMENT. Any Customer who refuses to use services contracted for forfeits any and all collected money, except the Customer's security deposit and cleaning fee (if applicable). The security deposit and pre-paid cleaning fee are not part of the initial deposit to hold the rental. The security deposit and pre-paid cleaning fee (if applicable) are included in the balance payment, therefore, the initial deposit will be forfeited if you refuse to fulfill your scheduled stay after confirmation of booking.
Collected money is non-refundable. Under no circumstances shall Customer be able to determine if a rental unit is unfit for habitation. If you as Customer forfeit your right to services contracted for, and Property Manager is able to re-book the property at the same rate, you will be issued a pro-rata refund for those dates re-booked. All refunds of rental service payments, whether complete or pro-rata, will be subject to a deduction equal to as much as 15% of deposit(s) paid. Customer shall give Property Manager, twenty four (24) hours to clean the rental that you might deem dirty upon check in. Customer also gives Property Manager, twenty four (24) hours to address any allegations that bugs or pests are in the rental. Ultimately, in order for you to claim the premises are unacceptable due to issues of cleanliness or bug/pest infestation, you must obtain a third-party opinion letter within forty eight (48) hours of arrival, (from a professional not staying in the rental that has physically witnessed the issue) to corroborate any allegations of poor quality services or accommodations.
Please be further advised that Property Manager is not responsible for construction or neighbor noise, as these are risks that are inherent when renting a vacation rental. We are unable to control these factors, and this agreement shall remain in full force and effect regardless of these issues. There shall be no cancellation for construction noise or for neighbor issues of any kind. To protect against cancellations caused by certain unforeseen events, such as illness, we recommend that customers purchase travel insurance to assure refund of deposits paid. As a valued Customer, we want to do everything possible to make your trip is enjoyable and worry free. Since the unforeseen and unexpected can occur before you leave or when you are away from home, we recommend (but do not require) CSA's Guest Cancellation Insurance Plan. Any changes made after booking shall be wholly at Property Manager's discretion. There is no "reasonable" change of accommodation that this agreement requires Property Manager to make.
If Customer complains about the condition of the rental, the amount of Security Deposit being withheld and or service they received from the Property Manager and or Property Manager's employees or contractors, KPC will work in good faith to help Property Manager and Customer reach a mutually acceptable resolution..
Any CHANGES made to a booking after a confirmation has been issued will be assessed a $150.00 service fee. Acceptance of any change is subject to approval by the Property Manager of the rental.


*Full Forfeiture: Refunds on any forfeiture will be issued to the extent of the dollar value the unit(s) is re-rented during the same dates as the cancelled reservation.
No refunds will be made for late check-ins; early check-outs, no-shows or for booked but unused services. Refunds will be made only under the following circumstances: 1.) The property rented becomes unfit for habitation and no acceptable substitute can be found; or, 2.) The property is sold by Owner, and no acceptable substitution is agreed upon, or,
The Property Manager strongly recommends the purchase of trip interruption/trip cancelation insurance to help protect against financial losses if trip delay or cancelation is necessitated by certain kinds of unforeseen circumstances.

LIABILITY: The Property Manager or its employees, subagents or assigns, (hereafter jointly and severally referred to as Agent) acts only as a marketing agent for the property Owner, and other suppliers providing accommodations, property management, and guest services. Agent does not own or manage any property offered for rental and does not exercise control over or have direct supervision of the respective owners, managers or service providers. If accommodations or services must be substituted for any reason, Agent, Owner and Manager will act in good faith and use their best efforts to substitute accommodations or services of a type comparable to those originally contracted and that are acceptable to Guest(s). Agent, Owner or Manager, upon just cause, reserves the right to refuse or discontinue service(s) to any person(s) and/or to rescind any contract for accommodations or guest services.
INDEMNIFICATION & RELEASE OF LIABILITY: The undersigned Guests/Occupants understand andacknowledge that the Owner, Manager or Agent is not responsible for loss, damage or theft ofGuest’s/Occupant’s personal property and that they bear the financial responsibility for the rentalcontracted for loss, damage or theft of guest’s, occupant’s and invitees’ personal property and formalicious, negligent or incidental damages to the property by any occupant(s), guest(s) or vendors(s)invited onto the property and are the only occupants with legal standing in any matter(s) of dispute orlitigation which might arise pursuant to, or in consequence of, any accommodations or services providedor as substituted under the rental agreement. Guests/Occupants acknowledge and agree that Agent,Owner or Manager shall not be held liable for any loss, expense, damage or claim for injury whetherdirect, indirect, consequential or otherwise; whatsoever or howsoever caused or incurred; whether arising in contract
or otherwise in law or in equity as a result of the rendering or the services or accommodations as herein described or as substituted and including, without restricting the generality of the foregoing, the result of any delay(s), substitution(s), rescheduling(s) or change(s) in the provision of accommodations or services by Agent, Owner or Manager or by reason of military actions, revolution, acts of God, or by agents, employees, subcontractors, servants or third parties whatsoever in supplying any of the accommodations or services as described herein or as substituted.

Spacious, luxurious alternative to the big resorts This unit was beautiful, clean and provided more than enough space for our family of four - although we loved being able to put each child in their own room. Everything was as described in the listing and photos, the management office was very friendly and helpful, and we would definitely recommend this unit to anyone who has children or wants the amenities of a kitchen and laundry, etc. My own feedback is that the towels all had that secret mildew smell that returns when they get wet - which seems to be a common problem at most rental properties (if your guests don’t dry their towels properly after use, they are ruined) - so not sure they are worth replacing? But that detail wouldn’t keep us from returning!

Fun at D201 The home was really nice and the view spectacular. This was our 2nd time staying in this community so the private pool and gym just a few steps away was really nice and met some very interesting folks at the pool.

A Beautiful, Relaxing Condo We rented this unit with 2 other couples to race the Hawaii 70.3 IRONMAN, and it was a perfect venue. Convenient location, beautiful views, and luxurious inside. We would definitely stay here again.

Fabulous Condo! Beautiful condo on the Kohala Coast. A short drive to three fabulous beaches. Condo is nicely appointed and rooms are large. BBQ and deck with view of the ocean are perfect for evening meals. We loved it!

Wai ‘Ula ‘Ula Second time that I have stayed at the Wai ‘Ula ‘Ula complex of condominiums. Best place ever! I love everything about Mauna Kea area. We were able to prepare many of our meals at our vacation home. The amenities of the Mauna Kea Resort are awesome and the beach is arguably one of the most beautiful in the world. Will return again and again.

Beautiful ocean view condo! This is a beautiful condominium with Lanai, very luxurious and spacious. The pool and workout facility are also very luxurious. You cannot go wrong with this property!

Family Hawaii Vacation AMAZING UNIT!! We have been staying in Wai'ula'ula for about 10 years and this year was the first year we stayed in Unit D201 with Kohala. We were extremely impressed with everything from the time we arrived until our departure. I would HIGHLY recommend this unit and Kohala!! WE will see you next year!!

Wonderful Time in Paradise We stayed here for 15 nights in June. This is the second time we have rented this property for a family get-together. The property is well maintained and so comfortable and relaxing. The air conditioner on one side stopped working one day and the management company had it fixed right away. Very quick service! If you are looking for a great place in a super location close to the best beaches on the Big Island, this is it!

Dream Vacation I was surprised by the ease of booking the condo. The condo was exactly what I expected and more. The location was near the pool and workout room. My grandkids loved the stay. I saw some stains on the carpet, near the entrance way, by the kitchen. And the garbage, located by the garage, had not been removed, but I contacted Marisa and Michelle. They handled the problem, immediately.

A hidden gem This is a perfect setting for our family, especially with the Ammenities center and proximity to the beach. We found the unit to be clean, spacious, and very comfortable. Michelle with Kohala Coast properties is amazing and always willing to assist. Most certainly we will be back, this is a great value!!!

Good Value; Nice Unit Our family of five enjoyed our stay at Wai'ula'ula 201. This unit was considerably cheaper than renting directly from the Mauna Kea resort. We did not use the resort pass (we don't golf or play tennis). We had everything we needed (including boogie boards and other water toys that were available for use). Highly recommended.

Big Island This is a great property and with access to both the Mauna Kea pool and beach as well as Hapuna, it affords a very relaxing vacation. The property is very close to a fitness center and pool accommodating both kids and adults. Our only suggestion would be to replace mattresses in two of the three bedrooms and find a way to supply better water pressure in the showers. Check in and check out were seamless and the management company is very helpful.

Very Nice Place We thoroughly enjoyed our stay at this beautiful condo. I've listed the pros and some cons below.<br/><br/>Pros:<br/>1. Very quite, relaxing neighborhood<br/>2. Wonderful views<br/>3. Very nicely furnished condo<br/>4. The fitness center and infinity pool were wonderful.<br/><br/>Cons:<br/>1. One of the residents wasn't very welcoming at the fitness center and didn't seem too happy to be sharing the fitness center with us "renters"<br/>2. The water never got hot, including in the just remained lukewarm. Not sure if this is just how things are on the Big Island or whether it was specific to our condo.<br/>3. On the first day when we arrived, the condo was 91 degrees. We turned on the AC on the main living area, but the AC in the master bedroom wouldn't turn on, so my husband called Kohala Coast Properties to find out what needed to be done. In the meantime, we realized that the sliding door to the lanai had been left open by the cleaning staff or the previous tenants, so the AC wasn't turning on. It did eventually turn on, but Kohala Coast Properties never even returned our call. Glad we didn't really need them for something else.

d102 The staff was very nice except for the resident manager. He was very rude to my guests and told them we were not registered guests. They were drinking beer in bottles but he could have told them nicely to not drink their beers in bottles and could use plastic cups. His tone and manner was very rude. I requested an apology from him, but received none.

This is a perfect setting for our family, especially with the Ammenities center and proximity to the beach. We found the unit to be clean, spacious, and very comfortable. Michelle with Kohala Coast properties is amazing and always willing to assist. Most certainly we will be back, this is a great value!!!

We stayed here for 15 nights in June. This is the second time we have rented this property for a family get-together. The property is well maintained and so comfortable and relaxing. The air conditioner on one side stopped working one day and the management company had it fixed right away. Very quick service! If you are looking for a great place in a super location close to the best beaches on the Big Island, this is it!

I was surprised by the ease of booking the condo. The condo was exactly what I expected and more. The location was near the pool and workout room. My grandkids loved the stay. I saw some stains on the carpet, near the entrance way, by the kitchen. And the garbage, located by the garage, had not been removed, but I contacted Marisa and Michelle. They handled the problem, immediately.

Our family of five enjoyed our stay at Wai'ula'ula 201. This unit was considerably cheaper than renting directly from the Mauna Kea resort. We did not use the resort pass (we don't golf or play tennis). We had everything we needed (including boogie boards and other water toys that were available for use). Highly recommended.

This is a great property and with access to both the Mauna Kea pool and beach as well as Hapuna, it affords a very relaxing vacation. The property is very close to a fitness center and pool accommodating both kids and adults. Our only suggestion would be to replace mattresses in two of the three bedrooms and find a way to supply better water pressure in the showers. Check in and check out were seamless and the management company is very helpful.

We thoroughly enjoyed our stay at this beautiful condo. I've listed the pros and some cons below.<br/><br/>Pros:<br/>1. Very quite, relaxing neighborhood<br/>2. Wonderful views<br/>3. Very nicely furnished condo<br/>4. The fitness center and infinity pool were wonderful.<br/><br/>Cons:<br/>1. One of the residents wasn't very welcoming at the fitness center and didn't seem too happy to be sharing the fitness center with us "renters"<br/>2. The water never got hot, including in the just remained lukewarm. Not sure if this is just how things are on the Big Island or whether it was specific to our condo.<br/>3. On the first day when we arrived, the condo was 91 degrees. We turned on the AC on the main living area, but the AC in the master bedroom wouldn't turn on, so my husband called Kohala Coast Properties to find out what needed to be done. In the meantime, we realized that the sliding door to the lanai had been left open by the cleaning staff or the previous tenants, so the AC wasn't turning on. It did e

The staff was very nice except for the resident manager. He was very rude to my guests and told them we were not registered guests. They were drinking beer in bottles but he could have told them nicely to not drink their beers in bottles and could use plastic cups. His tone and manner was very rude. I requested an apology from him, but received none.

AMAZING UNIT!! We have been staying in Wai'ula'ula for about 10 years and this year was the first year we stayed in Unit D201 with Kohala. We were extremely impressed with everything from the time we arrived until our departure. I would HIGHLY recommend this unit and Kohala!! WE will see you next year!!
