Cancellation Policy

SHORT TERM: Cancellations made 30 days or more will receive a full refund. Cancellations are
effective on the date written notice is received by mail, or e-mail in NWVR’s office. If a refund is
applicable, the refund payment will be processed within two weeks of receipt of the cancellation
notice and will be paid via check or by refund to the Guest’s credit card on file.


LONG TERM (30 days or longer): Cancellations made 61 days or more prior to your arrival
date, we will return $250 of your deposit, and guests will forfeit the credit card fees and booking
charge. For Cancellations made 31-60 days or more prior to your arrival date, your entire $500
deposit will be forfeited in addition to all credit card fees and booking charge.

Rental Agreement

NEW WAVE VACATION RENTALS AGREEMENT
This Rental Agreement (the “Agreement”) is between the Guest, (“Guest” or “you” or
“your”), and New Wave Vacation Rentals (“NWVR” or “us” or “our”), authorized agent to
rent for the Property Owner.
The following terms and conditions apply to this Agreement. The Guest agrees to rent
(Property Alias) (the “Property”) for the total amount of (the “Rental Amount”) from (the
“Rental Period”).
TERMS AND CONDITIONS
1. RESERVATIONS, DEPOSITS, AND TRAVEL INSURANCE:NWVR accepts Visa,
MasterCard, Discover, and American Express.
SHORT TERM RESERVATIONS : A deposit of 25% of the total Rental Amount is due at the
time the reservation is made. The remaining balance is due 30 days prior to arrival and will be
automatically charged to the credit card on file unless the Guest makes prior arrangements for
an alternative method of payment. Reservations made 30 days or less prior to arrival require
payment in full at time of booking for final confirmation.
LONG TERM RESERVATIONS: 30 days or more we require a $500 ("Hold Payment") to be
paid at the time of booking in addition to the $30 booking fee and a 3.5% non-refundable credit
card fee. (Renter can pay by check and have fee waived). The remaining balance needs to be
paid in equal monthly installments starting 60 days from arrival for long term rentals, with
recurring payments every 30 days until paid in full. Reservations made under 60 days or less
prior to arrival require first two months of payment at time of booking for final confirmation and
then every 30 days until paid.
Upon request, payment may also be arranged by personal check or money order. In such
cases, the check must be processed within seven days of booking in order to maintain the
reservation. Credit card information must also be provided. If paying by credit card a 3.5%
service charge will be added to your booking total.
We want to make sure to do everything possible to make your trip enjoyable. In the event that
circumstances may cause cancellation or trip interruption, or in the event of a mandatory
evacuation, we recommend you purchase travel insurance, which is offered with every
reservation.
Travel Insurance:
Vacation Rental Insurance has been made available with your reservation. Vacation Rental
Insurance provides coverage for the loss of prepaid, non-refundable expenses due to certain
unforeseeable circumstances that may jeopardize your vacation investment and force you to
incur unplanned expenses. Trip Cancellation and Trip Interruption coverage is available for
events such as a sickness or injury of yourself, family member or traveling companion; flight
delays due to adverse weather; interruptions of road service; terrorist acts; and mandatory
evacuations. The plan also includes other valuable coverages such as Medical and Dental,
Baggage, and Emergency Assistance and Transportation in addition to useful services such as
identity theft, concierge and 24/7/365 emergency assistance. We strongly recommend you
purchase this valuable protection. Additional terms and conditions apply; please read your
Description of Coverage/Policy carefully and contact Generali Global Assistance with coverage
questions.

Damage Insurance:
As a part of your stay, you may purchase a Vacation Rental Damage Protection plan designed
to cover unintentional damages to the rental unit interior that occur during your stay provided
they are disclosed to management prior to check-out. If purchased, the policy will pay a
maximum benefit of $3,000. Any damages that exceed $3,000 or are not covered under the
plan will be charged to the credit card on file. If, during your stay at one of our rental properties,
an insured person causes any damage to real or personal property of the unit as a result of
inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or
replacement of such property up to a maximum benefit of $3,000. Certain terms and conditions
apply. Full details of the Vacation Rental Damage coverage are contained in the Description of
Coverage or Insurance Policy.

The Vacation Rental Damage Protection can be purchased up to, and including at, check-in. By
submitting payment for this plan, you authorize and request Customized Services
Administrators, Inc. d/b/a Generali Global Assistance & Insurance Services to pay directly New
Wave Vacation Rentals any amount payable under the terms and conditions of the Vacation
Rental Damage.
A $25 Damage Waiver (the “Damage Waiver”) will be charged to the Guest at the time of
reservation. The Damage Waiver is required on all NWVR properties. The Damage Waiver
covers incidental, accidental, and/or unintentional damages (as determined in NWVR’s sole
discretion) to the Property up to $150. Repairs of such damages totaling more than $150 will be
charged to the Guest's credit card on file. The Damage Waiver does not apply towards stolen or
missing items upon NWVR’s visual inspection of the Property after Guest’s departure.
Once the Guest’s deposit payment is processed, the Guest will receive a confirmation statement
and Rental Agreement via email. The Rental Agreement must be signed and returned to
NWVR. Advertised or quoted rental rates are subject to change without notice. NWVR reserves
the right to correct advertised or quoted rental rates that may have been misquoted due to
human and/or computer error.
2. CHECK-IN AND CHECK-OUT:
CHECK-IN TIME IS AT 4:00 P.M. Plan to arrive no earlier than 4:00 P.M. Do not use the
Property before check-in. We will make every effort to ensure that the Property is available for
check-in at 4:00 but cannot guarantee it. If the Property is available and ready for rental prior to
4:00 an early check-in may be allowed. NWVR will only give keys and key codes to the Guest
who signed the Agreement, unless prior arrangements have been made.
NWVR rents to responsible parties 25 years or older. A VALID STATE DRIVER’S LICENSE OR
OTHER ACCEPTABLE PHOTO IDENTIFICATION IS REQUIRED AT CHECK-IN. Guests are
also required to be at property the entire length of reservation. NWVR reserves the right to
refuse service to anyone.
CHECK-OUT TIME IS BY 11:00 A.M. KEYS MUST BE RETURNED to the New Wave Vacation
Rentals office, no later than 11:00 a.m., on the date of Guest check-out. The office is located at
1305 State Highway 361, Port Aransas, TX 78373. There will be a $50 charge for lockouts,
extra keys or non-returned keys. Each reservation will be provided door codes or 2 keys per
property at check-in . There is a $100/hour charge for houses not vacated on time.
Guests agree that once they have checked in to the Property, no refund will be made for early
check-outs. If Guest does not arrive for the Guest's Rental Period, all monies paid will be
forfeited.
The Guest agrees to surrender the Property and associated amenities in the same condition as
at commencement of the Rental Period. In cases of abuse, malicious, excessive, and/or

intentional damage to the Property (as determined in NWVR’s sole discretion) in excess of
$150, Guest will reimburse NWVR and/or the Property Owner the full amount of any and all
damages, including additional housekeeping expenses and reasonable attorney's fees. NWVR
may charge this to the guest credit card.
3. CANCELLATION POLICY :
SHORT TERM: Cancellations made 31 days or more will receive a full refund. Cancellations
0-29 days prior to arrival will forfeit all monies paid. Cancellations are effective on the date written
notice is received by mail, or e-mail in NWVR’s office. If a refund is applicable, the refund payment
will be processed within two weeks of receipt of the cancellation
notice and will be paid via check or by refund to the Guest’s credit card on file. You are a valued
guest, and we want to do everything possible to make your trip enjoyable and memorable. In the
event that circumstances may cause cancellation or interruption, or in the event of a mandatory
evacuation, we recommend you purchase travel insurance.

4. PROPERTY CONDITION:
NWVR is a vacation property rental agency. NWVR advertises our properties as they are to the
best of our ability, and we have no responsibility or liability for the conditions of the rental
properties or any problems arising therefrom, specifically including any latent defects, defects or
conditions caused by the environment, or other defects not obvious to a lay person via visual
inspection. Nor can NWVR be held liable for any injuries, accidents, theft, damages, or other
misfortune or harm that may befall the Guest and/or the Guest’s invitees during their stay at the
Property.
Neither NWVR or the Property Owner shall be responsible for providing any additional
furnishings or equipment not available in the Property during the Rental Period. It is understood
that each property and its furnishings are privately owned and NWVR acts solely as the Rental
Agent for the Property Owner. If large furniture is moved, the Guest will be responsible for any
charges incurred in returning it to its proper location. Port A is a small island and sometimes the
wifi and cellular signals can be weak. NWVR can not be held responsible if wifi doesn’t work.
5. OWNERS CLOSETS
Within each NWVR property, some garages, closets, or cabinets may be locked or inaccessible.
These are for the Property Owner’s use only and will not be available for Guest’s use.
Tampering with any of these will result in charges for any and all damages, replacement of

items, including additional housekeeping expenses and reasonable attorney’s fees. If the Guest
tampers with or breaks into a Property Owner's area, the Guest will be charged for breaking and
entering.
6. OCCUPANCY and PARKING: The Guest agrees not to exceed the occupancy allowed by
this property as described in this Rental Agreement. Occupancy is defined as every individual in
the household, regardless of age. Penalty for violation of this Agreement will result in the
immediate termination of the rental agreement with no refund for any remaining nights. Guests
also agree to use only the parking spaces provided for the property. Offending vehicles will be
towed at your expense without notice. No RV’s, campers, trailers or boats are permitted at any
of our properties that do not allow per the HOA rules. Violators will be asked to leave without a
refund.
7. NEIGHBORS: Please respect your neighbors as you would in your own neighborhood.
Many people live around you full time. Loud music or parties outside of the property after 10 PM
is prohibited. Violations of this rule could result in immediate eviction and loss of security
deposit. Please observe speed limits at all times and obey all golf cart rules.
8. PETS:

NOT all New Wave houses are pet friendly. Please confirm that your rental home is pet friendly before booking. We charge a non refundable $75.00 per pet fee for guests that bring their pets with a 2 pet maximum for short term rentals. There is also a $50 pet cleaning fee per unit. (total price of $125 pet fee for 1 pet, $200 for two pets.) Long term rental pet fees are $150 per pet/per month, plus the $50 cleaning fee. The property that the guest is staying at must be considered pet friendly. Pets are not allowed in properties that are not considered pet friendly.

The guest must notify NWVR that they will have a pet prior to the stay and make payment of the pet fee. The pet fee is non-refundable and will be charged before arrival. Pets are not allowed in any pool areas and dogs must be kept on a leash. Your pet must be bathed to prevent fleas and be current on all vaccinations. Proof of these vaccinations is required upon request. (Rabies vaccination is required by the state of Texas.). An additional $100.00 fee will be charged to your credit card on file for not cleaning up after your pet on the property, prior to your check out. Pets found at not pet friendly properties will result in a charge of $750 to your credit card. Non disclosure of a pet and no pet fee paid at a pet-friendly rental results in $400 being charged to your credit card. The guest agrees to indemnify, hold harmless and defend rental manager, rental manager’s agents or owner against all liability, judgements, expenses (including attorney’s fees) or claims by third parties for any injury to any person or damage to property of any kind whatsoever caused by the guest’s pet.

Please Note: Coyotes on the islands can pose a danger to your dog. Your dog must be leashed and under your control at all times. Lease laws are also enforced on the beach.

9. SWIMMING POOL USAGE:
For any NWVR rental properties with a private pool or community pool, neither NWVR nor the
Property Owners/HOA’s are responsible for injuries or accidental death resulting from utilizing
the pool or surrounding area. Guest and any of Guest’s invitees utilize any swimming pools and
surrounding areas located at the Property at their own risk, and are solely responsible for

ensuring that access to and use of any swimming pools on the Property is done safely and with
proper supervision, if applicable.
10. SMOKING POLICY:
Smoking and/or vaping is not permitted inside or on any rooftop decks or covered porches for
any of NWVR’s rental properties, including the Property subject to this Agreement. Guests will
be financially responsible for any damages and extra cleaning, if applicable, due to smoking in a
Non-Smoking designated property. If evidence of smoking/vaping exists, the Guest credit card
on file will be charged an additional $500 cleaning fee. An additional $100 grounds cleaning fee
will be charged for cigarette debris left by Guest and/or Guest’s invitees outside the Property.
11. GUEST RESPONSIBILITIES:
While there may be numerous occupants of the Property during the Rental Period, only the
Guest(s) signing this Agreement will be held responsible by NWVR for payment of the Rental
Amount, any additional fees, and all other Leaseholder responsibilities enumerated in this
Agreement.
12. Miscellaneous Fees:
The grill must be cleaned by the Guest prior to departure. A $25 fee will be charged to the credit
card on file for grill or fire pit cleaning not completed. If you leave an item behind, we will mail it
to you for a $25 charge plus postage. A $50 fee will be charged to the credit card on file for
excessive trash. Excessive trash is anything that has to be hauled away because it was left at
the property or doesn’t fit inside the receptacles. A lost key charge of $50 will be applied if any
property key is not returned to the NWVR office by check-out. Linen that is stained and can not
be fully cleaned will be charged $20 per sheet, $15 per towel and $5 per washcloth. Homes
that are left excessively dirty will also incur a $75/hour extra cleaning.
13. PENALTY FOR VIOLATION OF THIS AGREEMENT:
If the Guest violates any of the conditions or restrictions of this Agreement, NWVR reserves the
right to terminate this Agreement and enter the Property. Upon notice of termination of the
Agreement, the Guest and all invitees shall vacate the Property immediately without being
entitled to any refund of the Rental Amount, in addition to any other fees, expenses, or damages
that may be charged pursuant to this Agreement.
14. UNAVAILABILITY OF ACCOMMODATIONS:
NWVR reserves the right to move guest reservations to other comparable units based on
unforeseen circumstances that make the original rental unit unavailable (including, but not
limited to, a residence changes ownership; a residence is removed from the rental program; an
act of nature; a mechanical failure; or any other reason beyond NWVR’s control). In the event

that the dwelling is undergoing any major repairs during the Rental Period, NWVR shall be held
harmless by Guest. In such circumstances, NWVR will make every effort to move Guests to
comparable accommodations. Rental rates are subject to change based on comparable
accommodations. If comparable accommodations, based on NWVR’s recommendations, are
not acceptable, the Guest agrees to accept a refund of monies paid as full and final satisfaction.
15. REPAIRS/CONSTRUCTION/PROPERTY AVAILABILITY: During your stay, promptly report
any maintenance problems to NWVR by phone ator by email at
. Please callif urgent maintenance is needed
after hours: on call service available from 6pm - 9 am if your emergency includes:Locked Out of
The House, No Electricity, Flooding, No A/C or Heat. If you are having an issue with anything
else, we will be happy to come out during business hours.
Even the best or newest equipment occasionally malfunctions and cannot be guaranteed 100%
of the time. NWVR and the Property Owners use the best administrative staff and maintenance
personnel available. Problems are corrected as soon as humanly possible. NWVR or an
authorized employee or repairman may enter the premises during business hours for any
purpose connected with the repair, care, or maintenance of the Property. Refunds will not be
issued due to malfunctioning equipment or other Guest dissatisfaction with the Property or its
surroundings. NWVR rents properties in a highly desirable developing resort area with
surrounding properties occasionally under construction. Guests will not be moved or refunds
given due to construction noise.
16. HURRICANE EVACUATION POLICY: PLEASE READ CAREFULLY -
NWVR will not issue any refunds for delays or cancellations due to hurricane evacuations or any
other natural disasters. We encourage you to purchase travel insurance (including hurricane
travel insurance) with coverage for mandatory hurricane evacuations and all other natural
disasters (subject to policy terms and conditions) in order to protect your travel investment.
Guests should monitor severe weather and tidal flood event warnings during their stay.
Emergency evacuation will be at the expense of the rental customer. EMS, Fire Department,
and Police may not have access to the property due to beach conditions and/or tidal flood
events or others. All renters and their guests acknowledge and assume liability and risk.
17. PERSONAL PROPERTY/VALUABLES:
Lock all doors and windows when you leave the Property. We also highly recommend locking up
when enjoying the pool or beach. Neither NWVR nor the Property Owner will be held liable for
any lost or stolen items, or other damages to any personal property for personal items left by
Guest in the Property at departure or during stay. Thoroughly check all drawers and closets
before departing.
18. APPROVED USE OF THE PROPERTY:

Any use of the dwelling other than residential use during a family vacation must be approved in
writing by NWVR. If the dwelling is to be used for any event such as weddings, receptions,
“parties,” or large gatherings, the Guest agrees to submit a request for approval to NWVR and
adhere to NWVR’s determination on that request. If NWVR approves the event, the Guest will
be required to pay an “event fee” and a security deposit. New Wave will determine the “event
fee.” If the Guest misrepresents an event (said misrepresentation to be determined by agent),
the Guest will forfeit the security deposit, may be asked to vacate the property, and will not be
entitled to any refund.
19. GOVERNING LAW; VENUE.
This Agreement was negotiated in, entered in, and is performable in Nueces County, Texas and
shall be governed by and interpreted in accordance with the substantive laws of the State of
Texas without regard to its conflict of law principles. The Parties acknowledge and agree that
any and all disputes arising from or related to this Agreement or the obligations contained herein
shall be brought only in the state courts located in Nueces County, Texas. All parties to this
Agreement consent to personal jurisdiction in Texas. Both parties waive the right to trial. The
Parties agree that, in any suit or action to enforce the terms of this Agreement, the prevailing
party shall recover all costs and expenses, including, without limitation, reasonable attorney’s
fees and court costs.
20. NO ORAL MODIFICATIONS.
This Agreement may not be modified, amended, or terminated orally. No modification,
amendment, or termination, or any waiver of any of the provisions of this Agreement, shall be
binding unless the same is in writing and signed by the person against whom such modification,
amendment, or waiver is sought to be enforced.
21. NO WAIVER.
The failure of any of the Parties to enforce at any time any provision of this Agreement shall not
be construed to be a waiver of such provision, nor in any affect the validity of this Agreement or
any part thereof or any right of any person thereafter to enforce each and every provision. No
waiver of any breach of this Agreement shall be held to constitute a waiver of any other breach.

22. INDEMNIFICATION OF NWVR BY GUEST:
Guest hereby releases, remises, and agrees to indemnify, defend, and hold harmless the
Property Owner, NWVR and NWVR’s successors, assigns, officers, directors, owners,
members, shareholders, partners, managers, agents, affiliates, parent and subsidiary entities,
and independent contractors (the “NWVR Indemnitees'') of and from any and all liabilities,
losses, claims, actions, judgments, suits, fines, penalties, demands, actions, causes of action,

damages, costs, or expenses, including, but not limited to, all reasonable costs for defense and
investigation thereof (including but not limited to attorney’s fees, court costs, expert fees,
investigative fees, and other costs), whether based in contract or tort, law or equity, including but
not limited to claims for bodily injury, death, damage, or destruction to person or property, or any
other claims against any of the NWVR Indemnitees arising from, relating to, or in connection
with the Property or the performance by NWVR of the services described herein, including but
not limited to, any claims and/or actions which are founded in whole or in part upon the sole,
joint, comparative, concurrent, or proportionate alleged negligence of any of the NWVR
Indemnitees. This indemnity shall survive the termination or expiration of this Agreement.
23. ENTIRE AGREEMENT.
This Agreement constitutes the entire Agreement between the Guest and NWVR concerning the
rental of the Property described herein and supersedes and replaces any and all prior
agreements between the Guest and NWVR, if any, whether written or oral, concerning the rental
of the Property. It is understood and agreed that all future rights and obligations of the Parties as
to each other shall be governed solely by this Agreement.
